HomeMy WebLinkAboutR-2002-001 Relating to Zoning in Progress RESOLUTION NO. 2002-001 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, RELATING TO ZONING IN PROGRESS; DECLARING THAT THE CITY IS CONSIDERING THE AMENDMENT OF ZONING REGULATIONS THAT PERTAIN TO SIGNS; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Dania Beach desires to update its sign regulations to conform to the evolving requirements of state and federal case law, and WHEREAS, the City Commission has determined that the City planning staff, in consultation with the City Attorney, should review the existing regulations to insure that they adequately reflect constitutional requirements; and WHEREAS, after such review the staff, in consultation with the City Attorney, should develop any necessary proposed amendments to the existing regulations; and WHEREAS, the City Commission wishes to place all parties on notice that it is considering such regulations and that parties who contemplate the location of signs in the City will be reviewed for compliance with such changes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. The above recitals are true and correct and are incorporated by reference. The City Commission of the City of Dania Beach declares that the city will be preparing and processing an ordinance (the "Pending Ordinance"), that will be an amendment to the zoning ordinances of the City of Dania Beach. The Pending Ordinance will amend the zoning regulations that regulate signs within the City. Parties who contemplate the location of signs in the City will be reviewed for compliance with the provisions of any Pending Ordinance. Section 3. All affected property owners are placed on notice that any application for a sign permit to locate a sign within the City shall be subject to review pursuant to the requirements of the Pending Ordinance. Section 4. The adoption of this Resolution shall be evidenced by placement, in a newspaper of general circulation within the City, of a one-eighth page advertisement on two occasions within two weeks after adoption of this Resolution. A copy of this Resolution shall also be posted in the Growth Management Department of the City for • the next one hundred twenty (120) days. Section 5. All resolutions or parts of resolutions in conflict with the resolution are repealed to the extent of such conflict. Section 6. This resolution shall be in force and take effect immediately upon its passage and adoption. PASSED AND ADOPTED ON THE 8T" DAY OF JANUARY, 2002.
