RESOLUTION NO. 2002-074 I N F THE CITY OF DANIA BEACH A RESOLUTION O , FLORIDA AUTHORIZING THE CITY MANAGER TO PURCHASE A COMPRESSOR AND AIR FILL STATION FOR HIGH PRESSURE BREATHING AIR SYSTEM FOR THE FIRE DEPARTMENT FROM UNITED COMPRESSOR INC. IN AN AMOUNT NOT TO EXCEED $26,594.25, UNDER PALM BEACH COUNTY BID NO. 01-192/CB; PROVIDING FOR CONFLICTS, FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Charter of the City of Dania Beach, Part III, Article 3, Section 4, Subsection (J), authorizes the City Manager to purchase supplies, services, equipment and materials for the city government in amounts in excess of $15,000.00 without competitive bidding and without advertisement for bids if he is authorized to do so in advance by a resolution adopted by the City Commission and if such purchases are made pursuant to a competitive bid obtained within the last twelve (12) months by other governmental agencies such as the Federal Government, State of Florida or a Florida county or municipality; and WHEREAS, the City Manager has determined that it is necessary to purchase a compressor and air fill station for high pressure breathing air system for the Fire Department; and WHEREAS, the City Manager has determined that such air fill station and air system can be purchased at the least cost to the City from United Compressor Inc., P.O. Box 14074, North Palm Beach, Florida 33403, in the amount of Twenty Six Thousand Five Hundred Ninety Four Dollars And Twenty Five Cents ($26,594.25), under Palm Beach County Bid No. 01-192/CB. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That the proposal from United Compressor Inc. for the purchase of a compressor and air fill station for high pressure breathing air system, in an amount not to 1 RESOLUTION NO. 2002-074 0 exceed Twenty Six Thousand Five Hundred Ninety Four Dollars And Twenty Five Cents ($26,594.25), in substantial form as Exhibit "A", is approved. Section 2. That the City Manager is authorized to pay for said services from the Capital Outlay Budget Account No. 00 1-0800-56-644. Section 3. That all resolutions or parts of resolutions in 'conflict with this resolution are repealed to the extent of such conflict. Section 4. The Bid Number is 01-192/CB. United Compressor Inc. of North Palm Beach was awarded the bid. (See brochure.) As you're aware our current compressor/fill station was purchased twenty years ago and no longer meets NFPA (National Fire Protection Association) requirements. In addition, to keep the current fill station operational, a complete overhaul will be required; this, however, will not solve the problem of the current requirements by NFPA for a totally enclosed fill station for high-pressure air cylinders. In our current budget under "capital outlay", in account No. 001-22-0800-56-644 (Machines and Equipment), there are sufficient funds to purchase the compressor and air fill station. The bid price is $28,094.25. We were given $1,500.00 trade-in on our current fill station which brings the price to $26,594.25. This purchase includes labor and all the equipment required to fill our air cylinders and is NFPA compliant. We are able to take advantage of a bid price that Palm Beach County received based on their purchase of several compressors and fill stations at the same time. This is a continuation of a capital project which began last year in which our old low pressure, obsolete, self contained breathing apparatus were phased out and new, high pressure air packs were purchased. The purchase of the compressor/fill station completes this project other than our usual request each budget to boy 2 or 3 air packs to build up our inventory and rotate our units a they become unusable due to the extreme environment in which they are required to operate. Page 5 9. AWARD(ALL-OR-NONE) Palm Beach County will award this bid to the lowest,responsive,responsible bidder on an all-or-none, total offer basis. 10. METHOD OF ORDERING (PURCHASE ORDER) Items shall be ordered via individual purchase order. Invoices must reflect purchase order number. 11. F.O.B. POINT The F.O.B.point shall be destination. Exact delivery point will be indicated on the purchase order(PC).Bid responses showing other than F.O.B. destination will be rejected. Bidder retains title and assumes all transportation charges,responsibility, liability and risk in transit,and shall be responsible for the filing of claims for loss or damages. 12. DELIVERY/INSTALLATION Delivery/Installation shall be completed within 60 calendar days after receipt of purchase order(PC)unless a modified delivery date has been requested by the successful bidder and approved in writing by the Purchasing Department or the designated County agent. Failure of the successful bidder to perform to the delivery/installation requirement is sufficient cause for default and termination of the contract. 13. INSTALLATION/ACCEPTANCE Awardee is responsible for a complete installation, including but not limited to, off loading, uncrating, setting in place and test'.ng. Acceptance of system is based on a"turnkey" installation which requires that the system be complete and functioning in accordance with the specifications provided herein and all applicable industry and safety standards. Palm Beach County shall provide the power source to the breathing air system. Id. ADDITIONAL QUANTITIES For a period not exceeding 12 months from the date of bid award, Palm Beach County reserves the right to purchase from the successful bidder any amount of additional systems at the prices bid in response to this Invitation and under the same Terms and Conditions. If the supply of additional quantities is not acceptable to the bidder, the bid response page must be noted "Bid is for specified quantity only." 15. INFORMATION AND DESCRIPTIVE LITERATURE Unless otherwise stated in these specifications,any manufacturer's names,trade names,brand names,information or catalog numbers listed in this specification are for information and not intended to limit competition. When the phrase"or equal" is used,the bidder may offer any brand for which they are an authorized representative,which meets or exceeds the specifications for any item listed in the bid.The bidder shall submit with their bid response,cut sheets,sketches,descriptive literature and/or complete specifications for said item(s). The scope of these specifications is to ensure the delivery of a complete unit ready for operations. All equipment must be new, of current manufacture in production at the time of bid opening..At least two complete shop repair manuals,maintenance instructions,and parts list must be furnished with each type of equipment at the time of delivery. WARRANTY The successful bidder shall fully warrant all equipment furnished hereunder against defect in materials and/or workmanship for a period of 12 months from date of delivery and acceptance by Palm Beach County. Should any defect in materials or workmanship,excepting ordinary wear and tear,appear during the above stated warrantyperiod,the successful bidder shall repair or replace same at no cost to Palm Beach County, immediately upon written notice from the Director of Purchasing. All warranty work shall be done"on-site"by a factory certified technician at no additional charge to Palm Beach County. Additionally,emergency service, as determined by Palm Beach County Fire Rescue, shall be provided "on-site"by factory certified technicians within 24 hours of notification during the warranty period. is. TRAINING Awardee must provide"on-site"training for Palm Beach County Fire Rescue personnel for three(3)consecutive days at no additional charge. A day shall be defined as Monday through Friday between 9:00 a.m. and 3:00 p.m. Scheduling shall be at the discretion of Palm Beach County Fire Rescue. 20. WORK SITE SAFETY/SECURITY The successful bidder shall at all times guard against damage or loss to the property of Palm Beach County,the bidder's own property, and/or that of other contractors, and shall be held responsible for replacing or repairing any such loss or damage. When applicable, the successful bidder shall provide fences,signs, barricades, flashing lights,etc.necessary to protect and secure the work site(s)and insure that all County,State of Florida,OSHA,and other applicable safety regulations are met. Additionally,successful bidder shall provide for the prompt removal of all debris from Palm Beach County property.
