CONDITIONS FOR PARKING AT A RESIDENCE, PROPERTY LOCATED AT 510 SW 2ND AVE., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 16, Mobile Living Units, Section 16-2, sets the conditions for parking at residences in the City of Dania Beach; and WHEREAS, Peter Crescitelli has applied for a variance (VA-04-02)to permit the storage of a motor home in excess of 24 feet, property located at 510 SW 2"d Ave., Dania Beach; and WHEREAS, the Planning &Zoning Board on March 20, 2002, recommended that the City Commission grant variance request VA-04-02 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-04-02, for a variance as described above (from requirements in Chapter 16, Mobile Living Units), a copy of which is attached as Exhibit "A" is approved for two years, to allow a recreational vehicle trailer up to 30 feet in length to be stored adjacent to the west lot line, subject to the applicant connecting a 6 foot fence with the existing fence and a shadowbox gate to the alley and along SW 2"d Avenue, to shade the shed and recreational vehicle. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Leeds,AICP, Director Date April 10,2002 Growth Management Department City Manager Date STAFF REPORT GROWTH MANAGEMENT DEPARTMENT TO: Ivan Pato, City Manager FROM: Laurence Leeds, AICP, Director RE: Variance Request to Permit the Storage of a Motor Home in Excess of 24 Feet at a Residence Property Zoned RD-6000 - Located At 510 SW 2"d Avenue Date: April 9, 2002 Applicant: Peter Crescitelli Chapter 16 of the City Code allows unoccupied motor homes (recreational vehicle) to be parked alongside residences provided the length of the motor home does not exceed 24 feet. In this case, the property owner was cited for parking a motor home that exceeds 24 feet in length. The vehicle is stored in the rear yard of the home (see "cross-hatched" area in attached sketch) adjacent to the west lot line. The front yard of the home is SW 2"d Avenue. . The City Code provides no guidelines for evaluating this type of variance request. The decision to grant or deny this type of variance is a neighborhood level determination to be made after considering the input of the applicant and other affected parties. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION Approval to store a recreational vehicle trailer (up to 30 feet in length) adjacent to the west lot line behind the leading edge of the home facing SW 6t' Street. -20 02.DOC TRAILER VARIANCE 3 Chapter 16 MOBILE LIVING UNIT88 Sec. 16-1. Defined. As used herein, the term "mobile living unit" shall mean and refer to any type of unit, accommodation' or mechanism constructed initially on an axle (or sales) and wheels and containing any type of cooking facility or any type of bed, couch or other sleeping accommodation. The term "mobile living unit" shall include, but not be limited to, mobile _homes, house trailers, travel trailers, buses containing livings sleeping or cooking accommodations, self-contained house trailers, campers, motor homes and houses on wheels. (Code 1971, § 29-11) Sec. 16-2. Conditions for parking at residence. (a) A person who is a bona fide resident of the city may park not more than one permitted mobile living unit off the street at his place of residence in the city on condition that no persons be allowed to live in, occupy or otherwise use such mobile living unit for living or cooking purposes while same is parked as aforesaid.-A "permitted mobile living unit" shall be one where the engine, driving mechanism and transmission forms an integral part of the living unit so that the mobile living unit is capable of moving and propelling itself, or alternatively, in the cases where the mobile living unit is towed by independent means, a "permitted mobile living unit" shall be one where the body or frame is not greater than twenty-four (24) feet in length. However, as to all permitted mobile living units which are allowed to be parked under the provisions of this section, the owner shall make certain that the underside, and adjacent sides, of the parked unit shall be kept mowed, trimmed and free of weeds, trash and debris. (b) Any person who claims the right to park one permitted mobile living unit oft the street at his place of residence in the City of Dania, under the authority of subsection (a) of this section shall produce proper and written evidence to either the chief of police, building inspector or city manager (upon request being made by such officers) showing that he is the legal owner of the said permitted mobile living unit Further, the said person claiming the advantage under subsection (a) shall also show the chief of police, building inspector or city manager (upon request being made) that he is actually a bona fide resident of the city, at the address where the mobile living .unit is parked.
