HomeMy WebLinkAboutR-2003-283 VA-80-03 Paolos 3s Co Variance RESOLUTION NO. 2003-283 A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE REQUEST SUBMITTED BY PAOLO DEFRANCISCI, OWNER OF PAOLO'S THREE'S COMPANY RESTAURANT, FROM CHAPTER 26,VEGETATION, FOR PROPERTY LOCATED AT 242 EAST DANIA BEACH BLVD., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, Vegetation, sets the landscaping requirements for the City of Dania Beach; and WHEREAS, Paolo DeFrancisci, owner of Paolo's 3's Company has applied for a variance (VA-80-03)from general landscape requirements identified in Chapter 26, Vegetation,for property located at 242 East Dania Beach Blvd., in the City of Dania Beach; and WHEREAS, the Planning & Zoning Board on November 19, 2003, recommended that the City Commission grant variance request VA-80-03 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-80-03, for a variance as described above (from requirements in Chapter 26, Vegetation, a copy of which is attached as Exhibit "A" is approved. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. SP-81-03: Request by Paolo's 3's Company, to construct 20 space parking lot directly west of 242 East Dania Beach Boulevard. The applicant previously obtained City Commission approval to allow an outdoor seating area on the west side of the existing restaurant. Applicant now wishes to install a paved parking area next to the outdoor seating area. The site plan complies with zoning requirements with the exception of the following: 1) Applicant's landscaping emphasizes palm trees instead of the required mix of shade and palm trees. 2) Applicant has not installed an underground sprinkler system. Applicant does meet the 30% landscaping requirement, has installed extensive palm landscaping on all sides of the site, and has installed exterior lighting along Dania Beach Boulevard.
