A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
THE VACATION OF A 30 FOOT BY 584.84 FOOT PUBLIC RIGHT-OF-WAY
(SW 12TH AVENUE EXTENDED) LOCATED ON THE "STIRLING
INDUSTRIAL PARK" PLAT BOOK 131, PAGE 40, PROPERTY IS
LOCATED BETWEEN WEST DANIA BEACH BOULEVARD AND SW 1 ST
STREET, IN THE CITY OF DANIA BEACH AND LEGALLY DESCRIBED IN
EXHIBIT"A", A COPY OF WHICH IS ATTACHED TO THIS RESOLUTION;
PROVIDING THAT ALL RESOLUTIONS OR PARTS OF RESOLUTIONS IN
CONFLICT WITH THIS RESOLUTION ARE REPEALED TO THE EXTENT
OF SUCH CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE,
WHEREAS, Section 3, Article 3, Part IX, as amended, of the Charter of the City of
Dania Beach, sets the procedure for vacating and abandoning streets, alleys, and utility
easements or other property dedicated to the public use; and
WHEREAS, Craven Thompson &Associates, Inc., representing Stirling Associates,
LLC for the Dania Distribution Center, duly petitioned the City Commission of the City of
Dania Beach, Florida, for the vacation of public right-of-way easement on the "Stirling
Industrial Park" Plat, more legally described in Exhibit "A", a copy of which is attached to
this resolution.
WHEREAS, the City Commission waived the re-platting requirements for petition
No. VC-29-03 on June 10, 2003; and
WHEREAS, atthe June 18, 2003 meeting, the Planning and Zoning Advisory Board
Unanimously voted to recommend approval of the vacation of easement on the "Stirling
Industrial Park" Plat;
WHEREAS, after publication of notice as required by Section 3, Article 3, Part IX of
the Charter of the City of Dania Beach, a public hearing was held before the City
Commission at its regular meeting held on July 8, 2003;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
1 RESOLUTION NO. 2003 -170
• Section 1. That the City Commission of the City of Dania Beach, Florida, vacates,
abandons, renounces and disclaims all of the right, title and interest of the City of Dania
Beach in and to the following right-of-way, subject to the following conditions:
a) Preserving 30 foot general utility easement above the proposed right-of-way
vacation area.
b) Provide landscaping and/or fencing to prohibit pedestrian access to vacated
right-of-way.
Section 2. That the City Commission finds and determines that the procedure for
the vacation and abandonment of the subject easements have been in strict conformity
with the requirements of Section 3, Article 3, Part IX of the Charter of the City of Dania
Beach.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: VC-29-03: Request by Craven Thompson & Associates,
Inc., on behalf of Sterling Associates, LLC. to vacate a 30
foot by 584.84 foot public right-of-way (SW 12th Avenue
extended) for the property located between !Test Dania
Beach Boulevard and SW 1st Street.
The applicant is requesting vacation of a 30 foot wide unimproved road right-
of-way ("ROW parcel'. This ROW parcel runs along the west side of the
recently completed Stirling Park Office/Distribution complex. The Stirling Park
complex is located north of Tile International's rear building. This ROW parcel
has never been paved or used as a roadway.
The 30 foot ROW parcel was dedicated in 1985 when the Stirling Park property
was platted. In 2000, the City Commission approved the Stirling Park site plan
(60,000 square foot office/distribution space). The Stirling Park site plan
showed that SW 12th Avenue would not extend north to Dania Beach
Boulevard. Access was limited to SW 12th Avenue.
In 2002, the City Commission approved the Dania Distribution Center Site Plan
(220,000 sq. ft. of office/distribution space), also with no access to Dania Beach
Boulevard. Again, access was limited to SW 12th Avenue.
If the City Commission does not vacate the ROW parcel, Broward County will
require roadway improvements on Dania Beach Boulevard that will significantly
reduce the landscape buffer between the Dania Distribution project and
adjacent residential homes to the north. The County's required roadway
improvements will also significantly reduce the pervious area and require a
major redesign site drainage system.
Including Dania Distribution, Stirling Park, and Tile International, approximately
is 300,000 square feet of industrial/warehouse space will be required to use SW
12t' Avenue as the only means of access. This is a less than desirable
situation as SW 12"' Avenue was built some time ago and does not meet
contemporary specifications.
Providing a second egress to the industrial area will require opening up either
SW 12t' Avenue (north to Dania Beach Boulevard) or SW 1st Street (east to SW
6"' Avenue and then south to Stirling Road). Unfortunately, either option will
divert through truck traffic into residential neighborhoods. This is inconsistent
with the City Comprehensive Plan and the City's crime prevention and
community development efforts. Staff does not support opening up either SW
12t' Avenue or SW 1st Street for these reasons.
Two City Commissioners requested the applicant dedicate a separate roadway
easement to preserve the option of extending SW 12t�' Avenue north to the
Dania Beach Boulevard in the future. The applicant is willing to dedicate a
"new" 30 foot wide roadway easement for this purpose. While the new road
easement is located in the right place for a future road extension (north of SW
12t' Avenue), it is also located on the principal dry retention area for the Dania
Distribution project.
To address this issue, staff requested the applicant redesign the project to
meet drainage requirements without using the 30 foot road easement area.
This way, if the City chooses to install the road, sufficient drainage facilities will
have already been provided. Applicant indicates this will add $800,000.00 or
more to site development costs. Staff has requested applicant meet with the
Public Works/Utilities Director to confirm if this is the case.
As mentioned above, the City Commission has the option of providing a second
egress to the industrial properties via SW 1st Street. This roadway is already
improved east to SW 8"' Avenue, but is restricted by a gate to emergency
vehicles. The City Commission has the discretion to remove the gate and open
up SW 1st Street to through traffic. Again, staff cannot support opening SW 1st
Street for the reasons mentioned above.

provided it main access to SW 12`h Avenue to Stirling Road which is a
signalized intersection.

9angineers easement. If for some reason in the future(if ever)the City could use the
ne s easement the City could construct a roadway. The developer would like to

construction plans.
It could be pointed out to the Planning&Zoning Board& City
Commission that the easement is in place if required in the future, and to
vacate the 30' Road Right-of-Way on the Stirling Industrial Park as we are
currently requesting.

During the Planning & Zoning Board hearing of June 18, 2003, the Board
recommended that the Applicant provide a hedge and fence on the south and north
side of the vacated 30' R/W. Attached is a sketch which details a 6' high chain link
fence with black vinyl coating and a coco plum hedge 24" high at planting with
F spacing of 24"o/c along the south and north property line, as requested. The owner
of the property will also grant, as requested, a 30-foot utility easement over 30'

Dear Larry:
At the Planning & Zoning Board hearing of June 18, 2003 the Board recommended
that the applicant provide a hedge&fence on the South& North side of the vacated
30' Road Right-of-Way. I do not believe this will be a problem. I will discuss it with
&ASSOCIWES INC the current owner and the developer of the Dania Distribution Centre. As requested,
a sketch will be provided for staff review prior to the final City Commission hearing
lean�nerrs for the vacation petition. Another condition for approval is that the 30' Road Right-
Surveyors of-Way would be granted to the City of Dania Beach as a Utility Easement because of
the existing 12" watermain within the existing Road Right-of-Way.
It was agreed in a meeting in February 2003 with the developer of Dania Distribution
Centre that the 30'Road Right-of-Way would be irrigated and sodded. The irrigation
of this area would be provided by the Dania Distribution Centre irrigation system.
We will coordinate this with the owner of Stirling Industrial Park now that the area
will not be a road right-of-way.
From a recent a-Mail from you, it was stated that if in the future the City of Dania
Beach requires a roadway connection from SW 12t' Avenue to Dania Beach
Boulevard, the City would require the use the 30' roadway easement granted by
separate instrument on the eastern portion of the Dania Distribution property by O.R.
Book 34883, Pg. 1353-1356 (copy attached). The City would require the property
owner of Dania Distribution Centre to remove the dry retention area on the eastern
property line. The project would be required to handle the drainage requirements for
the project by additional exfiltration trench/drainage well(s). The existing trees along
the eastern property line would be relocated and the irrigation system modified. The
City of Dania Beach would pay for and construct the roadway connection if ever
required.
