REPRESENTING RABBI ANDREW SKUROWITZ ON BEHALF OF MAIMONIDES SHALOM ACADEMY, INC., FOR PROPERTY LOCATED AT 5300 SW 40TI AVENUE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit; and WHEREAS, Synalovski Gutierrez Romanik Architects, Inc., representing Rabbi Andrew Skurowitz on behalf of Maimonides Shalom Academy, Inc., has applied for ® modifications to the site plan approved by Resolution 2003-168, relating to the proposed construction of an addition to the existing school located at 5300 SW 40th Avenue, Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposed modifications to the site plan (SP-38-03), property located at 5300 SW 40th Avenue, Dania Beach is approved, subject to the following conditions: 1) Indicate the highest elevation on the adjacent east property line, in order to determine the slope of the 10' buffer. The maximum elevation drop must be 6" to 8" on all landscape buffers. 2) Landscape consultant to verify condition of Oak and Banyan trees prior to issuance of any tree removal permits, including payment of tree removal fees if applicable. 1 RESOLUTION NO. 2003 -259 3) The applicant must clarify type and height of hedge to be planted inside the wall located on the north lot line. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. Site Plan Modification The applicant is requesting to modify the previously approved site plan, including a new building foot print, fire lane, parking lot location and northern egress location. The City Commission approved, with conditions, a site plan and variances for this ® project on July 8, 2003. The applicant is now requesting modifications to the site plan. SITE PLAN REVIEW The original site plan included the following: ® A new 4,000 square feet modular classroom along the south lot line of the existing school parcel. o A new parking lot on the property directly north of the school parcel. ® The applicant also proposes a new driveway, for exit only, be installed adjacent to the north lot line of the north parcel. The following variances were approved subject to the applicant providing a minimum 20 foot wide landscape buffer along the north property line. To waive the requirement that residentially zoned property only be used to accommodate 25% of the required parking for adjacent non- residentially used development (existing school). Section 39-240, entitled Off- Site Parking Lots. o To waive the 10 foot landscape buffer around the parking lot, adjacent to SW ® 40 Avenue, as identified in Section 39-240, entitled Off-Site Parking Lots. ® To waive general landscape requirements identified in Article 8 entitled, Functional Landscaping and Xeriscaping. The applicant continues to propose, though not part of this application, the construction of new school buildings on the north parcel in the future. The applicant has been advised this property may not be approved for school use until it is rezoned to I-1 zoning. The applicant has not yet submitted a rezoning application. The modified site plan includes: ® New classrooms larger than originally proposed. 0 Location of the fire lane has changed. ® Location of the egress has moved south. ® Parking lot moved west, requiring demolition of existing house. ® 10 More trees to be removed/relocated. ® 8 More parking spaces are provided. LANDSCAPE REVXEW The applicant originally proposed the following tree preservation, relocation, and removal program along the north lot line. 0 14 trees to be preserved; including eight Ischemia, one Tulip tree, and five Royal Palms. o 3 Royal Palm trees to be relocated. o 12 trees to be removed; including four Melaleuca, two Live Oaks, one Banyan, three Schif lera, and two Florida Holly. • 33 new trees; including 30 Green Buttonwood and three Silver Buttonwood. These trees will be planted in two rows, each row approximately 30 feet apart. In addition to those listed above, the applicant is now also requesting the following: 5 additional trees to be removed; 1 Black Olive, 4 Oleanders. ® 5 additional trees to be relocated; 2 Live Oak, 1 Coconut Palm, 1 Green Buttonwood, 1 Pink Tabebula. The site plan has been reviewed by staff. The following is a list of the outstanding issues that must be addressed by the applicant prior to issuance of a building permit. Unless otherwise indicated, these comments refer to the north parcel only. 1. Indicate the highest elevation on the adjacent east property line, in order to determine the slope of the 10' buffer.
