REPRESENTING KEVIN GUTHARD, SHERIDAN 87, LLC., FOR PROPERTY LOCATED ON THE NORTH SIDE OF SHERIDAN STREET DIRECTLY EAST OF THE WALGREEN'S DRUG STORE, (KEVIN'S PLAT) IN THE CITY OF DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Kevin Guthard, Sheridan 87, LLC, has applied for site plan approval for the proposed construction of 87 multi-family units to be located on the north side of Sheridan Street, directly east of the Walgreen's Drug Store on the plat known as "Kevin's Plat", in the City of Dania Beach; and WHEREAS, the Planning &Zoning Board on June 18, 2003, recommended thatthe City Commission grant the site plan request(SP-25-03), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-25-03) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved, subject to the following conditions: 1. A hedge shall be provided on the outside of the west wall to help soften and deter graffiti prior to issuance of a building permit. This may have to be planted on Walgreen's property. The applicant shall provide written approval from DPEP for the proposed hedge and species of hedge material near north property line prior to issuance of a building permit. 3. The applicant shall provide a copy of the executed conservation easement to staff, prior to issuance of a certificate of occupancy. 4. The applicant shall provide a copy of written approval from all governing regulatory agencies for the encroachment into the wetlands and mangroves. 5. The applicant shall obtain City Commission approval (public hearing required) of Local Park Impact Fee dedication. 6. The applicant agreed that Condominium documents shall acknowledge the City has no responsibility for replacement of any landscaping or walls that cannot be saved and restored in the utility easement should work be required within the easement. 7. The City acknowledges receipt of Exhibit referenced as "Wetland Map", approved by DPEP, that was provided by applicant at City Commission meeting, August 12, 2003 (per Exhibit identified by License No. DF03-1088 dated June 23, 2003). If determination by DPEP changes, the Community Development Director can require additional trees in appropriate locations. It is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Site Plan Site plan for the construction of 87 condominium units on "Kevin's Plat". The applicant proposes 87 condominiums on vacant property located east of SE 5tn Avenue on the north side of Sheridan Street. The proposed building height is four (4) stories. Each building appears to resemble the building under construction behind the veterinary clinic, east of the subject property. An 80 foot wide conservation area is proposed at the rear of the project, along the north property line, although it is unclear exactly which trees will remain in this area. Vehicular access is provided from Sheridan Street. The Florida Department of Transportation (FDOT) has indicated that no in-bound left turns are permitted at this location, and access shall be restricted to right turn in/right turn out. The applicant agreed, as part of the platting process, that he would install a channelized entrance/exit to restrict turning movements accordingly. Applicant's Neighborhood Compatibility Letter: On March 11, 2003, the applicant submitted the attached letter indicating he would agree to comply with 15 conditions to assure neighborhood compatibility. The proposed site plan shows compliance with Conditions 2, 4, 5, and 7. The applicant has submitted a second letter suggesting that some of the residents have agreed to modify Condition 8 relating to building height. The resident's signatures are not notarized and no addresses have been provided. Conditions 13 and 14 are already addressed by City ordinance. . The applicant's letter is not signed by any of the residents, is not notarized, is not recorded, and is not associated with a variance or special exception request. As such, the city has no authority to enforce the remaining conditions (1, 3, 6, 9, 10, 11, 12, and 15)should the applicant choose not to implement them. Analysis: Staff has reviewed the submitted plans and has asked the applicant to address several issues. Some issues are secondary and may be addressed prior to a building permit. However, other issues are so significant that staff recommends the City Commission defer action on the site plan until these latter issues are resolved. Conditions to be addressed prior to issuance of building permit. 1. Provide method and location of mail delivery for this project (not previous projects). 2. Provide detail of monument sign including color and method of illumination. 3. Recommend that a hedge be provided on the outside of the west wall to help soften it and deter graffiti prior to issuance of a building permit. This may have to be planted on Walgreen's property. • 4. Revise note on site plan (Sheet SP-1) identifying 50 foot row easement to match the plat, which identifies the same 50 feet as a dedication. 5. Revise measurement from gate to newly designated property line after designation to identify the number of stacking spaces provided on site. 6. Obtain written approval from DPEP for the proposed hedge and species of hedge material near north property line prior to issuance of a building permit. Recommend utilizing a native Silver buttonwood, Fire bush or Jamaican Caper hedge. 7. A copy of the executed conservation easement must be provided to staff. Conditions to be addressed prior to City Commission approval of Site Plan. 8. Obtain written approval from the easement holders for landscaping proposed to be located in easement areas. 9. The Community Development Department has an obligation to provide the public an accurate expectation of the appearance of the finished development. Staff cannot provide an accurate account of what landscaping will be installed, preserved, and removed until comments 8 — 14 are indicated with clarity and certainty on the site plan. Items 15 and 16 are life safety issues that may change the layout or geometry of the site plan. All of the items which are the basis of this recommendation were brought to the applicants attention at or prior to June 18, 2003, PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION On June 18, 2003 the Planning and Zoning Advisory Board heard the applicant's request for variances and site plan review and recommended approval provided that all the outstanding items are addressed prior to scheduling for City Commission public hearing. We understand that FP&L no longer owns this land,. In a meeting on February 25, 2003, the Commissioners voted to rezone this property from Commercial (C-2)to High Density Residential. (RM-3) We understand that the designation of RM-3 could mean a Developer could possibly build an 8-story(or 90 feet, whichever should be the least)building (where as Commercial could have been maximum of only 5 stories or 62 feet, whichever should be the least) and have 87 multi- family dwelling units. We understand that you are requesting an amendment to the Broward County Land Use Plan for a maximum of 17 units per acre. In order to provide you the opportunity to prepare for Monday's meeting. Below are some concerns that residence in the neighborhood wish to obtain your concurrence on. It is our expectation that upon the conclusion of the meeting, we will either have your agreement to specific points(initialing your concurrent)or that you are not in agreement with our concerns and you will provide a suggested resolution to our concern. The plant life is not to be decreased in height or density by the removal of non-indigenous plant life, such as Australian Pines or Pepper trees. If removal is deemed necessary, plants conforming to the conservation specifications must be placed along the upland area by Sheridan 87 LLC. This information is to be documented by placing a conservation easement over the area and restricting the area by placing a note on the plat. 2. Guthard CC: Date: 8/5/03 e: Sheridan 87 Condominium Mr Leads, Last night I had a meeting with the homeowners who are of the neighborhood agreement dated 3/11/03. We discussed all the items on the agreement and agreed they were consistent with the site plan submitted. In speaking with you yesterday there was one issue that needed clarification and in speaking with Bill Tesaro there was one issue. The issue raised by you, #8 on the neighborhood agreement was to clarify that the 4"' floor unit's main ceiling would not be greater than 34 feet 4 inches. However, that the living room/den would be 2 feet higher but would still be within the 48 foot top of peak. They all signed the attached document to clarify. The second issue was#5 which was the double row hedge is to extend the length of the northern property line where the wall terminates easterly toward the apartments. Pursuant to your request, I am advising you of possible DPEP action on the proposed Conservation Easement at Sheridan 87. The proposed 0.84-acre conservation area located in the northern section of the property has been designated as wetland by the DPEP. Since, this area is classified as a wetland, it is out of my purview as all jurisdictions belonging to DPEP. As, part of my landscape comments, we have required wetland delineation, copies of the approved wetland permits, a copy of the recorded conservation easement and the approved mitigation plans prior to the building permit. Additionally, we have required 12'andl4' tall Green buttonwood (Conocarpus erectus) trees on 15' centers and a 30" high double row hedge along the open area of the northern upland perimeter of the conservation area. Also, we have proposed trees and clusters of palms ® between the conservation easement and rear of the buildings to help scale/soften the buildings. Lastly, we have proposed 6-14' tall Green buttonwood trees and a 24" hedge along the western upland perimeter of the conservation area. During a recent onsite visit, a brief survey was conducted of the area. This brief survey revealed that the dominant existing wetland plant species proposed for preservation would consist of White Mangroves (Laguncularia racemosa), Leather ferns (Acrostichum spp.) and Willows (Salix spp.). Intermixed with these proposed preserved wetland species are several invasive exotic plant species consisting of Australian pines (Casuarina spp.), Brazilian pepper (Schinus terebinthififolius), Bischofia (Bischofia javanica) and several exotic species of groundcover. In over 90% of the cases, a condition of the approved wetland permit requires the developer to completely remove the invasive exotic plant species to allow for renourishment of the dominate existing preserved wetland species. Additionally, they may require enhancement, by adding under story or shrubby vegetation in the open areas to preserve the wetland and to help keep the invasive plants from coming back. Lastly, DPEP usually requires a 5-year monitoring schedule to selectively remove any invasive exotics that may have volunteered. Since, the wetland permit application is submitted for review, and until it gets approved we cannot be sure of the final outcome.
