RESOLUTION NO. 2003- 169 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING A REQUEST SUBMITTED BY BONNIE MISKEL, RUDEN-MCCLOSKY, REPRESENTING DANIA BEACH HOTEL, LLC., FOR A SPECIAL EXCEPTION TO ASSIGN 90 FLEXIBILITY UNITS TO CONSTRUCT A MIXED USE DEVELOPMENT AT 180 EAST DANIA BEACH BOULEVARD; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Zoning Code provides that mixed-use residential/commercial is allowed as Special Exception Use in C-2 zoning districts with the allocation of reserve or flex units; and WHEREAS, the Dania Beach Hotel, LLC., has applied for a Special Exception request to assign 90 flexibility units to construct a Mixed Use Development located at 180 East Dania Beach Boulevard, (Southwest corner of Southeast Second Avenue and Dania Beach Boulevard), located within a C-2 (Commercial) zoning district; and WHEREAS, the Planning &Zoning Board on June 18, 2003, recommended that the City Commission grant the Special Exception request, based upon the criteria set forth in Chapter 28, Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special Exception Uses, of the Code of Ordinances of the City of Dania Beach. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That certain application SE-46-03, for a Special Exception Use to construct a Mixed Use Development for property located at 180 East Dania Beach Boulevard (Southwest corner of Southeast Second Avenue and Dania Beach Boulevard), located within a C-2 (Commercial) zoning district; a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved, subject to the following conditions: 1 RESOLUTION NO.2003-169 a The special exception/flex tion/flex unit allocation confers no vested rights or entitlements p p 9 with respect to building design, building height, setbacks, density, required parking, tree preservation, and landscaping beyond what is allowed or required under existing zoning. b) The flex/reserve allocation confers no vested rights or entitlements with respect to modification, alteration, or demolition of the historic Dania Beach Hotel. c) Due to the size, scale, and location of this project, certain issues must be addressed before special exception/flex unit allocation can be made permanent. These include, but are not limited to, neighborhood compatibility, residential density, building height, setbacks, design, architecture, and (if deemed required) roadway dedication and off-site traffic improvements to SE 2"d Avenue and/or Park Street. d) City Commission approval of the special exception and flex unit allocation automatically expires at the end of six months unless extended by the City Commission. e) Within six months of approval, applicant shall submit substantially completed site and architectural plans of sufficient detail to evaluate compliance with zoning code, city code, comprehensive plan, and historic preservation regulations. Concurrent with site plan submittal, applicant shall submit a parking/traffic analysis for review by the City's traffic engineering consultant. f) At the time of the site plan application, applicant shall submit a minimum $15,000.00 application/cost recovery deposit to defer the initial cost of site plan, architectural, historic preservation, and traffic review by City staff and consultants. g) Applicant voluntarily commits to restricting residential dwelling units to condominiums. 2 RESOLUTION NO.2003-169 Section 2. The request is for a Special Exception Use to assign approximately 90 flexibility units to construct a 90 dwelling unit mixed-use development adjacent to the Dania Beach Hotel. This property is bound by Dania Beach Boulevard to the north, SE 2"d Avenue to the east, and Park Street to the south. Land Use Analysis • The subject parcel contains approximately 2.7 gross acres. The Zoning Code provides that mixed-use residential/commercial is allowed as a Special Exception use in C-2 zoning districts with the allocation of reserve or flex units. This provision has previously been used to approve Michael Shiff's retail/residential project under construction east of the Dania Beach Hotel. More recently, this process has been used to assign 300 flexibility units to redevelop the Fish Grill/Pirates Inn and related properties on the north side of Dania Beach Boulevard. The Community Redevelopment Agency (CRA) Plan, adopted by the City Commission, conceptually approved 6 to 8 story • residential or mixed-use residential development at this location. Dania Bch Hotel-special exception.DOC 1 of 4 The pending Local Activity Center ("LAC') land use plan amendment also endorses the mixed-use multi-story residential concept at this location. Staff has explained to the applicant that the current zoning designation limits building height to 40 feet and approval of flex unit allocation confers no vested rights or entitlements of any kind beyond what is allowed under the current zoning. The applicant has been advised building height cannot exceed 62 feet without a 4/5 vote of the City Commission. Flex Unit Assignment This subject parcel is located within a geographic planning area known as Flexibility Zone 84. Flex Zone 84 includes the entire City east of the FEC railroad tracks. Based on this application and previously flex/reserve unit applications, allocation of approximately 90 flex units to the subject parcel will exhaust the pool of flex units in Flex Zone 84, resulting in zero units left. The pending Local Activity Center amendment, if. ultimately approved by Broward County, would create a pool of 2,000+ additional units in the downtown area. While the applicant is requesting 90 flex units at this time, he indicates the total project would include 150 units. The City Commission will not be able to assign additional units to this parcel until the LAC land use plan amendment is approved • by the County Commission and Florida Department of Community Affairs. Applicant's Proposal/Historic Hotel Designation The site is currently occupied by the Dania Beach Hotel. The hotel consists of approximately 50 rooms (most without bathrooms), a lobby area, restaurant area (not used), and a package liquor store and bar. The hotel is currently designated a historic structure pursuant to local ordinance along with five other buildings in Downtown/US 1 area. The hotel meets several criteria for historic designation, including architectural heritage and association with an individual who contributed significantly to Dania Beach (see attachment). While the hotel is not listed on the National Historic Register, the City's local historic designation precludes the alteration, modification, or demolition (in part or whole) without separate action of the Dania Beach City Commission. Applicant's conceptual plan proposes to demolish the north and south residential wings of the hotel. The hotel central core (building entrance, lobby, and restaurant area) would be retained and architecturally integrated into the following new development. This building would include 90 condominiums above first floor retail. 2) New four/five story residential building (directly south of hotel core) facing SE 2nd Avenue and Park Street. This building would include 60 condominiums. 3) New four/five level parking garage on the west portion of the site (The garage is not shown on the perspective drawing). Applicant's conceptual rendering shows that new construction would mimic the architecture of the existing hotel. PLANNING AND ZONING ADVISORY BARD RECOMMENDATION On June 18, 2003 the Planning and Zoning Advisory Board recommended approval of the requested Special Exception flex unit assignment. STAFF RECOMMENDATION The allocation of flex and reserve units at this location is consistent with both the CRA Plan and the LAC land use plan amendment. As such, staff supports "temporary approval" (up to six months) of the special exception and 90 flex units. However, much more information must be submitted and evaluated before staff can offer any recommendation on the site plan or applicant's proposal to demolish significant portions of the original hotel. As such, staff recommends approval of only the special exception and approximately 90 flex units for six months subject to the following conditions: 1) The special exception/flex unit allocation confers no vested rights or entitlements with respect to building design, building height, setbacks, density, required parking, tree preservation, and landscaping beyond what is allowed or required under existing zoning. 2) The flex/reserve allocation confers no vested rights or entitlements with respect to modification, alteration, or demolition of the historic Dania Beach Hotel. 3) Due to the size, scale, and location of this project, certain issues must be addressed before special exception/flex unit allocation can be made permanent. Summary The Dania Beach Hotel, located at 180 East Dania Beach Boulevard, appears eligible under National Register Criteria B & C for its local significance for listing on the National Register of i Historic Places in the areas of local history, community planning and development, architecture, and commerce and economic growth. Under criteria B, the structure possesses significance for its association with architect Francis Abreu and to its builder Art J. Ryan, Sr. and for their considerable contributions to the area's development. Abreu, having practiced in nearby Fort Lauderdale, was most noteworthy for his regional interpretations of the Mediterranean Revival style of architecture. His various commercial and residential structures can be found throughout South Florida and the Dania Beach Hotel is perhaps one of his finest works. The hotel's builder, Art J. Ryan, Sr. was a prosperous land developer, realtor, and businessman who developed much of the city of Dania, including Dania's downtown area, as tourism grew into one of the region's most prosperous industries. In the 1920s, the hotel became famous for its various amenities and its national publicity helped spawn the growth of what is today downtown Dania Beach. Architectural Description The two-story hollow clay the structure lies just east of the Dania Beach downtown commercial district. Popular in the region and during the 1920s, the structure is a paradigm of the Mediterranean-Revival style. The asymmetrical u-shaped plan of the structure compliments the textured stucco exterior and Spanish influences. The open courtyard along the east elevation served as the structure's original entrance, which opened off of the hotel's main lobby. The complex roof planes are comprised of barrel tiled, hipped and gabled segments with a front facing gable on the north elevation and hipped roofs that cover the remainder of the structure, including the dwelling's four comer towers. Fenestration is symmetrical and includes 6/6 double hung sash windows. The asymmetrical front facade was originally a side entrance but today serves as the main entrance to the building. The hotel's ties with its famed builder and architect and its significance to Dania's community development supports its local and national recognition. The building's condition is presently only fair, which highlights the critical need for the building's preservation; it remains a good candidate for an adaptive use project. Historical Context A native of New York State, architect Francis Abreu was born at his grandfather's estate on the Hudson River in 1896. Abreu attended Cornell University's College of Architecture in 1916. He completed his education at Cornell in 1921 after his service in the armed forces during World War I. Attracted by the booming real estate market, Abreu relocated to South Florida and opened an office in Fort Lauderdale in 1923. For five years, Abreu designed some of the most notable buildings in South Florida, including the Las Olas Casino, the Dania Beach Hotel, and various residences, many of them inspired by the Mediterranean-Revival style, scattered throughout Broward County. In 1928, Abreu moved his practice to Georgia but continued work throughout the state of Florida. Abreu remained active in the field of architecture until his death in 1969. Though his stay in South Florida was brief, Abreu remains one of the area's most distinguished and memorable architects for his many architectural contributions. The hotel's builder, Art J. Ryan, Sr., came to Dania on his honeymoon in 1923 with his bride, Genevieve. After their brief stay in South Florida, the Ryans decided to relocate to Dania from their home in Chicago. One of the original partners of the Dania Bank, Art J. Ryan, Sr. was a leading pioneer in the planning and economic development of Dania. He began a prosperous land development company and helped to promote the growth of Dania during the land boom of the 1920s. Ryan made his mark throughout the city, helping to build various commercial and residential structures in addition to his civic service. Ryan's various contributions can still be seen throughout Dania. The Dania Beach Hotel provides the most conspicuous physical example of Ryan's work. . National Register Criteria The standard criteria used to define a historic building was developed by the National Park Service to determining eligibility for listing in the National Register of Historic Places. Properties listed in the National Register must possess historical significance and integrity. Significance may be found in four aspects of national, state, or local history: A. Association with historic events or activities. B. Association with important persons. C. Distinctive design or architectural characteristics. D.
