HomeMy WebLinkAboutO-2006-039 Date of Installation of Signs ORDINANCE NO. 2006-039 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE CITY CODE OF ORDINANCES, CHAPTER 28 "ZONING," ARTICLE 28 "SIGNS", TO PROVIDE THAT TEMPORARY POLITICAL SIGNS SHALL NOT BE POSTED PRIOR TO THE DATE OF QUALIFICATION OF THE CANDIDATE, OR BALLOT ISSUE TO WHICH THEY PERTAIN; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; FURTHER PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission ("City Commission") of the City of Dania Beach ("City") has adopted regulations pertaining to signs located in the City, in order to maintain and improve the aesthetic quality of life presently existing within the City; and WHEREAS, these sign provisions are codified at Article 2, "Definitions," and Article 28, "Signs," of Chapter 28, "Zoning," of the City's Code of Ordinances; and WHEREAS, the City Commission finds and determines that these provisions are in need of revision to better protect the citizens of the City from the impacts of excessive temporary political signage; and WHEREAS, the City Commission finds and determines that the posting of temporary political signs prior to the date of qualification of the candidate or ballot issue to which they pertain does not serve the public interest and harms the aesthetic environment and appearance of the City; and WHEREAS, the purpose of this revision is to clarify the intent of the existing sign regulations and to provide viewpoint neutral regulation of temporary political signage in the City; and WHEREAS, pursuant to law, notice has been given by publication in a newspaper of general circulation in the City, notifying the public of this proposed Ordinance and of a related public hearing; and WHEREAS, a public hearing before the City Commission was held pursuant to the published notice described above, at which the parties in interest and all other citizens so desiring had an opportunity to be heard and were heard; and WHEREAS, the City Commission finds that enactment of these revisions through its police powers will protect the public health, safety and welfare of the residents of the City, including the aesthetic environment and appearance of the City, and furthers the purpose, goals, objectives, and policies of the City's Comprehensive Plan; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. Intent. That the preceding "WHEREAS" clauses are ratified and incorporated into this Ordinance as the legislative intent of this Ordinance. Section 2. Date of installation of temporary political signs. That Section 28.220 of Chapter 28, Article 28, "Signs," is amended to read as follows: 28.220. Temporary signs. The following temporary signs shall be permitted in any zoning district and shall be subject to the provisions set forth below: 0 0 0 (7) Temporary political signs. Political signs (temporary), subject to the removal requirements of subsection (2) above, of eight (8) square feet in area or less. Temporary political signs shall not be posted or displayedprior to the date of qualification of the candidate identified in such signs. For signs relatingto o any other ballot matter, such signs shall not be posted or displayed prior to date of receipt by the office of the Broward County Supervisor of Elections of the ballot matter wording for printing on the ballot for the applicable election. ® 0 2 ORDINANCE#2006-039 Section 3. That, except as amended above, all other provisions of Chapter 28 of the Code of Ordinances of the City of Dania Beach, Florida, as amended, shall remain in full force and effect. Section 4. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with the provisions of this Ordinance are repealed. Section 5. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 6. That this Ordinance shall take effect immediately at the time of its passage and adoption. PASSED on first reading on November 14, 2006. Once a candidate "qualifies" as a candidate, he or she may post signs. As for other ballot matters, such sign displays can begin after the Office of the Supervisor of Elections receives the ballot matter wording for printing on the ballot for the applicable election. All temporary sign of any nature are required to be removed within seven (7) days after the applicable event or election occurs. This is ready for City Commission consideration and adoption.
