AN ORDINANCE OF THE CITY OF DANIA, FLORIDA, APPROVING
THE "GRIFFIN LAKES" PLAT, SUCH PROPERTY BEING LOCATED
WEST OF RAVENSWOOD ROAD, SOUTH OF GRIFFIN ROAD, NORTH
OF SW 51 COURT, AND EAST OF SW 24T" AVENUE, IN THE CITY OF
DANIA AND LEGALLY DESCRIBED IN EXHIBIT "A", A COPY OF
WHICH IS ATTACHED TO THIS ORDINANCE; ACCEPTING THE
DEDICATION FOR PUBLIC USE OF ALL STREETS, HIGHWAYS AND
ALLEYS AS SHOWN ON SUCH PLAT OF "GRIFFIN LAKES" PLAT;
PROVIDING FOR SEVERABILITY; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the plat of "Griffin Lakes" (PL-09-02), an Ordinance of the City Of
Dania Beach,. Florida, approving the "Griffin Lakes" plat, such property being located in the
City Of Dania Beach and legally described in exhibit "A", a copy of which is attached to this
ordinance; is hereby accepted and approved. The City of Dania Beach consents and agrees
that such plat may be recorded in the Public Records of Broward County, Florida, upon further
approval of all agencies of Broward County, Florida, having jurisdiction in the matter.
iSection 2. That the dedication for public use of all streets, highways and alleys, as
shown on the plat of "Griffin Lakes" plat, is accepted by the City of Dania Beach, Florida,
Section 3. That all ordinances or parts of ordinances in conflict with the provisions of
this ordinance are hereby repealed.
Section 4. That this ordinance shall take effect immediately at its time of passage.

REQUEST: PL-09-02: Preliminary Plat Request (Second Public Hearing)
LOCATION: West of Ravenswood Road, south of Griffin Road, east of SW 24th
Avenue, and North of SW 51St Court
PROPERTY SIZE: 35.58 gross acres (33.62 net acres)
In order to develop the subject property, the developer is required to file what is known
as a "perimeter plat" (similar to a boundary survey) of the property.
Broward County, as part of its plat review:
a) Evaluates the needs of the proposed development in terms of potable water,
sanitary sewer, and schools.
b) Collects impact fees for public schools, county parks, and county mass transit.
c) May require the construction of off-site road improvements to mitigate the impact
of the project.
The City of Dania Beach requires person's platting land for residential use to dedicate
public land for parks to meet the needs created by their development. Where
dedication of land is not feasible, the applicant shall dedicate a fee based upon the "fair
market value" of the land that would otherwise be required to be dedicated.
In this case, a 427 townhouse project requires 2.56 acres for public park. If the city
commission determines a 2 Y2 acre public park within this project is not feasible, the
developer shall pay a fee equal to the fair market value of the land to be dedicated.
The City Code provides three alternative methods for determining "fair market value":
1) The City Commission may hire an appraiser to determine the fair market
value of the dedicated parcel.
• 2) The developer ,obtains his own appraisal, which appraisal may be accepted
by the city commission if found reasonable.

3) The city commission and developer may agree as to the fair market value.
In lieu of preparing an appraisal, the developer has offered to pay $150,000 per acre for
the 2.56 acre parcel, or $384,000.00. The developer has volunteered an additional
$250,000.00, for a total of$634,000.00.
Finally, the developer has revised the site plan to provide two tot lots and one passive
park inside the project. This is in addition to the private open space behind each
traditional townhouse and shared courtyard open space provided adjacent to the back-
to-back "new urbanism" townhouse units.
PLANNING AND ZONING BOARD RECOMMENDATION
The Planning and Zoning Advisory Board recommended accepting the park impact fee
in lieu of the dedication.
Staff will present a recommendation regarding developer's proposed fee dedication at
the City Commission meeting.

Dear Larry:
As you requested, this letter will confirm certain information relating to the applications
j for the above referenced project. First, my client will be including the following disclosures
within each purchase contract: the B-2 commercial zoning of the parcel to the northeast; the
Broward County Aviation Department contact for information concerning the status of the
airport and runway expansion; the estimated monthly and yearly payments relating to the CDD
District assessment; and the private nature of the roadways and common areas within the
property and the private association's obligation to maintain those areas.
Further, a deed restriction will be recorded against the property relating to developers
marketing the property as a for sale product to be conveyed either in fee simple or condominium,
and the limitation of site design as a two story townhouse type dwelling unit project not to
exceed 12 units per gross acre as is reflected in the Site Plan submittal under consideration. That
deed restriction will be prepared and submitted to you and to the City Attorney prior to the May
14, 2002 City Commission meeting.
Finally, my client has agreed-to contribute an additional $250,000 towards parks and
recreation in addition to any park funding requirement pursuant to Chapter 19, Article VI of the
