A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA
AUTHORIZING THE CITY MANAGER TO PURCHASE ROAD
RESURFACING SERVICE IN THE AMOUNT NOT TO
EXCEED $125,000.00 IN THE FISCAL YEAR 03/04, UNDER
PALM BEACH COUNTY BID R-2003-1657 WITHOUT
COMPETITIVE BIDDING AND WITHOUT ADVERTISEMENT
FOR BIDS; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4,
Subsection (J), authorizes the City Manager to purchase supplies, services, equipment
and materials for the city government in amounts in excess of Fifteen Thousand Dollars
($15,000.00) without competitive. bidding and without advertisement for bids if he is
authorized to do so in advance by a resolution adopted by the City Commission and if
such purchases are made pursuant to a competitive bid obtained within the last twelve
(12) months by other governmental agencies such as the Federal Government, State of
Florida or a Florida county or municipality; and
WHEREAS, the City Manager has determined that it is necessary to purchase
road resurfacing services for the Public Services Department; and
WHEREAS, the City Manager has determined that such services can be made at
the least cost to the City by purchasing them from Florida Highway Products, Inc., under
Palm Beach County Bid R-2003-1657 a copy of which is attached hereto and made a
part hereof as Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That the proposal from Florida Highway Products, Inc., for road
resurfacing in the amount not to exceed $125,000.00 in Fiscal Year 03/04, under Palm
Beach County Bid R-2003-1657, in substantial form as Exhibit "A",is approved and the

City Manager is authorized to pay Florida Highway Products for said services from the
Public Services Fund Budget for the fiscal year 2003-2004.
Section 2. That this resolution shall be in force and take effect immediately upon
its passage and adoption.

I. EXECUTIVE BRIEF
Motion and Title: Staff Recommends Motion to Approve:
A contract not to exceed the total value of$50,000 for task orders which may be issued to'
Florida Highway Products, Inc., the lowest responsive, responsible bidder for the Annual
Micro-Surfacing Contract.
Summary:
The Annual Micro-Surfacing Contract consists of overlaying existing pavement on various
roads. Small Business Enterprise (SBE) goals were established at 15% of the overall
contract amount. The low, and only, bidder, Florida Highway Products, Inc., achieved
8.1%overall. These contract prices are similar,and in a few cases,lower than our existing
® annual contract.
District:Countywide (MRE)
Background and Justification:
Bids were received by the Board of County Commissioners (BCC)on Tuesday, July 22,
2003. Items within the bid take into consideration different geographic locations,different
project sizes and adjustments for varying existing road conditions. This contract is for one
year but may be extended at the County's option,with the approval of the BCC.

specific project. After commencement of the work, it shall be properly dispatched toward completl
to the satisfaction of the Engineer, and shall be fully complete within the time limit specified. I
