RESOLUTION NO. 2003 - 207 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING MODIFICATIONS TO THE APPROVED SITE PLAN SUBMITTED BY TREASURE COVE ASSOCIATES, LTD, FOR PROPERTY LOCATED AT SW 45T" STREET AND SW 27T" AVENUE; PROVIDING FOR CONFLICTS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Gary Posner, owner of Treasure Cove Associates, Ltd., has applied for a modification to the site plan (SP-46-00)to revise the setback alignment for buildings "P" and "Q" for property located at SW 45th Street and SW 27th Avenue, Dania Beach; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modifications to the site plan (SP-46-00) to allow a reduction in the north side measurement of buildings `P' and `Q' for property located at SW 45th Street and SW 27th Avenue, by Treasure Cove Associates, Ltd., is approved, Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. 1 RESOLUTION NO. 2003-207 Section 4. TO: Ivan Pato, City Manager !VIA: Laurence Leeds, AICP, Director C G� FROM: Corinne Church, AICP, Principal Planner C9412— SUBJECT: SP-46-00/03 — The applicant, Craven Thompson and Associates, Inc., is requesting to modify-a-previously-approvedsite-plan for the- construction of 51 townhomes for a property located adjacent to the south side of the Dania Cut-Off Canal between SW 27th Avenue and SW 2e Terrace, Dania Beach. Site Place: To modify a previously approved site plan. The subject property is zoned RM-10, which is a Broward County zoning district. • The property was annexed into the City in 1990. In 2001, the City Commission approved a site plan for 51 new two-story townhouse units on central and east portions of the parcel. The applicant has obtained building permits for several of these townhouse structures and has begun construction. The applicant is requesting to modify the previously approved site plan, allowing a reduction in the north side measurement of building 'P'. The approved site plan shows an 8.14 foot distance between building 'P' and the proposed fire hydrant line to the north. The construction has begun on building 'P' and the actual measurement in the field is 6.6 feet. The interior setback between building 'P' and 'Q' will be 20.6 feet and will still meet the minimum 15 foot interior setback requirement. The measurements in question are internal to the site and will not move any building closure to the perimeter of the site. In addition, the revised measurements will meet the minimum building separation required by the Florida Building Code. Additionally, the City's Fire Marshal has reviewed the requested modification and has expressed no opposition to the change. STAFF RECOMMENDATION Approval. RESOLUTION NO. 2001-005 �• A RESOLUTION. That that certain application (SP-46-00)for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit "A" is approved with the following conditions: C. We have a problem with the side setback for Building"P"on the unit 41. The approved side setback is 8.14 feet. The actual setback in the field is 6.6 feet. It is my understanding that the developer Gary Posner spoke with Laney Leeds before Larry went on vacation. Larry said we need to file a revised site plan application. &ASSOCINES INC The building department has stopped construction on this building and we would eke to get this resolved as soon as nears Hers possible. What do we need to provide for the revised site plan and Surveyors does it go to the City Commission? Your assistance with this matter is greatly appreciated!
