HomeMy WebLinkAboutR-2002-009 Supporting Municipal Home Rule Powers and Authority for Municipalities to provide fire and emergency medical services they deem to be in the best health, safety and welfare of their citizens RESOLUTION NO. 2002-009 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, SUPPORTING MUNICIPAL HOME RULE POWERS AND AUTHORITY FOR MUNICIPALITIES TO PROVIDE FIRE AND EMERGENCY MEDICAL SERVICES THEY DEEM TO BE IN THE BEST HEALTH, SAFETY AND WELFARE OF THEIR CITIZENS; OPPOSING CONSOLIDATION AND MERGER OF FIRE PROTECTION AND EMERGENCY MEDICAL SERVICES WITHOUT FULL CONSULTATION WITH AND APPROVAL OF MUNICIPAL PROVIDERS IN BROWARD COUNTY; SUPPORTING AND ENCOURAGING ON-GOING MUNICIPAL COOPERATION IN THE DELIVERY OF FIRE PROTECTION AND EMERGENCY MEDICAL SERVICES; PROVIDING THAT COPIES OF THIS RESOLUTION BE FORWARDED TO THE BROWARD COUNTY COMMISSION AND ALL MEMBERS OF THE BROWARD COUNTY STATE LEGISLATIVE DELEGATION; ENCOURAGING OTHER CITIES IN BROWARD COUNTY TO ADOPT SIMILAR RESOLUTIONS; PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Dania Beach supports municipal home rule powers and authority for it and other municipalities to provide fire protection and emergency medical services within their municipalities; and WHEREAS, Broward County has commissioned a study,for the delivery of fire protection and emergency medical services in Broward County, which includes recommendations that directly impact the delivery of these services by municipal providers; and WHEREAS, the City of Dania Beach and other municipalities have been cooperating in the delivery of fire protection and emergency medical services for years, consistent with their home rule authority to provide such services as they deem appropriate for their residents and citizens; and WHEREAS, municipal cooperation in the delivery of fire protection and emergency services 1 RESOLUITON NO. 2002-009 includes, but is not limited to, mutual aid agreements, the contractual provision of services by a municipality to a neighboring municipality and dispatching issues; and WHEREAS, no efforts should be undertaken to consolidate or merge fire protection and emergency medical services in Broward County without full participation in the process by municipalities and the consent and approval of municipalities in Broward County; and WHEREAS, the City of Dania Beach desires to communicate its position on consolidation and merger of fire protection and emergency medical services to the members of the Broward County Commission and members of the Broward County Legislative Delegation. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: SECTION 1. The foregoing "WHEREAS" clauses are true and correct and hereby ratified and confirmed. SECTION 2. The City of Dania Beach, Florida, opposes any effort to consolidate or merge fire protection and emergency medical services without full consideration of municipal interests, consultation with municipal providers and involvement of municipal providers in the review of services in Broward County, and the consent and approval of such consolidation and merger of services. SECTION 3. The City of Dania Beach recognizes and endorses the on-going cooperation by and among municipalities in the provision of fire protection and emergency medical services, which has been accomplished through decisions specifically made by those municipal providers directly involved in such efforts, without direction or requirement by third parties and encourages further cooperation by municipal providers in the best interest of their residents and citizens. • 2 RESOLUITON NO. 2002-009 SECTION 4. The City Clerk is directed to forward an executed copy of this resolution to each member of the Broward County Board of County Commissioners, the Broward County Administrator and all members of the Broward County Delegation to the Florida Legislature. SECTION 5. The City of Dania Beach encourages other cities in Broward County to adopt similar resolutions and to forward such to the Broward County Commission and the Broward County Legislative Delegation to the Florida Legislature. SECTION 6. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. SECTION 7. That this resolution shall be in force and take effect immediately upon its passage and adoption. PASSED and ADOPTED this 22ND day of January, 2002. The cities of Pompano Beach and Hallandale have passed similar resolutions and the City of Tamarac is following suit. Other municipalities are presently considering taking the same action. I am submitting this resolution for • consideration and passage by the city commission. As you are aware, the county, through charter changes and other means, continues its attempt to usurp the authority of municipal leaders within Broward County to choose services which they deem the most advantageous to their citizens. Accordingly, I hereby request that this resolution be placed on the January 22, 2002 agenda.. For your further information, the fire-rescue department has prepared commendations relating to the small airplane crash on January 1s` and I hereby also request that the presentation of those commendations be placed on the same agenda.
