A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING MODIFICATIONS TO THE
APPROVED SITE PLAN SUBMITTED BY ROBERT JOHNS,
FOR GUARDIAN AMERICAN DEVELOPMENT CO., LLC.,
FOR PROPERTY LOCATED AT 3057 SW 45T" STREET
GENERALLY LOCATED NORTH OF 45T" STREET, WEST
OF SW 30T" AVENUE AND EAST OF SW 30T"WAY, DANIA
BEACH, DANIA BEACH; PROVIDING FOR CONFLICTS;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Robert Johns, for Guardian American Development Co., LLC., has
applied for modifications to the site plan relating to the installation of perimeter landscape
and wall around a 20 unit single family development known as the Bridgewater Estate
Homes, property located at 3057 SW 45th Street generally located north of 45th Street, west
of SW 30th Avenue and east of SW 30th Way, Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proposed modification to the site plan (SP-41-03) relating to the
installation of perimeter landscape and wall around a 20 unit single family development
known as the Bridgewater Estate Homes, property located at 3057 SW 45th Street
generally located north of 45th Street, west of SW 30th Avenue and east of SW 30th Way,
Dania Beach is approved, subject to the following:
a) Applicant to install a six foot wall along the west lot line with a six inches cornice
on top.

b) Applicant to maintain a 5 foot wall with a six inches cap along the south lot line.
Section 2. That based upon the criteria set forth in Section 84(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SUBJECT: SP-41-03 — The Applicant, Robert Johns, on behalf of
Guardian American Development Co., LLC., is requesting
site plan modification of the perimeter wall height for
Bridgewater Estate Homes (property located at 3057 SW
451h Street).
On September 9, 2003 the City Commission approved a site plan for the subject
property, subject to the applicant reducing the wall height to five (5) feet and
maintaining a six (6) feet hedge in front of the wall. The applicant has agreed
to maintain a five (5) foot wall along SW 45th Street. Pilasters or corner caps will
® increase the wall height by 6" to 12" resulting in an overall height of five and a
half (5.5) feet to six (6) feet.
The applicant is requesting a site plan modification to install a six (6) foot high
wall (plus 6"-12" pilasters) along the west lot line. A six (6) foot exterior wall
height would result in a four (4) foot high wall measured from the interior of the
property. The height difference is due to a two (2) foot ground differential
between the inside and outside of the wall.
A five foot wall would provide only a (3) foot interior wall height along the west
property line. The applicant indicates this is not a problem along SW 45th Street
which is at a higher ground elevation. The applicant argues a three (3) foot
interior wall height would not be effective in preventing small children from
climbing, from the inside out, over the wall. Staff is awaiting applicant's revised
plans to determine if this is the case.
RECOMMENDATION
Recommendation pending review of revised plans.

WHEREAS, the Planning &Zoning Board on July 16,2003, recommended that the
City Commission grant the site plan request(SP-41-03), based upon the criteria set forth in
Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-41-03)for site plan approval, a copy of which
is attached and made a part of this Resolution as Exhibit "A", is approved subject to the
following conditions:
® a Reduce the height of the wall on the west and south side to 5 feet
® Installation of proper vegetation as determined by the City's Landscape
Consultant on the outside of the wall

® Installation of a fire hydrant to service the existing homes to the west of the
subject parcel (location to be determined by the Fire Marshal)
It is further noted that the original Site Plan is maintained in the office of the Community
Development Department, of the City of Dania Beach.

NOTICE IS HEREBY GIVEN that a public hearing will be held before the City Commission on
Tuesday, October 14, 2003 at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach
Commission Chambers, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida
33004, for the purpose of hearing any comments which might be made to the following requests:
MODIFICATION TO SP-41-03 — The applicant, Robert Johns, on behalf of Guardian American
Development Co., LLC., is requesting site plan modification of the perimeter wall height for
a project know as the Bridgewater Estate Homes for property located at 3057 SW 45th
Street.
Copies of the proposed petition are available for viewing in the Community Development Department, 100
West Dania Beach Blvd., Dania Beach, Florida between the hours of 8:00 a.m. and 4:00 p.m., Monday -
Friday. Interested parties may appear at the public hearing and be heard with respect to the proposed
petition.
In accordance with the Americans With Disabilities Act, persons needing assistance to participate in any of
