A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA,APPROVING
THE THIRD AMENDMENT TO THE BEACH MAINTENANCE AGREEMENT
BETWEEN THE CITY OF HOLLYWOOD AND THE CITY OF DANIA BEACH
FOR MAINTENANCE AND TRASH REMOVAL SERVICES AT DANIA
BEACH INCLUDING PARKING LOT AND LITTER PICKUP; PROVIDING
THAT THE THIRD AMENDMENT SHALL BE RETROACTIVE TO
OCTOBER 1, 2001; PROVIDING FOR CONFLICT; FURTHER, PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, via Resolution No. 134-95, the City of Dania Beach entered into an
Agreement with the City of Hollywood for beach maintenance services at Dania beach; and
WHEREAS, the term of this Agreement, as extended and amended by this Third
Amendment, shall be for one three (3) year period, retroactive to October 1, 2001,
renewable for one three (3) year period, as may be requested by the City of Dania Beach,
subject to concurrence of the City of Hollywood; provided, however, that the payments
shall be adjusted in an amount equal to the sum of the preceding three (3) years
Consumer Price Index (South Urban area), at time of renewal, as published by the United
States Department of Labor with the publication date being the month of the September;
and
WHEREAS, the City of Dania Beach shall pay to the City of Hollywood for said
services a sum of $42,100.00 per year. This sum shall be payable in equal monthly
installments retroactively to October 1, 2001.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH,
FLORIDA:
Section 1. That the Third Amendment to the Beach Maintenance Agreement with

the City of Hollywood for beach maintenance and trash removal services at Dania Beach,
in substantial form as Exhibit"A"attached, is approved and the appropriate city officials are
authorized to execute same.
Section 2. That the City Manager and City Attorney are authorized to make minor
revisions to such Third Amendment to the Beach Agreement with the City of Hollywood as
are deemed necessary and proper for the best interests of the City.
Section 3. That all resolutions or parts of resolutions in conflict are repealed to the
extent of such conflict.
Section 4. That all other terms and conditions of the Beach Agreement, as
amended, shall remain in operative force and effect.
Section 5. That this resolution shall be in force and take effect retroactively to
October 1, 2001.

THIRD AMENDMENT TO
i BEACH MAINTENANCE AGREEMENT
This Third Amendment to the Beach Maintenance Agreement made and entered
into this /44Kvday of Mli4.4- , 2002, between the City of Hollywood, a Florida
` municipal corporation (hereinafter "HOLLYWOOD"), and the City of Dania Beach, a
Florida municipal corporation (hereinafter "DANIA BEACH").
WITNESSETH:
WHEREAS, the parties entered into a Beach Maintenance Agreement for the
period beginning October 1, 1995; and
WHEREAS, the parties entered into a Renewal and First Amendment to the
Beach Maintenance Agreement on or about October 28, 1997; and
WHEREAS, the parties entered into a Renewal and Second Amendment to the
Beach Maintenance Agreement on or about October 28, 1998; and
WHEREAS, the parties wish to enter into this Third Amendment to the
Agreement, on the date and year first above written, although this Amendment will be
given an effective date of October 1, 2001;
NOW, THEREFORE, in consideration of the mutual terms, conditions, promises
and consideration hereinafter set forth, HOLLYWOOD and DANIA BEACH agree as
follows:
1. Retroactive to October 1, 2001, being the effective date of this amendment,
Section 2 of the original Agreement, as amended, shall provide as follows:
The term of this Agreement, as extended and amended by this Third Amendment,
shall be for one three (3) year period, commencing October 1, 2001, renewable
for one three (3) year period, as may be requested by DANIA BEACH, subject to
the concurrence of HOLLYWOOD.
2. Retroactive to October 1, 2001, Section 3-of the original Agreement, as amended,
shall provide as follows:
DANIA BEACH shall pay to HOLLYWOOD for the beach maintenance services,
parking lot and litter pickup the sum of $42,100.00 per year. This sum shall be
payable in equal monthly installments retroactive to October 1, 2001; provided,
however, that such payments shall be adjusted in an amount equal to the sum of
the preceding three (3) years Consumer Price Index (South Urban area), as
published by the United States Department of Labor, with the publication date
being the month of September.
3. All other terms and conditions of the Agreement, as amended, shall remain in
operative force and effect.

CITY OF HOLLYWOOD, FLORIDA, AUTHORIZING THE
APPROPRIATE CITY OFFICIALS TO EXECUTE A THIRD
AMENDMENT TO THE AGREEMENT BETWEEN THE
CITY OF DANIA BEACH AND THE CITY OF HOLLYWOOD
FOR BEACH MAINTENANCE GENERATING REVENUE
OF APPROXIMATELY $42,100.00 FOR THE PREVIOUSLY
ESTABLISHED SERVICES.
WHEREAS, the Public Works Department of the City of Hollywood has been
performing beach maintenance services for the City of Dania Beach since 1995, and
Dania Beach has requested the continuance of services previously provided by city
forces; and
WHEREAS, the City of Dania Beach will compensate the City of Hollywood in the
amount of approximately $42,100.00 annually for beach maintenance services; and
WHEREAS, the third amendment will extend the duration of the original
agreement for an additional three (3) year period commencing October 1, 2001 with an
option to renew said agreement for an additional three (3) year period; and
WHEREAS, the work specified in the agreement will be performed using existin

beach maintenance personnel and equipment, and the revenues derived from this Third
Amendment shall be used to upgrade or replace existing beach maintenance equipment
and/or provide funds for beach maintenance needs;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF HOLLYWOOD, FLORIDA:
Section 1: That -it hereby approves and authorizes the execution by the
appropriate City officials, of the Third Amendment to the Beach Maintenance
Agreement between the City of Dania Beach and the City of Hollywood, in substantially
the form attached hereto, together with such nonmaterial changes, if any, as may be
subsequently agreed to by the City Manager and approved as to form and legality by
the City Attorney.
Section 2: That the revenues derived from the Third Amendment to the Beach
Maintenance Agreement shall be used to upgrade or replace existing Meach
maintenance equipment and/or provide funds for beach maintenance needs aM ma.ji

Issue
The issue is the amendment to the Agreement for beach maintenance between the City of
Dania Beach and the City of Hollywood.
• Explanation
The attached resolution is for the amendment to the Agreement for beach maintenance
between the City of Dania Beach and the City of Hollywood. This agreement takes effect
October 1, 2001 and calls for the City of Hollywood to provide beach maintenance
services, parking lot and litter pick-up for a sum of $42,100.00 per annum. This sum shall
be payable in equal monthly installments beginning October 1, 2001.
Should the City of Dania Beach renew the contract for another three (3) year period, the
contract amount shall be adjusted in an amount equal to the preceding three (3) years
Consumer Price Index (South Urban Area), as published by the United States Department
of Labor.
