A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY ROBERT JOHNS, FOR GUARDIAN
AMERICAN DEVELOPMENT CO., LLC., FOR PROPERTY
LOCATED AT 3057 SW 45T" STREET GENERALLY
LOCATED NORTH OF 45T" STREET, WEST OF SW 30T"
AVENUE AND EAST OF SW 30T" WAY, DANIA BEACH;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Robert Johns, for Guardian American Development Co., LLC., has
applied for site plan approval for the proposed installation of perimeter landscape and wall
around a 20 unit single family development known as the Bridgewater Estate Homes,
generally located north of SW 45t" Street, west of SW 30th Avenue, and east of SW 30tn
Way, in the City of Dania Beach; and
WHEREAS, the Planning &Zoning Board on July 16, 2003, recommended that the
City Commission grant the site plan request(SP-41-03), based upon the criteria set forth in
Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-41-03)for site plan approval, a copy of which
is attached and made a part of this Resolution as Exhibit "A", is approved subject to the
following conditions:
® Reduce the height of the wall on the west and south side to 5 feet
® Installation of proper vegetation as determined by the City's Landscape
Consultant on the outside of the wall

• Installation of a fire hydrant to service the existing homes to the west of the
subject parcel (location to be determined by the Fire Marshal)
It is further noted that the original Site Plan is maintained in the office of the Community
Development Department, of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SP-41-03 — Site Plan request by Robert Johns, on behalf of
Guardian American Development Co., LLC., for site plan approval
of the landscape and perimeter wall around the 20 unit single
family development know as the Bridgewater Estate Homes for
property located at 3057 SW 45th Street.
In January of 2002 the City Commission approved the plat for the subject property,
provided that the applicant submits a site plan to illustrate the location of the proposed
wall and associated landscaping.
The property is approximately 5 acres and is located on SW 45"' Avenue, immediately
• south of the Dania Cut-off canal. The applicant is proposing 20 single family dwelling
units and a common area. The site will be surrounded by a wall and fence and will have
a gated entrance.
The applicant is proposing a six (6) foot landscaping area along the southern property
line providing a hedge and trees. A landscaping area is also proposed along he western
property, which provides a one foot area where vine will be planted along the wall.
The applicant is required by Broward County Utilities to install an on-site sewer lift
station. Residents have expressed concern that the lift station will allow Broward
County Utilities to require existing homeowners to hook up to county sewer. Staff has
directed the homeowners to contact Broward County Utilities which has jurisdiction over
sewer service in this area.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
On July 16, 2003 the Planning and Zoning Advisory Board recommended conditional
approval of the requested site plan. The applicant has addressed Planning and Zoning
Advisory Board conditions except as indicated below.
1) Installation of a temporary construction fence.
2) Installation of a fire hydrant to service the existing homes to the west of the
• subject parcel; location to be determined by the City Fire Marshall.

For Bridge Water Project
Dear Robert:
Yesterday we had a very effective meeting with Bill Tesauro, in review of the
plan drawings submitted for the Site Plan Review. In our opinion we are correct
and complete with all work except the addition of the Sewer lift Station
information.
Our mitigation plan was reviewed and had no comments other than to add that
caliper inch is measured at DBH, diameter at Breast height. Actually Bill and I
• agree on this, only it wasn't noted on the plan, as was his preference, although it
was not a code requirement.
In review of the Lift Station issue, he asked that some spot elevation information
be added to the plans that show proof that the drainage from the unit adjacent
to the existing trees, in fact flow away from the root zone of those trees to
remain. This is being added this same morning along with a detail which we
suggested and he agreed, would be beneficial. That was a cross section through
the retaining wall, showing the wall height above finished grade and the
drainage flowing away from the root zone.
In the opinion of your landscape architect and the fact there were no comments
of concern, these plans are ready to be submitted for your Commission Meeting.
