HomeMy WebLinkAboutO-2006-042 Military Leave ORDINANCE 2006-042 AN ORDINANCE OF THE CITY OF DANIA BEACH, FLORIDA AMENDING SECTION 2-6 OF THE CITY CODE OF ORDINANCES, WHICH SECTION IS ENTITLED "MILITARY LEAVE OF ABSENCE FOR OFFICERS AND EMPLOYEES", TO PROVIDE FOR COMPENSATION AND HEALTH INSURANCE FOR PERSONS ON ACTIVE MILITARY DUTY, SUBJECT TO CERTAIN CONDITIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA THAT: Section 1. That Sec. 2-6 of the City Code of Ordinances, which Section is entitled "Military leave of absence for officers and employees", is amended to read as follows: Sec. 2-6. Military leave of absence for ^offieers and employees. Additionally, such person shall be paid the difference between such person's regular City base pay and the salary received from the military service while on such duty, for a period of six (6) months from the beginning of f the active service. The City will subsidize the person's health insurance premium for the period of the active service specified above. The subsidy will be equal to the premium subsidy otherwise granted to such person while rendering service to the City. One or more extensions of this six (6) month period may be granted if approved by the City Commission. The provisions of this Section do not apply to short term National Guard service or reserve training programs. "Short term" means a period of less than six (6) months. Section 2. That if any section, clause, sentence or phrase of this Ordinance is for any reason held invalid or unconstitutional by a court of competent jurisdiction, the holding shall not affect the validity of the remaining portions of this Ordinance. Section 3. That all ordinances or parts of ordinances in conflict with the provisions of this Ordinance are repealed. Section 4. That this Ordinance shall take effect immediately at the time of passage and adoption. PASSED on first reading on November 28, 2006. PASSED AND ADOPTED on second reading on December 12, 2006. Interested parties may appear at the aforesaid meeting and be heard with respect to the proposed. Any person who decides to appeal any decision made with respect to any matter considered at this hearing will need a record of the proceedings and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
