WHEREAS, The Broward County Zoning Code Section 39-240, sets the Off-Street Parking requirements for the City of Dania Beach; and WHEREAS, The Broward County Zoning Code Article VIII sets the landscaping requirements for the City of Dania Beach; and WHEREAS, Rabbi Andrew Skurowitz, has applied for a variance(VA-45-03) requesting the following: 1. To waive the requirement that residentially zoned property(north parcel)can only be used to accommodate 25%of the required parking for adjacent non-residentially used development (existing school"Brauser Maimonides Acadamey"). Section 39-240, entitled Off-Site Parking Lots. 2. To waive the 10 foot landscape buffer around the parking lot as identified in Section 39-240, entitled Off-Site Parking Lots. 3. To waive general landscape requirements identified in Article 8 entitled, Functional Landscaping and Xeriscaping. for property located at 5300 SW 40th Avenue, in the City of Dania Beach; and WHEREAS, the Planning & Zoning Board on June 18, 2003, recommended that the City Commission grant variance request VA-45-03 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-45-03,for a variance as described above, a copy of which is attached as Exhibit "A" is approved, subject to the following conditions: 1 RESOLUTION NO.2003-167 1) Indicate the highest elevation on the adjacent east property line, in order to determine the 0 slope of the 10' buffer. Note:The maximum elevation drop must be 6"to 8"on all landscape buffers. 2) Name the unmarked tree. 3) Change the multi-stemmed and Silver buttonwood trees to single leadertrees and move one of the proposed Silver Buttonwood trees outside all the small landscape islands to another location. 4) Landscape consultant to verify condition of Oak and Banyan trees prior to issuance of any tree removal permits, including payment of tree removal fees if applicable. 5) The sheds along the west property line should be removed within sixty days. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Addressing additional landscape requirements for the southern portion of the site (existing to remain): • additional trees and shrubs required per 3,500 s.f. of pervious area • additional tree per 200 s.f. of required VUA landscape area ■ additional tree per 40 linear feet of entire site ■ additional tree per 80 linear feet along adjacent residential properties ■ minimum tree and shrub sizes(height, spread, caliper, etc) ■ minimum percentage of native landscape ■ minimum groundcover coverage requirements This project comprises the addition of a small modular classroom building to an existing school site as well as the inclusion of additional property to the north, which O will be modified to accommodate a new parking lot and entry gate. Although there are to be some minor landscape modifications directly adjacent to the new building, the southern (existing) portion of the combined site is to remain almost exactly as it is in terms of site work and landscaping. To modify the landscape on this portion at this time will require extensive site work that is not within the scope of the budget. As can be seen from the proposed master plan, the school intends to develop this site further in the future. At that time, the landscaping will be modified across the entire site. At this time however, the school would simply like to provide adequate parking for these future developments and will develop the corresponding northern portion of the site accordingly, including the items listed above for which a variance is being requested for the southern portion of the site. For example, the additional tree required for each forty linear feet of perimeter of the entire site would instead be considered an additional tree per forty linear feet of perimeter of the northern portion of the site. Addressing the sidewalk along the southern property line: The site has an existing five-foot wide concrete sidewalk approximately 240 feet long, set back five feet from the southern property line. The city is requesting that this sidewalk be removed due to a code requirement of a ten-foot landscape buffer along the southern property line. While there is ten feet of landscaping(cumulative) between the buildings and the property line, it is divided into two five-foot stretches—one along the property line, and one adjacent to the new modular classroom building. These two stretches of landscaping area are separated by the sidewalk and existing asphalt paving. The sidewalk provides safe pedestrian access to the classroom buildings, allowing a person to reach them without having to cross the middle of a paved driveway. Therefore, the petitioner requests that the existing sidewalk be allowed to remain. 3. Addressing the six foot high solid perimeter wall/fence: This site has residential properties adjacent to the north, south, and east property lines, and the code requires that a solid wall or wood fence border any adjacent residential properties. There is an existing six-foot high concrete wall along the majority of the north property line,which is to remain. The remainder of the north • property line and the entire east property line are bordered by an existing chain link fence, which is to remain. The south property line has an existing chain link fence also, but has existing landscape hedging that serves as a visual barrier between the residential and educational uses. The area of the site that is bordered by simply a chain link fence does not contain any buildings, structures, or even paving. It is a landscaped retention area. Because of this, the visual barrier of a solid wall or a wood fence is not needed. Addressing the off-site parking lot requirements: Section 39-240 of the zoning code of Broward County requires that no site may be used to supply more than 25% of the required off-street parking for another site. Parking for Maimonides Academy is provided on both the north and south portions of the combined property. The southern site contains the school buildings and also provides 59.25% of the required 79 parking spaces. Although the northern site contains more than the maximum 25% of the parking for the southern site, the two sites share a common property line and essentially function as one property. The southern site does not have enough space to provide adequate parking for the current proposed needs of the school. Not only does the configuration of the existing buildings cover much of the southern site, but the majority of the remaining open space is needed for storm water retention. In addition, extra parking (above and beyond the 79 required spaces) is being proposed at this time for future school expansion. There simply is not enough room on the southern site for this additional parking. Therefore, the petitioner requests that the northern site provide more than 25% of the required off-street parking for the school buildings on the adjacent southern site. Variance 1. To waive the requirement that residentially zoned property (north parcel) can only be used to accommodate 25% of the required parking for adjacent non-residentially used development (existing school). Section 39- . 240, entitled Off-Site Parking Lots. 2. To waive the 10 foot landscape buffer around the parking lot as identified in Section 39-240, entitled Off-Site Parking Lots. 3. To waive general landscape requirements identified in Article 8 entitled, Functional Landscaping and Xeriscaping. Site Plan: New classrooms (south parcel) and parking lot (north parcel). SITE PLAIN ANALYSIS: The site plan proposes the following: a) New 4,000 square feet modular classroom along the south lot line of the existing school parcel. The school parcel is zoned Institutional (I-1). b) New parking lot on the property directly north of the school parcel. This parcel is zoned Residential Multiple Family (RM-15). Applicant also proposes a new driveway be installed adjacent to the north lot line of the north parcel. The new driveway shall be limited to exit only and may require the approval • of Broward County Traffic Engineering. Applicant also proposes (not part of this application) to construct new school • buildings on the north parcel in the future. Applicant has been advised this property may not be approved for school use until it is rezoned to I-1 zoning. Applicant has not yet submitted a rezoning application. The site plan has been reviewed by staff and the City's Landscape Consultant. Attached Exhibit A is a list of the outstanding landscape issues that should be addressed by the applicant prior to issuance of a building permit. Applicant proposes the following tree preservation, relocation, and removal program along the north lot line. a) 14 trees to be preserved; including eight Ischemia, one Tulip tree, and five Royal Palms. b) Three Royal Palm trees to be relocated. c) 12 trees to be removed; including four Melaleuca, two Live Oaks, one Banyan, three Schifflera, and two Florida Holly. d) 33 new trees; including 30 Green Buttonwood and three Silver Buttonwood. These trees will be planted in two rows, each row approximately 30 feet apart. Applicant had originally represented that no trees would be removed along the north lot line, but as indicated above, is proposing the removal of 12 trees, including two • live oaks (represented as badly cut) and one large Banyan tree. Staff is requesting review of these three trees by the City Landscape Inspector. VARIANCE ANALYSIS: 1. To waive the requirement that residentially zoned property (north parcel) can only be used to accommodate 25% of the required parking for adjacent non-residentially used development (existing school). Section 39-240, entitled Off-Site Parking Lots. The applicable Broward County Zoning Code allows parking lots on RM-15 property for adjacent institutional uses provided the parking lot provides no more than 25% of the parking required for the school. The school currently provides 37 parking spaces. Based on proposed Phase I classroom expansion, a total of 79 parking spaces is required. Under the 25% rule, only 20 spaces may be constructed on the RM-15 parcel. The applicant has revised their original variance request of 100 spaces to 80 on the RM-15 parcel. Staff is in support of this variance, provided that a minimum 20 foot landscape buffer is provided along the north property line. • 2. To waive the 10 foot landscape buffer around the parking lot as identified in Section 39-240, entitled Off-Site Parking Lots. The proposed landscape buffer located along SW 40t' Avenue varies between 27 feet and six (6) feet wide. Because only a small portion of the SW 40"' Avenue buffer is less than 10 feet, staff recommends waiving this requirement as per the site plan. 3. To waive general landscape requirements identified in Article 8 entitled, Functional Landscaping and Xeriscaping. The proposed site plan does not meet many landscape requirements (See Exhibit A). Due to the size of the lot, staff feels there is adequate area to provide all of the required landscaping. Therefore, staff cannot support this general landscape variance request. PLANNING AND ZONING ADVISORY BARD RECOMMENDATION Variances 1. To waive the 25% maximum allowed of the required parking for a non- residentially used plot. Section 39-240, entitled Off-Site Parking Lots. Approval, subject to applicant providing a minimum 20 foot wide landscape buffer along the north lot line. Staff concurs with this recommendation. 2. To waive the 10 foot landscape buffer adjacent to SW 40 Avenue, as identified in Section 39-240, entitled Off-Site Parking Lots. Approval,, as per revised site plan dated June 25, 2003. Staff concurs with this recommendation. 3. To waive general landscape requirements identified in Article 8 entitled, Functional Landscaping and Xeriscaping. Approval of the general landscape variance. Approval of this variance would alleviate the applicant of complying with the outstanding landscape requirements identified in Exhibit A. Staff does not support this variance request because the size of the lot is adequate to provide all of the required landscaping on site. Site plan Approval, subject to applicant addressing the following items prior to issuance of construction permits. a) Exhibit A landscape comments attached. b) New north northern driveway to be "exit only" and approved by Broward County Transportation Engineering (if required). Staff concurs with this recommendation. EXHIBIT A: Landscape Conditions • Unless otherwise indicated, these comments refer to the north parcel only. 1. Indicate the 6 shrubs per 3,500 square feet of pervious area calculations for the north side of the site. Also revise the landscape calculation table to indicate the existing trees, total required, total provided and no minuses. 2. Change the Project Relocation Note #4 on Sheet L-2 to"equal replacement". 3. Label the required 5" high Type "D" curbing in the vehicle overhang areas on Cross section A-A of the Civil Engineering plans. 4. Indicate the highest elevation on the adjacent east property line, in order to determine the slope of the 10' buffer. NOTE: The maximum elevation drop must be 6"to 8"on all landscape buffers. 5.
