HomeMy WebLinkAboutR-2003-271 VA-65-03 Key College RESOLUTION NO. 2003 — 271 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY GIL BOUCHACOURT REPRESENTING KEY COLLEGE, FOR PROPERTY LOCATED AT 225 EAST DANIA BEACH BLVD., DANIA BEACH; CHAPTER 28, ZONING ARTICLE VI SUPPLEMENTARY USE REGULATIONS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article VI sets the Supplementary Use Regulations within the City of Dania Beach, and WHEREAS, Gil Bouchacourt, representing Key College, has applied for a variance (VA-65-03)to provide 192 parking spaces associated with a private business school at the Citibank Building located at 225 East Dania Beach Blvd. WHEREAS, the Planning &Zoning Board on October 15, 2003, recommended that the City Commission grant variance request VA-65-03 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-65-03, for a variance as described above (from requirements in Chapter 28, Zoning Article VI, Supplementary Use Regulations), a copy of which is attached as Exhibit "A" is approved, subject to the following: 1) No college parking on NE 1st Terrace. The applicant shall provide signage along NE 1st Terrace saying the same. 2) Supplemental parking shall be accommodated at Frost Park adjacent to Fronton Boulevard. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Variance: To waive up to 52 parking spaces to allow a business school at the Citibank Building (244 spaces required for school, library, bank, and general offices; 192 spaces provided) Chapter 28, Zoning, Article VI Supplementary Use Regulations, Section 6.21 Off-street Parking. Special Exception: Special Exception to allow a business school in the Citibank Building located in a Commercial (C-1) Zoning District. The applicant is proposing to locate Key College, an adult educational facility, in the existing Citibank building on East Dania Beach Boulevard. The property is zoned Commercial (C-1), which allows public or private academic schools via a special exception. The applicant indicates the school, which is currently located in Plantation, will offer courses in computer assisted draft (CAD) and paralegal training. The site is occupied by two (2) buildings connected by a drive through banking facility with office space above. The college will occupy two (2) floors of the western building, with classrooms occupying most of the second floor. The eastern building is occupied by the Dania Beach library and Citibank. The office space above the drive through bank tellers is occupied by general offices. VARIANCE The site was developed as an office building, which has a lesser parking requirement than a school use. Staff reviewed the submitted plans and determined, based on the floor area and the uses, that the property will have a 52 parking space deficiency. The applicant has identified a total enrollment of 150 students with two (2) shifts of 75 students and 25 staff persons per shift. These shifts are from 8:00 am to 1:30 pm and 6:00 pm to 10:00 pm. The City's traffic consultant, Tinter and Associates, indicates there should be adequate parking for the school during evening hours, since the office and bank tenants are usually gone by 6:00 pm. However, the existing 192 parking spaces will not be sufficient to meet the minimum required number of parking spaces during weekdays. The City's traffic consultant has made recommendations to address the parking deficiency for the 8:00 am to 1:30 pm shift which is attached for your reference. These recommendations acknowledge the following: 0 10 on street parking spaces are located on NE 11t Terrace, immediately north of the site. ® Significant parking (estimated 100+ spaces) is available at Frost Park on weekdays. The City's traffic consultant concluded that "ample parking, in close proximity to the Key College site, may be utilized" to compensate for the disparity between required and provided parking. • SPECIAL EXCEPTION The use of a school in the C-1 zoning district is allowed via a special exception. As such, the use is generally not compatible with other uses allowed in a C-1 zoning district but could be if certain.criteria are met. These criteria are identified in the Zoning Code and must be satisfied in order for the City Commission to grant the special exception. These criteria include: 0 No detrimental impact will be caused; ® Use is compatible with existing uses of the site, district and character of the area; Landscaping and screening; Adequate parking is provided; and No conflict will be caused to vehicular and pedestrian traffic. As referenced in the variance discussion of this report, the information provided by the applicant was submitted to the City's traffic consultant. While the consultant identified the use of NE 1st Terrace for overflow parking, staff does not support school parking in this area because of its potential impact on the residents on NE 1st Terrace. In order to further ensure that overflow parking and future growth of the college will not negatively impact the adjacent residences, staff recommends the following: 1. No college parking on NE 1� Terrace. The applicant shall provide signage along NE 1st Terrace saying the same. 2. Supplemental parking shall be accommodated at Frost Park. 3. The use of student parking decals for vehicles shall be enforced by the College. 4. Any increase in student capacity above 150 shall require additional review by the City Commission. Staff encouraged the applicant to explore the possibility of utilizing Dania Jai Alai for additional parking. Dania Jai Alai was unable to accommodate their request. Correspondence from Dania Jai Alai is attached for your reference. STAFF RECOMMENDATION Approval provided that items 1-4 above are addressed prior to the issuance of an Occupational License. • PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION On October 15, 2003, the Planning and Zoning Advisory Board recommend approval with the following conditions: 1. No college parking on NW 1st Street. The applicant shall provide signage along NE 1st Terrace saying the same. 2. Supplemental parking shall be accommodated at Frost Park. 3. Any increase in student capacity above 150 shall require additional review by the City Commission. 4. The use of student parking decals for vehicles shall be enforced by the College. 5. The existing survey, as provided by your office, yields 192 existing parking spaces for the entire site. Pursuant to City Code the following represents the parking requirements for the active land uses as found on site: ® Bank= one parking space per 150 square feet of gross floor area. ® Library= one parking space per 200 square feet of gross floor area. 0 Office = one parking space per 250 square feet of gross floor area. Accordingly, I have calculated the parking requirements for the existing uses based on these parking ratios. The existing office area over the drive through facilities yield 28 spaces, while the two story bank yields 54 spaces and the two story library yields 113 spaces for a total demand of 195 spaces. As previously noted from the existing survey, 192 parking spaces are provided. As such, parking supply is 3 spaces short based on the existing uses. Considering the Key College classroom area being proposed for the site and a parking rate of one parking space per 60 square feet of classroom area, I have calculated that the Key College demand would be 48.2 or 49 spaces based on 2,892 square feet of classroom area. While I do believe this rate of one space per 60 square feet of classroom area may be somewhat aggressive, we have not had the opportunity to complete independent studies of similar sites to either verify or dispute this rate. Therefore, the Key College parking demand would be 49 spaces. Coupled with the 195 space requirement for the existing uses as outlined above, the new demand would be 244 spaces, 52 spaces short of the existing 192 spaces provided. The data as provided by your office indicated that Key College will have a total student enrollment of 150 students in two shifts. These shifts are from 8:00 AM to 1:30 PM and 6:00 PM to 10:00 PM. Further, the student population will be split evenly between the two shifts (75 • City of Dania Beach October 23, 2003 ® Page 2 students per shift). Key College itself would demand 25 spaces per shift. During the evening shift ample parking on site will be available since the office and bank components of the site will be virtually dormant, leaving 82 spaces needed by these uses (28 for the office and 54 for the bank), which may be used by Key College. The latest the bank stays open is on a Friday when the walk up area closes at 6:00 PM. The morning shift for the college will also require 25 spaces. Considering that the other existing land uses will in all likelihood be active during the morning Key College shift, the existing 192 spaces will not be sufficient to meet the code required parking supply for the entire site. As such, we offer the following to mitigate the Key College parking demand: ® There are 14 spaces along the west side of Fronton Boulevard, designated as a public parking area and not included in the total parking count as found on the original survey that may be used by Key College. ® Frost Park along Northeast 1 Street also has ample parking available that could be used for overflow parking and is within a comfortable walking distance. © There are also public parking areas along the south side of Northeast 1 t Terrace however, I would not encourage overflow parking from Key College along this area, as there are single family dwellings on the north side. A field survey was conducted by this office on Thursday October 9, 2003 at approximately 4:00 PM. The east side of the site, where the existing uses are operating provided for 54 parking spaces; of these approximately half were occupied. The west side of the site, consisting of 138 spaces found no vehicles parked. There were 12 vehicles parked off site on the south side of Northeast 1st Terrace, however we could not ascertain how many were site related and how many were from the single-family homes on the north side of Northeast 1s`Terrace. Therefore, considering the under-use of the existing parking area, the public parking availability at Frost Park and public parking areas along the west side of Fronton Boulevard, it can be concluded that ample parking, in close proximity to the Key College site, may be utilized. Public Works and Utilities Director SUBJECT: Water and Wastewater Requirements Information contained in this directive is for plan review only, it is the applicants obligation to follow due diligence and insure all applicable City, County, State and Federal codes are adhered to. Water and wastewater materials must be shown on the drawings, this includes Brass Fittings, Iron Taps and Specification Type of Piping. Locations of the Backflow Prevention Device must be shown 4on the drawings. It is required by the City of Dania Beach Code Section 27-9 and the Florida dminstrative Code 62-555.360 that a Backflow Prevention Device be installed on all supply line services. All properties must have a device that is applicable for the service and is subject to the review and descretion of the Public Works and Utilities Director as outlined in the City of Dania Beach Code Section 27-20. If the applicant is seeking a permit for an irrigation system the applicant must provide a backflow prevention device as required in the City of Dania Beach Code Section 26-53. Sec. 27-9. Water meters. (a) All meters shall be furnished and installed by the utility department upon application of owner or his/her agent and the payment of prescribed charges, and all meters furnished and installed shall be and remain subject to absolute and exclusive control of the utility department. (b) A backflow preventer valve shall be installed and maintained on supply line as stated in the Florida Administrative Code 17-555.360 and the BOCA Uniform Plumbing Code. (Ord. No. 30-91, § 1, 9-11-91; Ord. No. 02-94, § 3, 3-8-94) Sec. 27-20. Connections to service mains. (a) Service pipe to property line. The utility department shall lay the service pipe to the property line of the owner of platted lots who has paid the appropriate fee for water service. In other words, the utility department shall not run service connections into lots or parts of lots that have been divided and no provisions for easements or alleys have been made for water supply lines. (b) Installation of larger service pipes. In case the service supplying a house or building is found not to be large enough due to additions to the building or an increase or change in the number �f fixtures, the utility department will make the larger tap and install the larger service upon the payment of the tapping charge and appropriate deposit for the size of the new service. No credit will 0be given for the service already in place that is found to be insufficient in size. ) Gate valve. The owner shall be required to place a gate valve on the service between the building and the meter box so the supply may be turned off by the owner in case of a break or repairs being made in the building. (d) Size of service connection prescribed. The utility department in every instance reserves the right, at its option, to designate and prescribe the size of a service connection, either upon original installation of a new connection or upon any renewal or replacement of any old connection and in any case, where a size of service other than that applied for by the owner, or previously existing, is so designated and prescribed by the utility department, the owner shall be bound thereby. (e) Other requirements relating to service. The utility department reserves the right, at its option, where and when, in its discretion, the conditions may or might require it, at any time to require any owner to install on his service connection a tank, check valve or valves, approved backflow prevention devices, cock or gate valve, pressure regulator or other appliances, apparatus or equipment of such type and design as is approved by the utility department and thereafter to require any change, alteration, substitution or addition of and to any such tank, etc., as aforesaid, and failure upon the part of the owner to comply with such requirements of the utility department within thirty (30) days of written notice shall authorize the utility department at its option, and without further notice, to cancel the service and discontinue same. (Ord. No. 30-91, § 1, 9-11-91) Sec. 26-53. Plant material and installation requirements. (i) Irrigation plan required. An irrigation plan shall be submitted to the building department ofor approval and issuance of a permit prior to the installation of any new irrigation system. The rigation plan shall meet the following requirements: (1) A minimum scale of one (1) inch equals fifty (50)feet; (2) Location of existing or proposed trees, vegetation and ecological communities, if applicable; (3) Location of existing building, paving and site improvements to remain; (4) Location of proposed buildings, paving, site improvements and water bodies; (5) Main location, size and specifications; (6) Valve location, size and specifications; (7) Pump location, size and specifications and water source; (8) Backflow prevention device type and specifications; (9) Zone layout plan (minimum scale one (1) inch equals twenty (20) feet) indicating headtype, specifications and spacing along with methods used to compliance with xeriscape principles as required by Florida Statutes 125.568. Public Works and Utilities Director SUBJECT: Impervious and Pervious Requirements Information contained in this directive is for plan review only, it is the applicants obligation to follow due diligence and insure all applicable City, County, State and Federal codes are adhered to. Article 29 (attached) of The City of Dania Beach code allows for seventy (70) percent impervious area and thirty (30) percent pervious area for all non residential sites; sixty (60)percent impervious area Wnd forty (40) percent pervious area for all residential sites. Applicants requesting a deviation from is code must obtain a variance. All deviations must be mitigated with properly designed drainage systems that meet or exceed the capacity to be mitigated. If a variation is granted, the impervious area shall not exceed eighty-five (85) percent for industrial uses, eighty (80) percent for commercial uses and seventy (70) percent for residential uses. Permit application requires the submission of signed stamped drawings with the impervious and pervious areas and percentages clearly stated on the drawings. If a variation is requested, calculations must be submitted showing mitigated capacities, areas and design capacity of the drainage system. Calculations may be included on the drawings provided the drawings are signed and sealed by a licensed professional engineer registered in the state of Florida. If the drawings are signed and sealed by a licensed,architect, separate calculations must be submitted and must be signed and sealed by a licensed professional engineer registered in the state of Florida. All sites parcels greater than one (1) acre require the review and seal of the Broward County Department of Planning and Environmental Protection, Surface Water Management. Permits submitted without the required seal will be rejected and returned without review. ARTICLE 29. PERVIOUS AND IMPERVIOUS AREAS* *Editor's note: Section 1 of Ord. No. 20-99, adopted Aug. 24, 1999, added provisions designated as Art. 28, § 28.10. Inasmuch as there already exists an Art. 28, the editor has redesignated said new provisions as Art. 29, § 29.10. 29.10. Impervious land area requirements. To effectively provide for the drainage of stormwater, the area of land covered by buildings, structures and impervious surfaces shall not exceed seventy (70) percent for industrial uses, seventy (70) percent for commercial uses and sixty (60) percent for residential uses. For the purpose of this requirement, all other uses such as, but not limited to, utilities, transportation and office parks, shall be included in the commercial use category. In mixed use developments, the most restrictive of the applicable impervious area limitations shall be utilized. For purposes of this ordinance, "impervious" shall mean and refer to any area or part of any parcel of land that has been modified to reduce the natural ability of land to absorb and hold rainfall. Any placement of any nonorganic material which prohibits penetration by liquids or other soluble materials results in the creation of an impervious area. For purposes of this ordinance, "pervious" shall mean the opposite of"impervious" as defined and described above in this ordinance. (1) Subject to compliance with all other city ordinances, pervious areas may be used to satisfy �requirements for landscaping and setbacks, buffer strips, drain fields, passive recreation areas and ny other purpose that does not require covering with a material that prevents infiltration of water into the ground. (2) In those cases in which city ordinances may allow some required parking stalls to be grassed, no credit towards the computation of pervious area shall be granted for such areas. (3) Upon demonstration by an applicant that special conditions peculiar to the location or physical characteristics of a particular site are present, or special conditions resulting from the design of existing facilities or surrounding land uses are present, the city commission may permit variation from the impervious area standards, subject to the following limitations: a. Variation from the impervious requirements shall be proportional to mitigating design improvements provided in excess of the minimum required engineering and landscaping standards. If a variation is granted,the impervious area shall not exceed eighty-five (85) percent for industrial uses, eighty (80) percent for commercial uses and seventy (70) percent for residential uses. b. Mitigating design improvements may include the use of grassed retention basins and swales to aid in the filtration of storm water runoff or any combination of the foregoing. C. Pervious paving blocks may be used in overflow parking areas, park and recreation parking facilities and residential areas. In all cases in which pervious paving blocks are used at locations where pedestrian traffic is prevalent, the block voids shall be planted with a nonrunner specie of grass such as, but not limited to, zoysia or bermuda grass. The following information is provided to define special conditions that apply to the actual parking requirements for Key College. 2. Presently,Key College is located at 5525-C West Broward Boulevard in Plantation,Florida. Parking at that location is limited but adequate. 3. Key College anticipates re-locating to 255 East Dania Beach Boulevard, Dania Beach, Florida. This move is conditional and contingent upon a) analysis and review of parking availability, b) concurrence by the accreditation agencies of Key College and c)the results of an informal student impact survey. 4. Key College maintains a student body of approximately 150 students. This average has remained constant for more than a decade. 5. Programs are divided into two shifts. The morning shift is 8:00 am to 1:30 pm. The evening shift is from 6:00 pm to10:30 pm. Therefore,there are normally no more than seventy students present at any one time. 6. One of our primary programs is CAD and Drafting. Approximately 10%of classroom floor space is dedicated to the additional space the drafting tables take up. 7. Both the bank and library are small scale operations.Their allotment of parking spaces is always underutilized. 8. There are fourteen additional spaces adjacent to the site along the street that are not counted but could be used if necessary. 9. The formulae in the ordinance are based on`worst case'scenarios and full occupancy. Realistically it is exceptionally rare for any commercial building to be at 100%occupancy. 10. Key College does not project extraordinary growth. Our mission is to provide the highest quality professional education and not to compete with the quantity of other privately owned colleges. 11. We have explored other alternatives that provide viable options to potential parking problems should they arise including a) annual (limited to one year terms) renewable leases with Dania Jai Alai and b) remote satellite parking at the Sheridan Street Park & Ride lot. This latter alternative has been approved by the Florida Department of Transportation and will require a shuttle,which will be provided by Key College,if required. 12. In summary,our assessment is that on-site parking that is presently available is more than adequate.
