HomeMy WebLinkAboutR-2003-150 Agenda Items RESOLUTION NO. 2003-150 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, PERTAINING TO AGENDA ITEMS FOR REGULAR CITY COMMISSION MEETINGS; ESTABLISHING PROCEDURES FOR PLACEMENT OF ITEMS ON SUCH AGENDAS AND TIME REQUIREMENTS FOR SUCH PLACEMENTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That for agendas prepared for regular City Commission meetings (which meetings are held on the second and fourth Tuesdays of each month), the City Manager and City Clerk are authorized to close such agendas as of 5:00 P.M. on the first and third Tuesdays of each month; provided, however, that subject to the requirements of applicable laws pertaining to public notice, any City Commissioner or the City Manager may request that an item be placed upon any such agenda at any time before a meeting begins, if in the opinion of the Commissioner or the Manager, the item is of an urgent nature. No person shall be considered to have the right or privilege to direct the placement of an item on an agenda other than a City Commissioner or the City Manager. Any item may be added to an agenda at the beginning of a Commission meeting if authorized by a majority vote of the City Commissioners present at the meeting, subject to compliance with all applicable laws pertaining to public notice. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. 1 RESOLUTION NO. 2003-150 Section 3. SBRO CITYATTORNEY • 2 RESOLUTION NO. 2003-150 CITY OF DANIA BEACH MEMORANDUM TO: Charlene Johnson, City Clerk CC: Ivan Pato, City Manager FROM: Tom Ansbro, City Attorney DATE: June 3, 2003 RE: Proposed Resolutions Amending Agenda Procedures, City Commission Meetings "Order of Business" • Following are two proposed Resolutions. The first is, in effect, a "replacement" of Resolution No. 11-84 of March 13, 1984. I want to be certain that as drafted, our "agenda procedures" Resolution comports with Commissioner Mikes' intent, i.e., removal of reference to "Clerk-Auditor", deletion of mandatory wording ("shall") provision regarding agenda items' placement and provision of clear authority for any Commissioner and the City Manager to add items to an agenda before a regular meeting. As we discussed, I also added provisions that allow such placement subject to compliance with all applicable laws pertaining to public notice. If you feel any of the other verbiage needs to be retained from the 1984 Resolution, please advise and the Resolution can be expanded accordingly. The second Resolution would amend Resolution 28-85, to provide for the revised "Order of Business". I believe that is the only change you mentioned that needs to be done, so there is no point in completely replacing the 1985 Resolution and effectively reprinting it. Again, your comments are welcome. Please also recall that I am out of town from Wednesday, June 4 to and including Monday, June 9, 2003, but can be paged. 566.028 TJA:slw Attachments • f GENERAL RULES & PROCEDURES FOR PUBLIC PARTICIPATION AT COMMISSION MEETINGS I. WHO MAY SPEAK *Any individual who wishes to address the Commission, on any subject within the scope of the Commission authority, may do so providing it is accomplished in an orderly manner and in accordance with the procedures outlined below: A. SPEAKING ON ITEMS ON THE AGENDA 1. Consent Agenda Items. These are items which the Commission does not need to discuss individually and which are voted on as a group. If any member of the public wishes to comment or to be heard on any of theses items, he/she must notify the Commission Chair, in writing, prior to the start of the meeting. This will permit the Chair to pull such items for individual discussion at a time convenient to the Board. Notification can be accomplished by a handwritten note addressed to the Chair but furnished to the Minutes Secretary or Deputy, indicating the individual's name, address, telephone number, the agenda item(s), and reason for discussion. 2. Regular Agenda Items. These are items which the Commission will discuss individually in the order listed on the agenda. Individuals who wish to participate in these discussions may do so by merely raising their hand during the discussion and being recognized by the Chair. The Chair will determine the order in which each individual will speak and length of time allotted. B. SPEAKING ON SUBJECTS NOT ON THE AGENDA 1. Any individual or group may petition the Board to speak on any subject pertinent to Broward County. This can be done by submitting a letter to the County Administrator at least two (2) weeks in advance of the meeting at which they wish to appear. Send it to Assistant to the County Administrator, Room 409, Broward County Governmental Center, 115 S. Andrews Avenue, Fort Lauderdale, FL 33301, telephone number (954) 357-7353. Back-up material must be included. Late distribution of such material or distribution to other individuals or groups without furnishing copies to the Board of County Commissioners may mean deferral of the delegation to a future meeting in order to allow the Board an opportunity to review such material before discussion. 2. Each delegation will be notified of the scheduled appearance date and time. Copies of the agenda will be • available in the meeting room on the day of the meeting. C. SPEAKING AT PUBLIC HEARINGS 1. Any member of the public may participate in discussions held at public hearings. Discussion is limited to the subject being discussed, as listed on the Agenda. The Chair will call for interested parties to be heard as each item for discussion is introduced. Those interested will ask for recognition by raising their hand at the time indicated by the Chair. 2. Public hearings will be advertised according to law and are held on the second Tuesday of each month at 2 p.m. Zoning Public Hearings are quasi-judicial and are held on the fourth Tuesday of each month at 2 p.m. Other public hearings may be scheduled as needed. They will be advertised according to law. D. QUASI-JUDICIAL PROCEEDINGS 1. Certain items on the Commission's agenda are quasi-judicial in nature. If you wish to object or comment upon these items, please indicate the item number you would like to address when the announcement regarding the quasi-judicial item is made. You must be sworn before addressing the Commission, and if you wish to address the Commission, you may be subject to cross-examination. If you refuse to submit to cross-examination, the Commission will not consider what you have said in its final deliberations. II. ADDRESSING COMMISSION, MANNER, TIME The length of time each individual may speak must be limited in the interest of order and conduct of the business at hand. The Chair will set this limit at his/her discretion, but will allow the individual sufficient time for a thorough presentation, if within reason and proper order. Each person, other than salaried members of the County staff, who addressed the Commission shall step up to the speaker's lectern and shall give his/her name, address and who he/she represents and whether he/she is being compensated by the person(s)for whom he/she speaks. III. DECORUM Any person making impertinent or slanderous remarks or who becomes boisterous while addressing the Commission hall be barred from further audience before the Commission by the presiding officer, unless permission to continue or gain address the Commission be granted by majority vote of the Commission members present. (The above represents a summarization of rules pertaining to public participation at Board Meetings. Chapter 18, Part I of the Broward County Administrative Code lists the official Rules of Procedures of the Board of County Commissioners of Broward County. CITIZENS' COMMENTS: Addressing the Commission:Comments by Dania Beach citizens or interested parties that are not part of the regular agenda may be made during each Commission meeting during the period set aside for "citizen comments." A thirty (30) minute "citizen comments" period shall be designated on the agenda for citizens and interested persons to speak on matters not scheduled on that day's agenda. The citizen comments period shall begin promptly at 7:00 PM. Each speaker shall be limited to 3 minutes for his or her comments. Persons desiring to speak during the citizen comment period shall inform the City Clerk immediately prior to the beginning of the meeting of their intention to speak. If more than 10 speakers express a desire to speak, the Commission shall determine on a meeting by meeting basis whether to (a)extend the time allotted for citizen comments to accommodate all speakers, or (b) whether to limit the number of speakers or amount of time per speaker.
