HomeMy WebLinkAboutR-2003-285 va-79-03 Williams Garage RESOLUTION NO. 2003- 285 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY MICHAEL AND ANITA WILLIAMS, FROM CHAPTER 28, ZONING, ARTICLE 4, DISTRICT REGULATIONS, SCHEDULE OF LOT, YARD AND BULK REGULATIONS FOR PROPERTY LOCATED AT 829 ARGONAUT ISLE, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Article 4, District Regulations sets the Lot, Yard and Bulk regulations for properties within the City of a Dania Beach; and WHEREAS, Michael and Anita Williams have applied for a variance (VA-79-03)to allow an 18 foot 10 inch setback where 25 feet is required in conjunction with the reconstruction and expansion of a garage located at 829 Argonaut Isle, in the City of Dania Beach; and WHEREAS, the Planning & Zoning Board on November 19, 2003, recommended that the City Commission grant variance request VA-79-03 based upon the criteria set k forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-79-03,for a variance as described above (from requirements in Chapter 28, Zoning, Article 4, District Regulations), a copy of which r is attached as Exhibit "A" is approved, provided that the existing palm tree is preserved in its current location or relocated on-site. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution ® VA-79-03 Williams 1 RESOLUTION NO. 2003-285 are repealed to the extent of such conflict. Section 3. The subject property is located in a single family residential (RS-6000) zoning district. The dwelling unit currently has a carport accommodating one vehicle. The applicant is proposing the construction of a two (2) car garage, providing a 19 foot front yard setback (25 feet required). The minimum required side yard setback of seven and a half (7.5) feet will be maintained. The applicant is also proposing to expand the existing drive way to provide access to both garage bays. A new entry walkway into the dwelling will also be created. The proposed garage will have fenestration, similar to that of the house, on both sides of the structure providing a unifying design element. The proposed roof line of the garage matches the existing house further unifying the design. There is a Coconut palm located in the north east corner of the property which may be impacted by the proposed garage construction. Because this is an owner occupied house, and the tree is not located in the swale area, the tree, can be removed with out a permit or replacement if the tree is less than 18" in diameter. If the tree is 18" or greater in diameter, City Commission approval (plus payment to the landscape trust fund) is required. Please note the P and Z Advisory Board recommended, as a condition of approval, that the coconut palm be relocated on- site if removal is necessitated by the garage addition. The factors are consistent to meet the necessary criteria: The property in question is triangular in nature,resulting in the front property line on a severe angle, unlike most lots. The circumstances result from the odd property shape,not the actions of anyone. The goal is to enhance the above listed property with two attached, si.ingle car garages, with one being set back in order to minimize the variance required. This results in no special privilege in this zoning district. The existing carport has one corner not in compliance with code. Due to much termite and water damage, the existing structure cannot be enclosed, but needs to be completely rebuilt.
