Home My WebLink AboutO-2002-004 ORDINANCE NO. 2002-004 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING ORDINANCE NO. 2001-034, WHICH ADOPTED THE FLORIDA BUILDING CODE, BY AMENDING SECTION 4 OF THE ORDINANCE TO REVISE ITS EFFECTIVE DATE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on December 11, 2001, the City Commission adopted Ordinance No. 2001-034, which adopted the Florida Building Code, effective on January 1, 2002; and WHEREAS, the Florida Legislature has extended the effective date of the Florida Building Code until March 1, 2002; and WHEREAS, the City Commission desires to amend Ordinance No. 2001-034 to ensure consistency with state law; NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That Section 4 of Ordinance No. 2001-034 is amended to read as follows: Section 4. That this ordinance shall be in force and take effect on jana4y-March 1, 2002 or on the date that the Florida Building Code shall become officially in effect throughout the State, whichever date is applicable. Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 3. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Section 4. That this ordinance shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED on first reading on January 22, 2002. The Florida Legislature has extended the effective date of the Florida Building Code until March 1, 2002. This amending ordinance is designed to ensure consistency with state law and to provide for an automatic new adoption date if the March 1, 2002 date is, for any reason, extended further.
