HomeMy WebLinkAboutR-2003-223 sp-42-03 Thunderbird Site Plan RESOLUTION NO. 2003- 223 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY SHELLEY EICHNER OF CALVIN GIORDANO AND ASSOCIATES REPRESENTING NAC INVESTORS, LLC, FOR PROPERTY LOCATED AT 3064 GRIFFIN RD., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Shelley Eichner of Calvin Giordano and Associates representing NAC Investors, LLC has applied for site plan approval for the proposed construction of a 57 unit 2-story townhouse development at the southeast corner of Griffin Road and SW 31 st Avenue on the former site of the Thunderbird Mobile Home Park, Dania Beach; and WHEREAS, the Planning &Zoning Board on June 18, 2003, recommended that the City Commission grant the site plan request(SP-42-03), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-42-03) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A" is approved, subject to the following conditions: 1) That the Home Owners' Association documents reflect that boats and boat trailers and recreational vehicles will not be permitted within the project. 2) Delete the monument sign from the site plan (City cannot grant a permit for the vehicular entry sign as it is located in public right-of-way). 3) Payment of$70,537 local park impact fee prior to issuance of any building permits. 1 RESOLUTION NO. 2003-223 4) Obtain written approval from the easement holders for any proposed landscaping within the easements. 5) Minimum C-900 pipe required brass fittings and iron taps. Lift station wet well material must be reviewed and approved by the Department of Public Services. Fiberglass is not acceptable. 6) Provide the wetland delineation for the site area being disturbed (including the outflow line) and obtain written approval from all governing regulatory agencies for the encroachment into the mangroves. 7) Provide the approved wetland mitigation plans. 8) Provide a mitigation donation of $12,800 to the City's Tree Trust Fund for the removal of the existing trees on the site, prior to issuance of tree removal permit. 9) If the applicant chooses not to reserve two parking spaces for each unit, Home Owners'Association documents shall provide notice that only one parking space is reserved for each unit and that additional parking is available on a "first come, first serve" basis in guest parking areas located throughout the complex. 10) Home Owners' Association documents to identify City Future Land Use Plan designations of adjacent undeveloped properties. 11) Homeowners' Association documents to identify proximity of project to Fort Lauderdale-Hollywood airport and refer questions concerning airport/runway expansion to the Broward County Aviation Department. 12) Payment of additional $5,000 cost recovery fees to address traffic consultant review, landscape consultant review and site inspection, and multiple in-house staff review. Unused funds will be reimbursed to the applicant upon issuance of • Certificate of Occupancy. It is further noted that the original Site Plan is maintained in the office of the Community Development Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Dania Beach Boulevard ` Dania Beach, FL 33004 RE: VILLAS @ HARBOR ISLES WEST TINTER ASSOCIATES PROJECT NO. 03-2052 Dear Mr. Leeds: As you requested, this office has reviewed the material submitted by Calvin, Giordono relative to the above referenced project on N.W. 31 Avenue in the City of Dania Beach. In addition, a field review of the area was completed on the morning'of July 21, 2003. ® The following comments are offered: 1) The trip generation calculations completed were apparently based on a combination of new Broward County peak hour trip generation rates, old Broward County daily trip generation rates and Institute of Transportation Engineers (ITE) calculations for directional split during the peak hour. Using just ITE rates yields slightly different results. The methodology employed, however, maximizes the anticipated traffic approaching the site during the peak hour, thus yielding reasonable results. 2) No distribution calculations were included. For the purposes of the queue analysis, it was apparently assumed that all traffic will come to/from the north on N.W. 31 Avenue. As some traffic may be oriented to the south to gain access to Stirling Rd. or directly west into Publix, this assumption yields conservative results for the queue analysis. 3) This office concurs with the findings relative to the need for a southbound left turn lane, when applying Broward County standards. 4) The queue analysis is reasonable. We concur that a southbound left turn lane will not be required for the anticipated site traffic. If this had been a larger traffic generator, it would have been appropriate to collect additional traffic data at the Griffin Rd./ N.W. 31 Avenue intersection and have the applicant complete a more detailed analysis of that intersection. The additional peak hour traffic from this development should not, however, have Sa significant impact on that signal operation. 4 August 27, 2003 City of Dania Beach Page 2 • 5) The site plan indicates that there is sufficient room to stack 6 vehicles between the entrance gate and the edge or pavement of the N.W. 31 Avenue. Given the low volume of entering vehicles during the PM Peak Hour (averaging less than one vehicle every two minutes), this stacking distance will be more than adequate and will insure that any queues which might develop will not interfere with traffic on the public street. 6) It is unclear from the site plan what the offset (if any) will be between the site access and the entrance/exit to Publix. Improper offset could create a situation that would be conducive to the creation of a queue on N.W. 31 Ave. Best operation will be obtained if the driveways line up. While the driveways are "intended to line up", it is not clear from the site plan whether or not they do. The site plan seems to show that the driveway is located just south of the existing guardrail. There does not appear to be any notation that the guardrail is to be modified. If that is where it is, I do not believe that it will align with the Publix drive. In order to verify, have the proponent supply the Town with a survey showing both sides of N.W. 31 Avenue and locating the new proposed driveway. If they are offset, as I believe they are, this should be corrected. 7) Anyone (pedestrian) from the site desiring to go to Publix will likely do so by crossing directly across N.W. 31 Avenue. Pedestrian facilities (sidewalks) should be provided for this. If the driveways are aligned, this will require a sidewalk along the entrance road to N.W. 31 Avenue. If they do not align (which we do not recommend) then a short section of sidewalk should also be provided on the east side of NM. 31 Avenue between the entrance to the site and the entrance to Publix. Other pedestrian activity can be accommodated via the pedestrian access from Griffin Rd., eliminating the need for additional sidewalk along the site frontage on N.W. 31 Avenue. I am not convinced that pedestrians who are destined to Publix will walk out of the site, between two buildings, via the pedestrian access to Griffin Road and then walk west to Publix. This is especially true of residents who will reside along the south and west portions of the property. The most direct access will be to cross N.W. 31 Avenue. Sidewalks (which will have to include gates in the fence that can be opened with the same access system used for the vehicular gates..-r..tbe...proposed_,getes3..the.flor$h) should be��q included along either the north or south side of the entrance road. To improve pedestrian safety, consideration should be given to posting Pedestrian Xing signs, along with a marked crosswalk. Y August 27, 2003 City of Dania Beach Page 3 8) If the northern gate is accepted as the only pedestrian access to Griffin Road, then sidewalks should be provided between Buildings 8 & 9. The site plan that was provided does not show such a sidewalk. 9) The site plan provided to this office does not show any handicapped parking spaces. Where will they be located? On September 9, 2003 the City Commission continued the site plan request to allow the applicant to address parking concerns of staff. The applicant has submitted a site plan indicating parking spaces will be allocated accordingly: 1) Each townhouse will have a one parking space reserved exclusively for that townhouse. In the majority of cases, this space will be located close to the townhouse it serves (57 spaces). i 2) 57 spaces located throughout the complex will be designated for "unit owners only" (These spaces may be used by any unit owner on a first- come first serve basis). 3) 18 spaces will be designated for guests only, located primarily at the north end of the complex. STAFF RECOMMENDATION Sidewalk waiver to be discussed. Approval of revised site plan, provided HOA documents reflect the above and exclude boats, boat trailers, and recreational vehicles; subject further to the following additional conditions. i 1. Response: Visitors and residents will use the same lane. 3. Fence located along SW 31"Avenue is not located on property,please relocate. The signage on Griffon Road Is a part of the perimeter wall and not a free standing monument sign.'There Is no entrance on Griffin Road. Sheet L-1 lists trees requiring mitigation,trees not requiring mitigation. No tree relocation is proposed. 3. Revise the provided specification percentages for the proposed trees to meet the required percentages. Response: Done. 4. Provide and label all existing and proposed easements on the landscaping plans. Additionally,obtain written approval from the easement holders for any proposed landscaping within the easements. Response: Ali easements are noted. Written approvals from easement holders will be.requested upon site plan approval. S. Label all the fences and walls on the landscape plans. Also advise if a fence is proposed on the east perimeter buffer. Lastly,obtain staff approval for the proposed chain link fence. Recommend if approved that the hedge be installed at a height equal to the chain link fence. Response: All fences have been labeled. A shadowbox fence is proposed on the east P/L. 6. Several of the proposed engineering cross sections need to be revised,.as they conflict and/or require more information to determine that they do not conflict with the proposed landscaping. NOTE: The proposed landscaping cannot be in the retention areas or on the required 4 to 1 slopes of them. Response: Done. 7. Provide a tree protection barricade on the landscaping plans. Response: None required. See response#3. 8. Label all the site lighting and explain some of the locations,as they appear to be in the sidewalk and on top of the retaining wall. Response: Lighting has been revised. There are no conflicts with sidewalks. The light on the south end of the lake cannot be placed on the bulkhead and is offset between curb stops. 9. Move the proposed fire hydrants and the fire department equipment to the front of the landscape islands to allow for the required trees. Response: Done. During that visit it was determined that the site contains some Department jurisdictional wetlands. The approximate boundaries are delineated in hatching on the enclosed aerial photograph. If an exact line is desired,you may elect to arrange a joint site inspection with your surveyor present. This determination was made according to the Natural Resource Protection Code definition of RegulaledAquadc and Wetland Resources and Section 27-334(e),which incorporates the wetland delineation methodology ratified by the Florida Legislature and implemented in 62-340 F.A.C. In the event of a conflict with a formal delineation conducted by the Florida Department of Environmental Protection or the South Florida Water Management District pursuant to 62-340 F.A.C.the determination of said Agency will be the controlling delineation. This determination is valid for a period of no more than two(2)years from the date of this letter. Any construction which involves any dredging or filling operation in the wetlands will require an Environmental Resource License. Any activities,e.g. lake or canal excavation,regulated under Article XI of the Natural Resource Protection Code,may require a license. This letter does not constitute a waiver of review by the Land Use and Permitting Division of this Department prior to clearing and grubbing. Since there is room to stack 6 entering vehicles, I believe that peak hour traffic can be stored on-site without interferring with NW 31 Avenue traffic.
