HomeMy WebLinkAboutO-2002-039 ORDINANCE NO. 2002-039 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA, AMENDING SECTION 27-19 OF THE CITY CODE OF ORDINANCES TO INCREASE THE WATER SUPPLY RECONNECTION SERVICE FEE FROM $25.00 TO $75.00; PROVIDING FOR CONFLICTS; PROVIDING fi FOR SEVERANCE; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That paragraph (b) of Section 27-19 of the City Code of Ordinances is amended to read as follows: Sec. 27-19. Turning on and shutting off of service connections. (b) Charge for shutting off and turning on. There shall be no separate charge made for shutting off the water supply to any premises, but in every instance when such shutoff was originally made for nonpayment of any delinquent account or any other violation of any rule of the utility department, a turn-on fee of twenty-five dollars ($25.00) shall be collected; also in cases where the same person requires a turn-on at a service where the last cut-off had been in his/her such person's name, a turn-on fee .of five dollars ($5.00) shall be collected. For any service reconnection request which is received by the City after 4:00 p.m., for which the customer seeks to have service reconnected on the same day, a turn-on fee of seventy-five dollars ($75.00) shall be collected by the City. 1 ORDINANCE NO.2002-039 F:/566001:/Ordinances:/water Reconnect fees Section 2. That all ordinances or parts of ordinances and all resolutions or parts of resolutions in conflict with this ordinance are repealed to the extent of such conflict. Section 3. That if any section, clause, sentence or phrase of this ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this ordinance. Best regards, Mike 11.2 Update from City Manager Pato on shopping cart issue with grocery stores. (City Manager) ARTICLE IV Sec. 22-70 Shopping Cart Retention and Retrieval. (e) Similar systems or other plans approved by the City Manager or designee, which would accomplish the intent of this law or, at a minimum, insure the periodic and prompt retrieval of shopping carts removed from a business establishment's property. Publix and Winn Dixie have submitted retention and retrieval plans that meet the requirements of the ordinance. If it is determined that the plan is ineffective the matter can be brought back for review. 11.3 Update from Michael Sheridan, Public Works/Utilities Director, on speed humps and street closure procedures and current status of installations on SE 4`h Avenue/Dixie Highway. (Staff) Public works and the city clerks office are working with area agencies that have current procedures and/or ordinances in place that address these issues. We are currently implementing a 5 step procedure to be reviewed and revised based on relevance of area agencies,procedures. Our current procedure requires the City Manager to assign the Public Works Director as the designated city official for submission of the petition in step 2. Steps for street closure and speed hump review and implementation. 1. Citizen is required to petition effected area and the surrounding area and obtain 66 percentile in favor of the speed humps and /or street closures. Wetition is submitted to the Public Works Director for procedural implementation. 3. Review by all affected agencies. At any point in this step the determination may be completed if any agency deems the petition to be ineffective or detrimental. Presentation to the commission for their approval. 5. Implementation. Status of street closure at 40' and Dixie is as follows: Calvin and Giordano are working with Chen and Associates to complete the survey of the area so that we may finalize the design. Chen and Associates is waiting for a response from the City of Fort Lauderdale with regard to us piggybacking onto their current contract in order to minimize cost. 11.4 Discussion of increasing the service fee to customers who require a re-establishment of water service after 5:00 p.m. (Staff) Request for revision to the Code section 27-19.b. "when such shutoff was originally made for nonpayment of any delinquent account or any other violation of any rule of the utility department, a turn-on fee of twenty-five dollars ($25.00) shall be collected" Current charge is twenty-five dollars ($25.00) with no additional charge if the request is after regular business hours. The City of Dania Beach incurs a minimum of 3 hours pay for after hours employee call outs as agreed to in the union contract. Revision should be made to the code to require additional charge for after hours turn on to insure the city is compensated for its cost. A minimum of seventy-five dollars ($75.00) would be incurred for the cost of the employee and equipment. 05 Discussion of an increase in service charge for repair work required of City employees when damage is sed by outside parties. (Staff) In a case where unintentional damage is caused, the party causing the damage may elect to have the city perform the repair in lieu of obtaining a private contractor. Payment for the repair work is then made to the city. Man-hour charge fee is not set by the code; currently the City of Dania Beach charges a rate of fifteen dollars ($15.00) per man-hour. This is inconsistent with the cost incurred; this rate will be increased to thirty-five dollars ($35.00) per man-hour. •
