DORSEY, EXECUTIVE VICE- PRESIDENT OF COMMUNITY BANK OF BROWARD, FROM CHAPTER 28 ZONING, ARTICLE 28 SIGNS, SECTION 28.110 (3)(A)&(B), FOR PROPERTY LOCATED AT 1991 STIRLING ROAD, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Article 28, sets the Signage requirements for the City of Dania Beach; and WHEREAS, Joseph C. Dorsey, Executive Vice-President of Community Bank of Broward has applied for a variance (VA-08-02) to allow the installation of a monument sign measuring 22 feet high, containing 92 square feet of sign area (80 square feet in area excluding digital clock), and set back approximately one foot from the street lot line; (The sign code allows a seven feet high monument sign containing 42 square feet of area that is setback five feet from the street lot line), for property located at 1991 Stirling Road, Dania Beach; and WHEREAS, the Planning & Zoning Board on April 17, 2002, recommended that the City Commission grant variance request VA-08-02 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-08-02, for a variance as described above (from requirements in Chapter 28, Article 28, Signs), a copy of which is attached as Exhibit "A" is approved, to allow a 22 foot high monument sign, 92 square feet of area (including 12 square foot digital clock) and the "City of Dania Beach" being added on the sign. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Requested Variance: Applicant wishes to install a monument sign measuring 22 feet high, containing 92 square feet of sign area (including 12 square foot digital clock) and set back approximately one foot from the street lot line. Permitted by Sign Code: The sign code allows a seven feet high monument sign containing 42 square feet of area that is setback five feet from the street lot line. The zoning code contains an amortization schedule that requires non-conforming signs • city-wide to conform to current sign code regulations by December, 2003. All existing non-conforming signs (excluding billboards and signs approved by sign variance or sign adjustment) must be removed or comply by this deadline. There are currently three pole signs in the general area that exceed current sign code size and/or height restrictions (ie., video store, auto repair shop, auto headliner shop). These non-conforming signs will have to comply with the sign code by December, 2003 to meet the same code requirements for which Community Bank now requests a variance. In the interest of consistency among similarly situated properties, and in anticipation of the planned compliance of non-conforming signs, staff cannot support the sign variance as requested. At the same time, staff acknowledges there are site visibility issues at this location. As such, staff can support a variance to allow a monument sign 15 feet in height and 62 square feet (including 12 square foot digital clock) in area. This is a lesser variance than requested by the applicant.
