A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY DAVID ZELCH, ARCHITECT REPRESENTING THE
AMERICAN MARITIME OFFICERS `AMO' FOR THE AMO-RTM STAR CENTER
RESCUE TRAINING CENTER PROPERTY LOCATED AT SOUTH SIDE OF THE
DANIA CUT-OFF CANAL, THE NORTH SIDE OF NE 3RD TERRACE, WEST OF
GULFSTREAM ROAD, AND EAST OF THE ROYAL PALM YACHT BASIN AND
ALSO KNOWN AS THE "SCHICK PLAT", DANIA BEACH FROM CHAPTER 28,
ZONING,SECTION 7.42 AND ZONING APPENDIX ARTICLE V,SECTION 33-214;
PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, Article IV, sets the
landscaping requirements for areas separating business, commercial and industrial property from
residential property within the City of Dania Beach; and
WHEREAS, David Zelch Architect representing the American Maritime Officers,"AMO", has
applied for a variance, VA-60-01, to allow a six(6)foot high screen wall to be placed immediately
adjacent to a lot line (wall required to be setback five feet from the lot line). Property located on the
south side of the Dania Cut-off Canal, the north side of NE 3rd Terrace, west of Gulfstream Road,
and east of the Royal Palm Yacht Basin.
• WHEREAS, the Planning&Zoning Board on January 16, 2002, recommended that the City
Commission grant the variance request VA-60-01 based upon the criteria set forth in section 10.13
of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That certain application VA-60-01, for variances as described above (from
requirements in Chapter 28 Zoning), a copy of which is attached as Exhibit"A"be approved subject
to the following conditions:
a) The placement of a chain link fence next to the east lot line, instead of the
screen wall.
b) The removal of the Black Olive tree, subject to a $2,500.00 contribution to the
City Landscape Trust fund; and
b) The installation of a 48" cocoplum hedge.

Section 2. That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.
