A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA, URGING GOVERNOR
JEB BUSH TO VETO SENATE BILL 676, WHICH SEEKS TO
EXCLUDE CITIES AND COUNTIES FROM PARTICIPATION
IN OR REVIEW OF THE FLORIDA DEPARTMENT OF
TRANSPORTATION'S PLANNING OF EXISTING AND
FUTURE TRANSPORTATION FACILITIES AND
APPURTENANCES; PROVIDING FOR CONFLICTS;
FURTHER,PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Senate Bill 676 was prefiled in the Florida Senate on February 4, 2003, and
was described as making technical amendments to various statutes relating to transportation; and
WHEREAS, Senate Bill 676 proceeded to be reviewed by the Transportation,
Appropriations and Economic Development Committees of the Senate and was placed on the
Senate calendar for second reading on May 1, 2003; and
WHEREAS, on second reading, without prior notice or further committee hearings, Senate
Bill 676 was amended to substantially impair the ability of cities and counties to regulate local
development in their jurisdictions; and
WHEREAS, Senate Bill 676 amends Section 335.02, Florida Statutes, to add a new
subsection, which provides:
"Notwithstanding any general law or special act, regulations of any county, municipality, or
special district, including any instrumentality thereof, shall not apply to existing or future
transportation facilities, or appurtenances thereto, on the State Highway System"; and
WHEREAS, this amendment will undo years of growth management legislation that
required the Florida Department of Transportation to coordinate with local government jurisdictions
when planning new transportation facilities and placed limits on the other types of development
proposed by FDOT that was not directly related to roadway improvements; and
WHEREAS, Senate Bill 676 eliminates the ability of the cities and counties to have a voice
in the type of development the Florida Department of Transportation undertakes in their
jurisdictions; and
WHEREAS, Senate Bill 676, in effect, gives the FDOT free rein throughout the state to
locate transportation facilities or"appurtenances"wherever it, in its sole discretion, chooses; and
WHEREAS, the manner in which this amendment was put forward — in the closing days of
the Legislative session, in a bill described as correcting "various technical problems in the statutes",
without notice, without discussion or debate, without the knowledge of the state's planning agency,
the Florida Department of Community Affairs, and without any participation by cities and counties
has paved a path for bad public policy to guide future transportation planning in the state; and

WHEREAS, there is no current pressing need to correct the "technical" problems in state
• statutes addressed in the original version of Senate Bill 676, some of which have existed for many
years; and
WHEREAS, Senate Bill 676 will do great harm to the state by eliminating any involvement
in transportation planning decisions by local citizens of this state through their city and county
governments.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA THAT:
Section 1. Governor Jeb Bush is urged in the strongest terms to veto Senate Bill
676 because it would exclude cities and counties from any participation in or review of Florida
Department of Transportation's decisions regarding the development of existing and future
transportation facilities and appurtenances in their respective jurisdictions.
Section 2. This Resolution shall become effective upon its passage and
adoption.

Bill 676
Dear Ms. Johnson:
• Enclosed please find City of Sunrise Resolution 03-76, urging Governor Jeb
Bush to veto Senate Bill 676. This legislation seeks to exclude cities and
counties from participation in or review of the Florida Department of
Transportation's planning of existing and future transportation facilities and
appurtenances. It would be greatly appreciated if you would distribute this
