RESOLUTION NO. 2003- 141 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY THE CITY OF DANIA BEACH, FROM CHAPTER 28,ZONING,AND FROM CHAPTER 26,VEGETATION, ARTICLE IV LANDSCAPING, FOR PROPERTY LOCATED AT THE NORTHWEST COMMUNITY OUTREACH CENTER AT THE SOUTHEAST CORNER OF NW 8T" AVENUE AND NW 1ST STREET, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 6.21, sets the Off Street Parking requirements for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 5, sets the Supplementary Lot requirements for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, Vegetation,Article, IV Landscaping sets the Landscape requirements for the City of Dania Beach; and WHEREAS, The City of Dania Beach has applied for a variance (VA-30-03)to allow o Waiver 20% of the total vehicular use area (exclusive of perimeter landscape buffers. O Waiver 2' of the required 6 foot high fence along the south property line to provide a 4 foot high fence. • Waiver 24' high perimeter hedge requirement. © . Waiver required 24 foot wide drive way (20 foot wide drive provided). ® Waiver required 10 foot south property line buffer (8.5 foot setback). for property located at the Northwest Community Outreach Center at the Southeast Corner of NW 8t" Avenue and NW 1st Street, Dania Beach; and WHEREAS, the Planning &Zoning Board on April 23, 2003, recommended thatthe City Commission grant variance request VA-30-03 based upon the criteria set forth in Section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: 1 RESOLUTION NO.2003-141 Section 1. That that certain application VA-30-03,for a variance as described above s (from requirements in Chapter 28, Zoning and Chapter 26, Vegetation), a copy of which is attached as Exhibit "A" is approved. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. The site plan proposes a parking lot with 10 parking spaces. The parking lot will have landscaping around it and a four (4) foot decorative fence. Due to the small size and width of the property, some of the required landscaping cannot be installed without a substantial loss in parking spaces.
