A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY GARY HELDENMOTH, REPRESENTING
STIRLING PETROLEUM, INC., FOR PROPERTY LOCATED
AT 3991 STIRLING RD., DANIA BEACH; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Gary Heldenmoth has applied for site plan approval for proposed
renovations to an existing service station and the addition of an accessory car wash to be
located at 3991 Stirling Road, Dania Beach; and
WHEREAS, the Planning &Zoning Board on January 16, 2002, recommended that
the City Commission grant the site plan request (SP-61-01), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-61-01) for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit"A" is approved, subject to
the following conditions:
a) Twenty-four (24) feet between pump islands;
b) Six (6) feet high screen wall on both the Site Plan and Landscape Plan;

c Seven 7 feet wide landscape buffer against the north lot line;
d) Orange Geiger Tree shall be 10 feet in height;
e) Parking spaces along the north lot line be reduced to 16 feet in depth
(applicant to install Type "D" curbing instead of wheel stops);
f) Relocate vacuum cleaner array from front yard to the rear yard parking area.
It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
• on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect.immediately upon its
passage and adoption.

Site Plan Fees are calculated as follows:
Residential - $275.00 Base Fee, plus $8.80 per unit for the first 100 units, plus $4.40 for each unit
in excess of 100 units.
Non-Residential/Hotel-Motel -$275.00 Base Fee, plus $1.10 per 100 sq.ft.for the first 10,000 sq.ft.

LOCATION: NE corner of Stirling Road and SW 40th Avenue — 3991 Stirling

DATE: February 26, 2002
• EXISTING CONDITIONS
The existing Mobil service station includes five gasoline pumps and three (apparently
unused) service bays. Four of the five gas pumps abut Stirling Road. The fifth gas
pump is located on the (west) side of the building and abuts SW 40th Avenue.
The larger of two canopies is located on Stirling Road, approximately 12 feet from the
street line. The smaller canopy is located on SW 40th Avenue. The rear of the service
station abuts residential use.
ZONING
The existing B-3 Broward County zoning allows the renovation of the service
station/convenience food store and the installation of an accessory drive-through car
wash. The prohibition upon service station exits and entrances within 350 yards of
residential use does not apply because the applicant intends to use existing non-
conforming entrances and exits.
PROPOSED CONDITIONS
Applicant proposes to install six new gas pumps located entirely to the west and
southwest of the building under a single canopy. The new canopy is to be setback 27
feet from SW 40th Avenue and 15 feet from Stirling Road. The area directly in front of
the building is reserved for convenience store parking.

The new gas pump canopy will provide 15 feet of vehicle clearance (14 feet required)
® and be 18 feet in height. The existing convenience store building has a pitched roof.
The canopy will be approximately 2 '/z feet higher than the roof peak of the existing
building. The new canopy will have a flat roof.
The applicant has provided required 35% window/door glass surfaces along the front of
the building (Stirling Road) and 15% window/door glass surfaces along the west side of
the building (SW 40th Avenue). The applicant is required to provide three "incoming"
carwash stacking spaces and two "outgoing" stacking spaces. The applicant exceeds
these requirements.
The applicant is also required to provide:
(a) 24 feet between pump islands (21 feet provided),
(b) Six foot high screen wall (site plan shows five-foot high wall).
(c) Seven foot landscape buffer against the north lot line (five feet provided).
(d) Orange Geiger Trees at least 10 feet in height.
Staff requested applicant present a color rendering of the proposed improvements so
that the Commission may evaluate the compatibility of the existing pitched roof
convenience store with the modern gas pump canopy.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval, subject to the following conditions:
(a) 24 feet between pump islands.
(b) Six foot high screen wall on both the site and landscape plans.
(c) Seven foot landscape buffer against the north lot line.
(d) Orange Geiger Tree shall be 10 feet in height.
Staff also recommends conditions (e) and (f):
(e) Parking spaces along the north lot line be reduced to 16 feet in depth
