HomeMy WebLinkAboutR-2003-117 Support Hollywood Civil Action agst BCnty re Public Records Airport RESOLUTION NO. 2003- 117 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SUPPORTING THE ACTIONS OF THE CITY OF HOLLYWOOD BY AUTHORIZING THE CITY TO JOIN HOLLYWOOD AS A PLAINTIFF IN THE FILING OF A CIVIL ACTION NAMING BROWARD COUNTY FOR FAILURE OF THE COUNTY ATTORNEY TO PROVIDE COPIES OF PUBLIC RECORDS REQUESTED BY THE CITIES PURSUANT TO THE PUBLIC RECORDS ACT, PROVIDING FOR CONFLICTS, FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on October 30, 2002 and again on April 8, 2003, the City Attorney of Hollywood, Florida sent a request pursuant to the Public Records Act (Chapter 119, Florida Statutes), to the Broward County Attorney for copies of certain public records relating to the proposed expansion of Fort Lauderdale- Hollywood International Airport; and WHEREAS, the Dania Beach City Manager sent a similar request to the County Attorney; and !WHEREAS, Broward County has failed to provide copies of the requested records, claiming that they are exempt from disclosure; and WHEREAS, the City Commission of the City of Dania Beach believes that the requested records are not exempt from disclosure; WHEREAS, the proper procedure to determine whether the County Attorney is obligated to provide the requested records is to file a civil action to enforce the Public Records Act, and !WHEREAS, the City Commission of the City of Dania Beach desires to join the City of Hollywood and the Town of Davie as plaintiffs in the civil action to enforce the Public Records Act; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY F OF DANIA BEACH, FLORIDA: Section 1. That the foregoing "WHEREAS" clauses are ratified and confirmed as being true and correct and they are made a specific part of this resolution. 1 RESOLUTION NO. 2003-117 Section 2. That the City Commission of the City of Dania Beach, Florida, expresses its support of the City of Hollywood in its intent to file a civil action naming Broward County, its officials or both, to enforce the Public Records Act and the City of Dania Beach is authorized to join the suit as a Plaintiff to seek any and all appropriate remedies. Section 3. That all resolutions or parts of resolutions in conflict are repealed to the extent of such conflict. Section 4. That this resolution shall take effect immediately upon its passage and adoption. PASSED AND ADOPTED this 13th day of May, 2003.
