AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA
APPROVING THE REZONING REQUEST SUBMITTED BY JOSEPH J.
RUBANO (RZ-65-06), FOR PROPERTY LOCATED AT 2555 AND 2565
STATE ROAD 84, IN THE CITY OF DANIA BEACH, FLORIDA, WHICH
PROPERTY IS LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS ORDINANCE; CHANGING THE
CURRENT ZONING CLASSIFICATION OF THE PROPERTY FROM IROM
(INDUSTRIAL RESEARCH OFFICE MARINE), TO MA-1 (MARINA MILE),
SUBJECT TO CERTAIN RESTRICTIONS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City's Planning and Zoning Advisory Board, sitting as the local
planning agency, has reviewed this Ordinance and recommended its approval to the City
Commission; and
WHEREAS, the City Commission has considered this Ordinance at a duly noticed public
hearing according to law; and
WHEREAS, the City Commission finds that this Ordinance is necessary for the
preservation of the public health, safety and welfare of the City's residents;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section I. That the rezoning request filed by Joseph J. Rubano, for property located
at 2555 and 2565 State Road 84, within the City of Dania Beach, Florida, is granted and the
parcel, as described in Exhibit "A", a copy of which is attached to this Ordinance, is rezoned
from the "IROM" zoning classification to the "MA-I" zoning classification.
Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any
reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not
affect the validity of the remaining portions of this Ordinance.
• Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this Ordinance are repealed.
Section 4. That this Ordinance shall be effective immediately at adoption on second
reading.

SUBJECT: RZ-65-06: The applicant, Margaret Croxton, on behalf of the property
owner Joe Rubano, is requesting a change the zoning from Industrial,
Research, Office, Marine (IROM) to Marina Mile (MA-1) zoning for the
property located at 2555 & 2565 State Road 84 (FIRST READING).

Mile (MA-1).

The subject property was annexed into the City in 1990. In 2000 the City changed the
commercial districts from the Broward County zoning to the City commercial zoning district.
When the zoning changed some uses that were previously allowed became illegal.
On August 8, 2006 the City Commission approved a new zoning district called Marina Mile
(MA-1), which allows many uses that were originally permitted with the original Broward
County zoning.
The applicant is requesting to change the zoning of the property to MA-1 to,legalize the
tenants (Atlantic Truck Center) currently located on the site, who are operating as an
existing non-conforming use.
CITY COMMISSION PREVIOUS ACTION
On November 14, 2006 the City Commission approved the request on first reading.

Rezoning request for Rumur Properties Ltd.
City of Dania Beach
The three parcels on this Plat, are being requested to be rezoned to the new Marina Mile
District(MAI),which was recently created, after a unanimous recommendation of the
Planning and Zoning Board, by a unanimous vote of the City Commission. The property
owners believe that city zoning, which does not permit previously permitted uses,
devalued the property and has caused problems with lessees obtaining occupational
licenses. The property is used by the owner Joseph J Rubano, RPM Diesel Engine Co.
and leased to Atlantic Truck Center. Although uses on the site were grandfathered in
when the property was annexed to the city from the county, we are asking for a
permanent and appropriate use of this property as it is presently being used.
Members of the Marina Mile 84 Association-including Vice President Joseph J.
Rubano---believe that properties that were previously county zoned were inadvertently
harmed by the City's zoning change. After years of work with city staff, we were
successful in creating the new Marina Mile Zoning District,which will now allow
businesses that want to rezone to former legal uses to do so.
It was represented to the P&Z board and the Commission that this property would be
applying for zoning relief.
These previous and current uses are in keeping with the Marine District along State Road
84 and are an economic benefit to the city.
We appreciate the cooperation of staff and this effort.
