A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,
AUTHORIZING THE PROPER CITY OFFICIALS TO EXECUTE A
DOCUMENT ON BEHALF OF THE CITY, EVIDENCING THE CONSENT
OF THE CITY TO THE SALE OF PROPERTY LOCATED AT 1190 SW
11T" AVENUE (KNOWN AS THE "LIBERTY HEIGHTS APARTMENTS")
LOCATED IN THE CITY TO BE SOLD BY THE BROWARD COUNTY
HOUSING FINANCE AUTHORITY TO THE BROWARD COUNTY
HOUSING AUTHORITY; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Broward County Housing Finance Authority currently owns and
operates a low-income housing complex known as the "Liberty Heights Apartments",
located at 1190 SW 11t" Avenue (the "Liberty Heights Apartments") in the City; and
WHEREAS the Broward County Housing Authority ("BCHA") wishes to purchase
the property from the current owner and operate it and has requested that the City
evidence its consent to such sale and operation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proper City officials are authorized to execute a document
evidencing the consent of the City to the purchase of the property located in the City at
1190 SW 12t" Avenue by the BCHA from the Broward County Housing Financial
Authority, subject to approval as to form by the City Attorney.
Section 2. That the City Manager and City Attorney are authorized to make minor
revisions to such Consent Agreement as are deemed necessary and proper for the best
interests of the City. °

Section 3. That all resolutions or parts of resolutions in conflict with this
Resolution are repealed to the extent of such conflict.

Section 4. That this resolution shall take effect immediately upon its passage
and adoption.

CONSENT OF CITY OF DANIA BEACH
TO ACQUISITION OF PROPERTY BY
BROWARD COUNTY HOUSING AUTHORITY
THIS IS A CONSENT given to the BROWARD COUNTY HOUSING
AUTHORITY ("BCHA"), a Public body corporate and politic, the principal place of
business of which is Corporate Park at Inverrary 3810 Inverrary Boulevard, Suite
405, Lauderhill, Florida 33319, by the CITY OF DANIA BEACH ("CITY"), a
municipal corporation of the State of Florida, the principal place of business of
which is 100 West Dania Beach Boulevard, Dania Beach, Florida 33004.
WHEREAS, the BROWARD COUNTY HOUSING FINANCE AUTHORITY
owns real property located at 1190 SW 12th Avenue in the City (known as
"Liberty Heights Apartments"), and wishes to sell the property to the BCHA; and
® WHEREAS, BCHA wishes to purchase the property; and
WHEREAS, the City has no objection and is willing to consent to the
purchase and operation of the property by BCHA;
NOW, THEREFORE, the City acknowledges the following:
Section 1. Recitals. The foregoing recitals are true, correct and are
incorporated into this Consent by reference.
Section 2. Consent.
2.01 The City consents to the purchase by BCHA from the
BROWARD COUNTY HOUSING FINANCE AUTHORITY and subsequent
operation by BCHA of the property located at 1190 SW 12th Avenue in the City
(known as the "Liberty Heights Apartments"),
2.02 BCHA has represented to City that it will operate the
property for purposes of providing affordable rental housing in compliance with all
applicable governmental regulations, federal, state and local.

Section 3. Termination. This Consent shall terminate upon sale of
property by the BCHA to any person or entity.
IN WITNESS OF THE FOREGOING, the proper officials of the City have
set their hands and seals the day and year first written above.

Dear Mr. Pato:
This is it follow-up to our telephone conversation of August 26, 2003 concerning the
need for an Agreement between the City and the Broward County Housing Authority
• enabling us to purchase the Liberty IIeights Apartments on Ely Boulevard from the
Broward County Housing, Finance Authority.
I have enclosed a copy of a proposed "Consent Between Broward County Housing
Authority and City of Dania Beach" for your review. Also, our Attorney, Lindsey
Payne of the firm Goren, Cherry, Doody and Ezrol has been in discussions with the
Dania Beach Attorney who is knowledgeable of this document.
If you would let me know when the City Co mission will consider this Consent, I will
be present at the meeting to answer any questions that may arise.
Please let me know if you have any, questions at this time or require any additional
information.
