HomeMy WebLinkAboutO-2002-038 ORDINANCE NO. 2002-038 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES RELATING TO THE POLICE AND FIREFIGHTERS RETIREMENT SYSTEM, PROVIDING FOR RETIREE ELIGIBLITY FOR ELECTION TO TRUSTEE POSITIONS IN SPECIFIC CIRCUMSTANCES; PROVIDING FOR A SAVINGS CLAUSE; PROVIDING FOR A REPEALER; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, recent amendments to Chapters 175 and 185 allow for the election of retired members to elected trustees positions to the Board of Trustees for the Police and Fire Fighters Retirement System under certain circumstances, and WHEREAS, the City Commission has received and reviewed the actuarial impact statement concerning the cost impact of this ordinance amendment prepared by the Retirement System's actuary, and WHEREAS, the proposed ordinance amendment has been approved and recommended by the Retirement System Board of Trustees; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, AS FOLLOWS: Section 1. Sec. 18-46(1) (c), of the Dania Beach Code is hereby amended by adding the underlined language as follows: (c) Two (2) police officers, or police officers who are in the DROP, elected by a majority of the police officers who are members of the system, or a retired member when active police officer membership falls below ten (10), elected by a majority of the police officers, active or retired who are members of the system, as hereinafter provided; and 1 ORDINANCE NO. 2002-03 8 Section 2. Sec. 18-46(3), of the Dania Beach Code is hereby amended by deleting the striek-en through language and adding the underlined language as follows: (3) The elective employee trustee shall be elected in the following manner, to wit: By vote of all actively employed members of each of said respective departments who come within the purview of this article at meetings to be held at places designated by the board, of which meetings all qualified members entitled to vote shall be notified in person or by written notice ten (10) days in advance of said meeting, when the active police officer membership falls below ten (10), both active and retired members shall be eligible to vote. The candidate receiving the highest number of votes for each office shall be declared elected and shall take office immediately upon commencement of the term of office for which elected or as soon thereafter as he shall qualify therefore. An election shall be held not more than thirty (30) and not less than ten(10) days prior to the commencement of the terms for which trustees are to be elected. However, if there are no active or retired_ members remaining in the system or capable of serving, the remaining board members may elect an individual to serve in the trustee_position, who the City Commission shall, as a ministerial duty, appoint to the board of trustees. The board shall establish and administer the • election procedure for each election. The board shall by majority vote elect form its members a chairman, vice chairman and a secretary. The secretary shall perform al duties as required in Sections 175.071 and 185.06 of the Florida statutes. Section 3. That all sections or parts of sections of the Code of Ordinances, all ordinances or parts of ordinances, all charter sections or parts of sections, and all resolutions or parts of resolutions in conflict herewith, be and the same are hereby repealed to the extent of such conflict. Section 4. If any word, phrase, clause, subsection, or section of this ordinance is for any reason held unconstitutional or invalid, the invalidity thereof shall not effect the validity of any remaining portions of this ordinance. • 2 ORDINANCE NO. 2002-038 Section 5. A copy of Ms. Shoemaker's letter to Pension Fund Chairman Eugene Jewell is enclosed. Chapter 2002-66, enacted by the 2002 Florida Legislature, amended §185.05 with respect to the composition of the boards of trustees of closed pension plans. As you know, the police portion of the Dania Beach Police & Firefighters' Retirement System is a closed plan, since all of the city's former police officers were transferred to the Broward Sheriffs Office and no new police officers have entered the pension plan since that time. Prior to the amendment brought about by Chapter 2002-66, the employee-elected trustees were required to be actively employed police officers. However, because of the number of actively-employed former city police officers continues to diminish, Chapter 2002-66 permits retirees to also vote for and serve as employee-elected trustees. The active police membership of the Retirement System has now dropped below 10 and the Division of Retirement has requested that the Pension Fund Board of Trustees "submit the necessary plan amendments to the City Council for approval." 0 Tom Ansbro, Esquire Weiss, Scrota, Helfman, et al. Sections 175.061 and 185.05 were amended to add a provision allowing retirees to serve on the Board under certain circumstances. This change was made to take into consideration the ever-diminishing active member population. Sections 175.371 and 185.38 were amended to allow your 175/185 plan to be maintained until the final benefit payment has been made to the last participant or beneficiary. Additionally, it will allow a plan that is determined to be "fully funded" at a particular valuation date and not fully funded at a later date to resume receipt of state premium tax moneys until the plan is once again determined to be fully funded. The Board should consult with the plan attorney and submit the necessary plan amendments to the City Council for approval. Please provide any such amendments to our office. Subsection (18) of section 175.032, Florida Statutes, is amended to read: 175.032 Definitions.—For any municipality, special fire control district, chapter plan, local law municipality, local law special fire control district, or local law plan under this chapter, the following words and phrases have the following meanings: (18) "Supplemental plan municipality"means any local law municipality in which there existed a supplemental plan, of any type or nature, as of December 1, 2000 y- , T. Subsection (16) of section 185.02, Florida Statutes, is amended to read: 185.02 Definitions.—For any municipality, chapter plan, local law mu- nicipality, or .local law plan under this chapter, the following words and phrases as used in this chapter shall have the following meanings, unless a different meaning is plainly required by the context: (16) "Supplemental plan municipality"means any local law municipality in which there existed a supplemental plan as of December 1, 2000 januaI . Section 3. Paragraph (c) is added to subsection (1) of section 175.061, Florida Statutes, to read: 175.061 Board of trustees; members; terms of office; meetings; legal en- tity; costs; attorney's fees.—For any municipality, special fire control dis- trict, chapter plan, local law municipality, local law special fire control district, or local law plan under this chapter: (1) In each municipality. and in each special fire control district there is hereby created a board of trustees of the firefighters' pension trust fund, 1 CODING: Words stxieh are deletions; words underlined are additions. Effective October 1, 1986, and thereafter: (c) Whenever the active firefighter membership of a closed chapter plan or closed local law lan as rovided in s. 175.371 falls below 10 an active firefikhter member seat may be held by either a retired member or an active firefig_hter member of the plan who is elected by the active and retired members of the plan. If there are no active or retired firefighters remaining in the plan or capable of serving the remaining board members may elect an individual to serve in the active firefighter seat Upon receipt of such person's name, the legislative body of the municipality or special fire control district shall, as a ministerial duty, appoint such person to the board of trustees This paragraph applies onlv to those plans that are closed to new members under s. 175.371(2), and does not applyt o any other municipality or fire control district having a chapter or local law plan Section 4. Paragraph (b) of subsection (3) of section 175.351, Florida Statutes, is amended to read: 175.351 Municipalities and special fire control districts having their own pension plans for firefighters.—For any municipality, special fire control district, local law municipality, local law special fire control district, or local law plan under this chapter, in order for municipalities and special fire control districts with their own pension plans for firefighters,. or for fire- fighters and police officers, where included, to participate in the distribution of the tax fund established pursuant to s. 175.101, local law plans must meet the minimum benefits and minimum standards set forth in this chapter. (3) Notwithstanding any other provision, with respect to any supplemen- tal plan municipality: (b) Section 175.061(1)(b) shall not apply, and a local law plan and a supplemental plan shall continue to be administered by a board or boards of trustees numbered, constituted, and selected as the board or boards were numbered, constituted, and selected on December 1. 2000 danuar3-!, 40_92. Subsection(2) of section 175.371, Florida Statutes, is amended to read: 175.371 Transfer to another state retirement system; benefits payable.— For any municipality, special fire control district, chapter plan, local law municipality, local law special fire control district, or local law plan under this chapter: (2) When every active participant in any pension plan created pursuant to this chapter elects to transfer to another state retirement system, the pension plan created pursuant to this chapter shall be terminated and the assets distributed in accordance with s. 175.361. If some participants in a pension plan created pursuant to this chapter elect to transfer to another state retirement system and other participants elect to remain in the exist- ing plan created pursuant to this,:chapter, the plan created pursuant to this chapter shall continue to receive state premium tax moneys until fully funded. Ch. 2002-66 LAWS OF FLORIDA Ch. 2002-66 funded at a later valuation date the plan shall resume receipt of state • premium tax moneys until the plan is once again fully funded "Fully fund- ed" means that the present value of all benefits, accrued and projected, is less than the available assets and the present value of future member contri- butions and future plan sponsor contributions on an actuarial entry age cost funding basis. Effective May 31 1998 for plans discussed herein the plan shall remain in effect until the final benefit payment has been made to the last aGtiv-e participant or beneficiary e-rminated and shall then be ter- minated in accordance with s. 175.361. Section 6. Paragraphs (c) and (d) are added to subsection (1) of section 185.05, Florida Statutes, to read: 185.05 Board of trustees; members; terms of office; meetings; legal en- tity; costs; attorney's fees.—For any municipality, chapter plan, local law municipality, or local law plan under this chapter: (1) In each municipality described in s. 185,03 there is hereby created a board of trustees of the municipal police officers' retirement trust fund, which shall be solely responsible for administering the trust fund. Effective October 1, 1986, and thereafter: (c) Whenever the active police officer membership of a closed chapter plan or closed local law plan as provided in s. 185.38 falls below 10 an active police officer member seat may be held by either a retired police officer or an active police officer member of the plan who is elected by the active and retired members of the plan. If there are no active or retired police officers remaining in the plan or capable of serving the remaining board members may elect an individual to serve in the active police officer member seat Upon receipt of such person's name the legislative body of the municipality shall, as a ministerial duty, appoint such person to the board of trustees This paragraph applies only to those plans that are closed to new members under s. 185.38(2), and does not apply to any other municipality having chapter or local law plan. (d) If the chapter plan or local law plan with an active membership of 10 or more is closed to new members, the member seats may be held by either a retiree. as defined in s. 185.02 or an active police officer of the plan who has been elected by the active police officers A closed plan means a plan that is closed to new members but continues to operate pursuant to s. 185 38(2) for participants who elect to remain in the existing plan This paragraph applies only to those plans that are closed to new members pursuant to s 185.38(2) and does not apply to any other municipality that has a chapter plan or a local law plan. Section 7. Paragraph (b) of subsection(3) of section 185.35, Florida Stat- utes, is amended to read: 185.35 Municipalities having their own pension plans for police offi- cers.—For any municipality, chapter plan, local law municipality, or local law plan under this chapter, in order for municipalities with their own pension plans for police officers, or for police officers and firefighters where 3 CODING: Words str-ieken are deletions; words underlined are additions.
