A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY WILLIAM E. ELMORE, JR. FOR
PROPERTY LOCATED ON THE WEST SIDE OF
RAVENSWOOD ROAD NORTH OF INTERSTATE 595(AKA-
2967 RAVENSWOOD ROAD) DANIA BEACH; PROVIDING
FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, William E. Elmore, Jr., has applied for site plan approval for the
proposed construction of a 7,760 square foot Office/Warehouse building to be located on
vacant property located on the west side of Ravenswood Road North of Interstate 595 (aka
2967 Ravenswood Road); and
WHEREAS, the Planning & Zoning Board on November 20, 2002, recommended
that the City Commission grant the site plan request (SP-61-02), based upon the criteria
set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of
Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-61-02) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A", is approved, subject to
the following conditions:
a) The addition of a window treatment to the front of the building.

b) Compliance with the following landscape comments:
1 Gumbo-limbo trees in rear yard to be located adjacent to the building
(Gumbo trees cannot be located in retention area).
2) Provide a 24" high, 24" spread, and 24" on center continuous (branch
touching branch) coco plum hedge along the entire perimeter of the site.
Indicate the different cross-hatching on each proposed shrub masses or
hedges in order to distinguish each material.
3) Add "minimum application of water to impervious areas" on the irrigation
notes and City of Dania Beach to the substitution note.
4) Change the proposed three deciduous Yellow Tabebua trees along the
north perimeter in front of Bay 1 to Green buttonwoods. Additionally, the
proposed two Sabal palms on each side of the Yellow Tabebuia should be in
groups of three and staggered (add one palm to each group of two).
5) The Sabal palm in the terminal landscape island next to the building
should be a group of three staggered palms. Lastly, the proposed Jacaranda
tree should be a Live Oak to keep the consistency in the design.
6) Indicate all sod areas on the landscape plans and add a one-year
guarantee to the notes on all landscape.
7) Change the proposed royal palms from Delonix regia to Toystonia elata
on the plant list. Additionally, indicate the FPL easement on the landscape
plans, as the palms may not be allowed in the present location because of
the overhead transmission lines. Lastly, add Florida fancy, heavy, and no
pencil topping to the specification of the Royal palms.

It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

foot office/warehouse building.
DATE: February 12, 2003
The applicant proposes a new 7,760 office/warehouse building on the west side
of Ravenswood Road north of I-595. The properties to the north and to the
east (across Ravenswood Road) are both vacant.
The property to the south is developed as a warehouse built in the 1980's
under County M-2 zoning. The existing warehouse is built right up to the south
lot line of the subject property with no setback.
The subject parcel is only 70 feet wide and proposes only 28 feet of building
frontage facing Ravenswood. While the building elevations are generally
acceptable, staff recommends the building frontage contain some glass
treatment consistent with IROM requirements.
PLANNING AND ZONING BARD RECOMMENDATIONS
1. Variance to provide 11 parking spaces (12 spaces required).
The parcel is only 70 feet wide, making 100% parking compliance
difficult. Also, the one space parking variance is minimal.
Approval of the parking variance, subject to the following:
a) The addition of a window treatment to the front of the building.
b) Compliance with the attached landscape comments.
2. Variance to allow zero setback along the south property line
(Minimum 10 foot setback required).
Approval subject to compliance with building, fire, and life safety codes.
The parcel is 70 feet wide and abuts zero-lot line industrial to the south.
Providing a 10 foot side yard setback between buildings in this location
would serve no useful purpose and make the subject parcel difficult to
develop.

W-ec. 22-5. Pavement, improvement and use of swale areas.
With respect to the paving, improvement and use of drainage swales within the public right-of-way of
streets.or other public rights-of-way owned or controlled by the city, the following standards and
regulations are hereby adopted:
(a) ' The area immediately adjacent to-the paved road surface extending to the right-of-way line or
to the edge of the sidewalk is primarily intended for the drainage of the paved roadway by percolation
of the Water through the natural sand soil and such area is not Intended for parking vehicles. It may
not be paved with any type of impervious paving or any type of lime rock or stabilizing materials,
excep(as follows:
(1) . Residential areas. Paved driveways for access to abutting property. In no event shall this
access drive or vehicular stopping area exceed thirty(30) percent of the frontage of the abutting lot.
(2) Commercial or industrial areas. The above standard for residential areas also applies to
commercial or industrial frontage. In the event a larger paved area is desired for parking or access,
the owner of the abutting property must provide for subsurface drainage areas or other facilities which
will be equal to the additional area which is proposed to be paved. A permit from the building division
must be obtained for this construction, Application for a permit shall consist of a proposed plan
including details of the construction, drawn, signed and sealed by a civil engineer and a completed
permit application by an appropriately licensed contractor. The application package will be reviewed
by the public works department and issued by the building division upon the approval of the public
works department. Maintenance of such systems is the responsibility of the abutting property owner.
(b) Drainage of paved areas on private property shall not drain Into the public right-of-way.
(c) Sodding of the swale area and right-of way is encouraged and permitted up to the edge of the
aved =1s46) shall be constructed to conform with the sketch included in the regulations as
adopted by subsection (f)hereof.
(e) briveways or parking areas constructed of concrete are prohibited in the public right-of-way.
(f) the certain diagram entitled "Swale Areas for Residential and Commercial Frontage"which is
attachdd to the regulations of the engineering department and which were approved December 8,
1959, three (3)copies of which are on file in the office of the city auditor and clerk, is hereby adopted
and made a part hereof by reference and shall apply in the city.
(g) No rock other than washed three-fourth ( 3/4) rock shall be used unless paved over.
(h) All work done in the swale area shall be done at the owner's risk; if the city has to remove the
same, there will be no recourse.
(i) The installation and uses within street swale areas within the City of Dania Beach, Florida, are
limited to the following:
(1) Traffic control devices such as signal lights, stop signs and yield signs;
(2) Utility systems and appurtenant structures;
(3) Drainage systems and appurtenant structures;
(4) Mail boxes;
(5) Grass sodding or grass seeding of the swale area is permitted and encouraged. The planting
of single truck trees shall be permitted in swale areas, with the exception of any causuarina trees
(Australian pine trees), Melaleuca trees, Brazilian oak, rubber trees, or ficus trees, so long as the
following conditions are complied with:
a. Trees shall be planted not closer to the street pavement than one-half the distance between
the property line and the street pavement.

Trees shall not be planted closer together than twenty-five (25)feet and on comer lots shall be
planted not less than twenty(20)feet from the intersection of any street lines or street lines ro 0 p p sed.
C. No trees shall be permitted which are less than six(6)feet in height at the time of planting.
d. All trees shall be kept trimmed by the abutting property owner,or tenant and shall have a
clearance of at least eight (8) feet above the sidewalk and ten (10)feet above the street level so as to
permit pedestrian and vehicular traffic beneath them without interference.
e. If roots and branches of any trees, hedges, or other plant growth shall cause damage or
destruction to any sidewalk, curb, gutter, street pavement, utility line or other city-owned or publicly
owned::property, the director of public works shall notify the owner of the trees, hedges, or other plant
growth by notice in writing, to cut down, destroy, or remove such trees within ten (10)working days
from the date of receipt of the notice. In the event the owner shall fail or refuse to cut down, destroy,
or remove same within the ten (10)working days, the director of public works shall cause the trees,
hedges, or other plant growth to be removed or destroyed and shall charge the cost thereof against
the owner. The amount of the cost to the city shall be constituted as a lien upon the property and shall
be added to the utility bill.
(6) Low-profile, dome-shaped decorative blocks or markers not to exceed twelve (12) inches in
diameter and six(6) inches in height shall not constitute Items which Interfere with the drainage of the
Swale areas and shall specifically be permitted along street rights-of way, drives, and public walks In
the city. These dome-shaped decorative blocks or markers shalt have rounded surface areas and no
comers which make a right-angle projection comer interface. In the event that dome-shaped
decorative blocks or markers are placed In the swale area, which shall be expressly permitted, they
shall be painted white or with a white reflective material.
