HomeMy WebLinkAboutR-2002-065 ® \ RESOLUTION NO. 2002-065 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE SITE PLAN REQUEST SUBMITTED BY MICHAEL ISSAC REPRESENTING STIRLING STATION, INC., FOR PROPERTY LOCATED AT (NW CORNER OF STIRLING ROAD AND SW 40T"AVENUE) 5813 STIRLING ROAD, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach, Florida, states that a site plan is required as a condition to the issuance of a building permit, and WHEREAS, Michael Issac, representing Stirling Station, Inc.. has applied for site plan approval for the proposed construction of a new service station/convenience store and ® accessory use car wash to be located at 5813 Stirling Road, Dania Beach; and WHEREAS, the Planning &Zoning Board on January 16, 2002, recommended that the City Commission grant the site plan request (SP-65-01), based upon the criteria set forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application (SP-65-01) for site plan approval, a copy of which is attached and made a part of this Resolution as Exhibit"A" is approved, subject to the following conditions: a) The applicant shall work with the Growth Management Department on the landscaping. 1 RESOLUTION NO. 2002-065 b) Caps shall be added to both ends of the canopy with tile matching the design • in the center. c) Florida Power & Light may not allow a wall below the power lines. d) CPTED (Community Planning through Environmental Design) principles may dictate an alternative to a CBS screen wall. It is further noted that the original Site Plan is maintained in the office of the Growth Management Department of the City of Dania Beach. Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals shall automatically expire and become null and void unless building permits are obtained on or before 18 months from the date of this resolution. Section 3. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 4. G FROM: Laurence Leeds, AICP, Director Growth Management Department SUBJECT: SP-65-01: Site Plan Approval to Construct a New Self Service Gas Station/Convenience Food Store/Accessory Use Car Wash (Property located at the NW corner of Stirling Road and SW 40' Avenue west of FPL Power Poles) APPLICANT: Mike Isaac for Stirling Station DATE: May 14, 2002 The City of Dania Beach annexed this property in September 15, 2001. Broward County issued a "development order" (but no building permit) prior to annexation to . construct a service station/convenience food store/car wash at this location. The proposed use is located on the north side of Stirling Road directly west of SW 40t' Avenue. The buildings and canopy are located to the west of the power lines. The convenience store, gas pump canopy, and car wash are setback at least 65 feet from Stirling Road. The site plan provides 35% window/door glass surfaces along the front of the building (Stirling) and 15% window/door glass surfaces along the (east) side of the building opposite the power lines. The landscape consultant indicates the plan exceeds City landscaping requirements. There is currently a chain link fence along the west property line abutting an existing condominium. Applicant proposes a six-foot wall along the west and north lot lines. Please note: 1) FPL may not allow a wall below the power lines. 2) CPTED (Community Planning through Environmental Design) principles may dictate an alternative to a CBS screen wall. ,Approval, subject to staff retaining discretion to modify the screen wall and/or fence requirements consistent with FPL design criteria and CPTED principles. City of Dania Beach RE: Stirling Station Project Dear Larry: Per my site inspection and what plans I have reviewed, the original set � got from you and the new set I got in the mail, the following are a List of my questions, concerns and what appear to be conflicts with the Dania Landscape Code: 1 ) Code Section 26-53 Plant Material (c) ( 1 ) (2 ) ( 3 ) The new shade trees Live Oak, slack olive, Red Maple and Bald Cypress should be 14 ' ht (Black olives should be replaced with with Gumbo Limbos) The intermediate tree, Green Buttonwood should be 12 ' ht and the small trees ie. Silver Buttowwood, Geiger Tree, Wax Myrtle and Dahoon Holly should be minimum 10 ' ht. The Plant List shows smaller trees in all catagories . 2 ) Code Section 26-50 Landscape Buffers (b) ( 1 ) (2 ) ( 3) This Commercial Development should be buffered from the ad4acent residential with a 6 'masonary wall or solid wood fence 5 ' off the property line and then landscaped with a shade tree per 40 LF and a shrub per 3 LF on the residential side and a shade tree per 80 LF on the commercial side. 3 ) There are still inconsistancies with the "tree survey" (appears to be drawn not surveyed by a surveyor) which now has trees which are not there but were there but removed by FPL (based on an old survey? ) , this is per my conversation with the engineer.:of record. But there is no canopy loss calculation to determine canopy replacement other adding numerous additional trees to compensate. Also per my visual perception on site from the perimeters of the property that the existing trees are much larger in size than the plan caliper inch notations shown and so these"big" trees with large root sytems may be more affected by the z z a -ac��-n5 zZvn� proposed. • OVER 235 COMMERCIAL BOULEVARD, SUITE 207, LAUDERDALE-BY-THE-SEA, FLORIDA 33308 PHONE (954) 77 1-8 184 • FAx (954) 77 1-2780 PAGE 03 Sterling Station Cont ' d Page 2 4 ) In my opinion, there should be no upland shade trees like Live Oak planted within the wetland mitigation area but only those which have "wet foot" capability ie. Red Maple, Bald Cypress, Wax Myrtle, Ilex Cassine etc . 5 ) There is in my opinion an excessive use of Green Pittosporum shrub, a non-native tropical plant. More native shrubs should be used ie firebush, fakahatchee grass, more cocoplum, cord grass or saw palmetto . Also I am not in favor of large beds of annuals which are high maintenance and do not hold up long term but would recommend a suitable flowering native ground cover ie dune sunflower or the native lantana. b ) The general notes notes substitutions can be made by the Landscape Architect and/or owner. Substitutions should only be made after approval by the , city of Dania Beach. 7 ) My general critque of the design concept is that weather planned or unplanned the apparent random scattering and clustering of trees though acceptable Greats irregular pockets of sod which in the long term my be difficult to maintain and so turn into weed areas . Perhaps these tree mass areas could simply be well mulched with 3-4" of environmentally acceptable mulch. Let me know if there is any further information you need. R pectfully Bruce E .
