RESOLUTION NO. 2003-206 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING VARIANCE#3 FOR WALL SIGN AS SUBMITTED BY SHELLEY EICHNER OF CALVIN GIORDANO AND ASSOCIATES REPRESENTING NAC INVESTORS,LLC, FROM CHAPTER 28, ZONING, CHAPTER 26, VEGETATION, FOR PROPERTY GENERALLY LOCATED AT 3064 GRIFFIN RD., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Article 28 Signs, Section 28.095 sets the signage regulations for Residential multi-unit complexes or communities in the City of Dania Beach; and WHEREAS, Shelley Eichner of Calvin Giordano and Associates, representing NAC Investors, LLC, has applied for several variances (VA-42-03)outlined in the attached staff report for property generally located at the southeast corner of Griffin Road and SW 31 st Avenue on the former site of the Thunderbird Mobile Home Park, Dania Beach; and WHEREAS, the Planning & Zoning Board on June 18, 2003, recommended approval of variance requests based upon the criteria set forth in Chapter 28,Zoning,Article 28, Signs, Section 28.095 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-42-03, for variance #3, as described in the attached staff report, from requirements in Chapter 28 Zoning, is approved for waiver of 61 feet of the required 300 foot minimum street frontage to allow a wall sign facing a street frontage with 239 feet of street frontage(Signs prohibited if frontage less than 300 feet)with the condition that the sign not exceed 8 square feet. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Sidewalk Waiver To waive the required sidewalk construction required along SW 31st Avenue. Site Plan Site plan for the construction of 57 two-story townhouses. The applicant proposes a 57 unit townhouse development at the southeast corner of Griffin Road and SW 31st Avenue on the former site of the Thunderbird Mobile-Home-Park The-development is 9.93 units per gross acre, similar to the nearby Oak Bridge Townhouse development. The project consists of a lake retention area surrounded by parking with the 57 townhouses located on the perimeter of the property. The property to the east has been approved for townhouses. The property to the south is undeveloped and has a Future Land Use Plan Designation of 5 dwelling units per acre. The bible store to the northwest is 'zoiedhCommercialt- ' ' (C-2). Vehicular access is provided from. SW 31.st1.Avenue opposite the existing Publix Supermarket's rear service entrance. It is expected that most vehicles will approach the site from Griffin Road turning southbound onto SW 31st Avenue. The site plan shows no southbound left turn lane for vehicles entering the project. Also, there is no sidewalk provided along SW 31st Avenue adjacent to the site. The applicant has submitted a traffic analysis addressing these issues. Staff forwarded the analysis to the City's Traffic Engineering Consultant, Tinter and Associates, Inc. ("Tinter"). Tinter indicates (see attached letter), based on the size of the project: 1) The site plan provides sufficient in-bound vehicle stacking space. 2) A southbound left turn lane from SW 31st Avenue is not required. Tinter recommends the project driveway line up exactly with the existing Publix Driveway (across SW 31st Avenue) and that a sidewalk is provided next to the townhouse driveway so residents can walk across the street directly to Publix. Both of these items have been addressed by the applicant and are reflected on the revised site plan. Variances 1. To waive five (5) of the required 131 parking spaces to provide 126 parking spaces. Chapter 28, Zoning Article 6, Supplementary lot regulations, Section 6.21 entitled Off- Street Parking. The applicant has revised the site plan and no longer requires the parking variance. • 2. To waive 15 feet of the required 25 foot street side setback to provide a 10 foot setback from SW 315t Avenue. Chapter 28, Zoning Article 2, Supplementary lot regulations, Section 6.51 entitled Townhouse. The proposed site plan identifies a 10 foot setback from the west lot line. The paved surface of SW 31st Avenue is setback over 50 feet from said lot line, and is separated from the development by a wide drainage ditch. As such, there is sufficient distance between SW 31st Avenue and the proposed townhouses. Staff has no objection to this variance. Please note also if the proposed right-of- way vacation request is granted, the 25 foot setback-will-be provided on site, and no variance will be required. 3. To waive 61 feet of the required 300 foot minimum street frontage to allow a wall sign facing a street frontage with 239 feet of street frontage. Signs are prohibited if frontage is less than 300 feet. Chapter 28, Zoning Article 28, Signs, Section 28.095 entitled Residential Multi-unit Complexes or • Communities. The applicant is requesting a sign variance to waive 61 feet of the required 300 foot minimum street frontage to allow a wall sign facing a street frontage with 239 feet of street frontage. Griffin Road is a main arterial roadway which most commuters will utilize when traveling to and from the subject site. Additionally, if the property had 300 feet of street frontage on Griffin Road the allowable sign area would be 15 square feet. The applicant is requesting a sign area of less than eight (8) square feet. Therefore, staff is in support of this requested variance provided the subject sign does not exceed eight(8)square feet. Sidewalk Waiver To waive the required sidewalk construction required along SW 315t Avenue. Chapter 22, Streets and Sidewalks, Article 11, Division 1, Section 22.27 entitled Construction of sidewalks when building constructed or substantially improved. The applicant is requesting to waive the required sidewalk construction required along SW 31st Avenue. The City's Planning and Development Code (Section 22.27) requires installation of sidewalks along SW 31st Avenue and Griffin Road. While it appears sidewalks are provided along Griffin Road, no such sidewalk is provided along SW 31st Avenue. The applicant is willing to pay an equivalent amount into the City's side walk fund. The Public Services Director has indicated that the code does allow for a bond to be placed with the city to insure future placement of the sidewalk if the applicant does not provide one. Having received quotes from outside contractors for this type of work by the Public Services Director, it has been determined that the bond should reflect a value of 6 dollars per square foot of sidewalk which is equivalent to 30 dollars per linear foot of frontage. Parking As indicated earlier, the applicant complies with current parking requirement of 2.3 parking spaces per unit, or 132 total parking spaces for a 57 unit development. The applicant proposes reserving only one parking space per townhouse. The remaining 75 spaces would be designated as guest parking and would be available on a "first come, first serve" basis to residents or guests. Each townhouse contains three bedrooms. Based on current trends of automobile ownership in the Broward County metropolitan area, staff has suggested the applicant reserve and assign two parking spaces exclusively to each townhouse. This assures each unit owner that two parking spaces will always be available near every townhouse at all times. If the applicant chooses not to reserve two spaces for each unit, staff recommends the HOA documents provide notice that only one parking space is reserve to each unit and that additional parking is available on a "first come, first serve" basis in guest parking areas located throughout the complex. Site Plan Staff has reviewed the revised submitted plans and has asked the applicant to address the following issues prior to issuance of a building permit. 1. Delete the monument sign from the site plan (City cannot grant a permit for the vehicular entry sign as it is located in public right-of-way). 2. Clearly show sidewalks along Griffin Road and SW 315t Avenue or submit a letter of sidewalk waiver from the Department of Public Services, including agreement of sidewalk bond. 3. Payment of $70,537.00 local park impact fee prior to issuance of any building permits. • Required land dedication is 0.4275 acres and is determined based on City Code formula as follows: 2.5 persons/unit* x 0.003 x 57 townhouse units = 0.4275 acres. 0.4275 acres x $165,000/acre** _ $70, 537. *2.5 persons/unit based upon 9.93 dwelling units per gross acre (Parcel size equals 5.74 gross acres). **Land cost based on 2002 Griffin Lakes estimate of $150,000/acre plus 10% appreciation factor, for an estimated land value of $165,000 per acre. 4. Obtain written approval from the easement holders for any proposed landscaping within the easements. 5. Please note the proposed fence and wall located along SW 31st Avenue is not located on the property, please relocate. This is not required if right- of-way vacation approved. 6. Minimum C-900 pipe required brass fittings and iron taps. Lift station wet well material must be reviewed and approved by the Department of Public Services. Fiberglass is not acceptable. 7. Provide the wetland delineation for the site area being disturbed (including the outflow line) and obtain written approval from all governing regulatory agencies for the encroachment into the mangroves 8. Provide the approved wetland mitigation plans. 9. Provide a mitigation donation of $12,800.00 to the City of Dania Beach Tree trust Fund for the removal of the existing trees on the site, prior to issuance of tree removal permit. 10.If the applicant chooses not to reserve two spaces for each unit, HOA documents shall provide notice that only one parking space is reserved for each unit and that additional parking is available on a "first come, first serve" basis in guest parking areas located throughout the complex. 11.HOA documents to identify City Future Land Use Plan designations of adjacent undeveloped properties. 12.HOA documents to identify proximity of project to FLL airport and refer questions concerning airport/runway expansion to the Broward County • Aviation Department. ® 13.Payment of additional ($5,000.00) cost recovery fees to address traffic consultant review, landscape consultant review and site inspection, and multiple in-house staff review. Unused funds will be reimbursed to the applicant at time of CO. STAFF RECOMMENDATION Variances 1. Parking: Withdrawn by the applicant. 2. Setback: Approval of the SW 31st Avenue setback variance. 3. Sign: Approval provided over all sign square footage does not exceed eight (8) square feet, as proposed by the applicant. Sidewalk Waiver (East side of SW 315t Avenue parallel to roadway) Approval provided the applicant post a bond reflecting a value of 6 dollars per square foot of sidewalk which is equivalent to 30 dollars per linear foot of frontage. Site Plan: Approval provided the applicant addresses items 1-13 prior to • issuance of any building permits. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION On June 18, 2003 the Planning and Zoning Advisory Board heard the applicant's request and made the following recommendations: Variances 1. Parking Variance: Approval to waive five (5) required parking spaces subject to exclusively designating and reserving 2 parking spaces per dwelling unit. This variance is no longer required. 2. SW 31st Avenue Setback Variance: Approval provided that a sidewalk is provided on the east bank of the drainage ditch parallel to SW 31st Avenue. 3. Sign Variance (Griffin Road): Denial. Sidewalk Waiver: Denial. Site Plan: Approval subject to staffs conditions. Dania Beach Boulevard Dania Beach, FL 33004 RE: VILLAS @ HARBOR ISLES WEST TINTER ASSOCIATES PROJECT NO. 03-2052 Dear Mr. Leeds: _ As you requested, this office has reviewed the material submitted by Calvin, Giordono relative to the above referenced project on N.W. 31 Avenue in the City of Dania Beach. ® In addition, a field review of the area was completed on the morning of July 21, 2003. The following comments are offered: 1) The trip generation calculations completed were apparently based on a combination of new Broward County peak hour trip generation rates, old Broward County daily trip generation rates and Institute of Transportation Engineers (ITE) calculations for directional split during the peak hour. Using just ITE rates yields slightly different results. The methodology employed; however, maximizes the anticipated traffic approaching the site during the peak hour, thus yielding reasonable results. 2) No distribution calculations were included. For the purposes of the queue analysis, it was apparently assumed that all traffic will come to/from the north on N.W. 31 Avenue. As some traffic may be oriented to the south to gain access to Stirling Rd. or directly west into Publix, this assumption yields conservative results for the queue analysis. 3) This office concurs with the findings relative to the need for a southbound left turn lane, when applying Broward County standards. 4) The queue analysis is reasonable. We concur that a southbound left turn lane will not be required for the anticipated site traffic. If this had been a larger traffic generator, it would have been appropriate to collect additional traffic data at the Griffin Rd./ N.W. 31 Avenue intersection and have the applicant complete a more detailed analysis of that intersection. The additional peak hour traffic from this development should not, however, have a significant impact on that signal operation. August 27, 2003 —City of Dania Beach Page 2 5) The site plan indicates that there is sufficient room to stack 6 vehicles between the entrance gate and the edge or pavement of the N.W. 31 Avenue: Given the low volume of entering vehicles during the PM Peak Hour (averaging less than one vehicle every two minutes), this stacking distance will be more than adequate and will insure that any queues which might develop will not interfere with traffic on the public street. 6) It is unclear from the site plan what the offset (if any) will be between the site access and the entrance/exit to Publix. Improper offset could create a situation that would be conducive to the creation of a queue on N.W. 31 Ave. Best operation will be obtained if the driveways line up. While the driveways are "intended to line up", it is not clear from the site plan whether or not they do. The site plan seems to show that the driveway is located just south of the existing guardrail. There does not appear to be any notation that the guardrail is to be modified. If that is where it is, I do not believe that it will align with the Publix drive. In order to verify, have the proponent supply the Town with a survey showing both sides of N.W. 31 Avenue and locating the new proposed driveway. If they are offset, as I believe they are, this should be corrected. ® 7) Anyone (pedestrian) from the site desiring to go to Publix will likely do so by crossing directly across N.W. 31 Avenue. Pedestrian facilities (sidewalks) should be provided for this. If the driveways are aligned, this will require a sidewalk along the entrance road to N.W. 31 Avenue. If they do not align (which we do not recommend) then a short section of sidewalk should also be provided on the east side of N.W. 31 Avenue between the entrance to the site and the entrance to Publix. Other pedestrian activity can be accommodated via the pedestrian access from Griffin Rd., eliminating the need for additional sidewalk along the site frontage on N.W. 31 Avenue. I am not convinced that pedestrians who are destined to Publix will walk out of the site, between two buildings, via the pedestrian access to Griffin Road and then walk west to Publix. This is especially true of residents who will reside along the south and west portions of the property. The most direct access will be to cross N.W. 31 Avenue. Sidewalks (which will have to include gates in the fence that can be opened with the same access system used for the vehicular gates or the proposed gates to the north) should be included along either the north or south side of the entrance road. To improve pedestrian safety, consideration should be given to posting Pedestrian Xing signs, along with a marked crosswalk. August 27, 2003 + City of Dania Beach Page 3 ® 8) If the- northern gate is accepted as0he only pedestrian access to Griffin Road, then sidewalks should be provided between Buildings 8 & 9. Response: A variance request was reviewed by the P& Z board for the monument sign on SW 315'Avenue. The signage on Griffin Road Is a part of the perimeter wall and not a free standing monument sign.There is no entrance on Griffin Road. Please see the variance justification for location of the sign on SW 31"Avenue. Applicant proposes to enter Into a hold harmless agreement. 10. Provide over all width(14' max allowed), width of lettering(max. 10' allowed) and set back from row(12' required)of monument sign. Response: Sizes comply(see SP-3 detail 1 and 2). See variance justification for setback response. 12. Provide dimension of paved area behind each unit. Response: Done. Refer to sheet SP-2 detail 1 for typical dimensions. 14. Provide variation in the front elevation of the buildings. Response: The elevation is IDENTICAL to the approved Villas at Harbor Isles models (Griffin Lakes). Several of the proposed engineering cross sections need to be revised, as they conflict and/or require more information to determine that they do not conflict with the proposed landscaping. NOTE: The proposed landscaping cannot be in the retention areas or on the required 4 to 1 slopes of them. Response: Done. 7. Provide a tree protection barricade on the landscaping plans. Response: None required. See response#3. 8. Label all the site lighting and explain some of the locations, as they appear to be in the sidewalk and on top of the retaining wall. Response: Lighting has been revised. There are no conflicts with sidewalks. The light on the south end of the lake cannot be placed on the bulkhead and is offset between curb stops. 9. The code was amended after the rezoning was approved, which rezoning application included the plan for 57 townhouses At that time, the plan conformed to the parking requirement of 2.2 spaces per unit. Due"to strict water m9fikgenlent regulations that do not allow a reduction in the on —site lake area, and the applicant's unsuccessful request to utilize a neighbor's lake for said water management purposes, there is no method of providing the additional 6 parking spaces the code now requires. 2) To allow a rear yard setback of 10 feet from the property line along . SW 3 1" Avenue where 25 feet is required. The applicant has filed an application to vacate a 15-foot strip of additional right-of-way lying east of the 80 feet of right-of way that comprises SW 31't Avenue. It is our contention that because of the canal and the mangroves, the existing right-of-way is not likely to be utilized for additional lanes on SW 31" Avenue, especially given the disjunctive nature of the road to the south and the fact that an expansion of the road would encourage a shortcut to the severe detriment of the Estate of Ft. Lauderdale neighborhood to the south. However, since situations can change and the fact it may not be legislatively possible to grant a variance to allow a sign within right-of-way, the applicant is willing to enter into an easement agreement with the City of Dania Beach for said purposes and to indemnify the City via a h®lei baranless agreement. As for the sign on the Griffin Road wall, there is simply not enough frontage available. The applicant was not successful in including the adjacent parcels in the proposed development. Neither adjacent parcel meets the minimum frontage of 300 feet, however those adjacent developments are of a non- residential and would not require a wall sign.
