A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, AUTHORIZING THE PROPER CITY OFFICIALS
TO EXECUTE VARIOUS SETTLEMENT DOCUMENTS
BETWEEN THE CITY OF DANIA BEACH AND GEORGE
CORNISH, UPON THE PURCHASE OF PROPERTY
LOCATED AT 15 NW 14T" AVENUE FROM SHAUN
SCHROEDER, AND ACCEPTING $23,000.00 TO CLEAR
ALL LIENS IN EXCHANGE FOR FULL COMPLIANCE
WITH CODE ENFORCEMENT ACTIVITIES FOR SAID
PROPERTY; AND PROVIDING AN EFFECTIVE DATE.
BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA
BEACH, FLORIDA THAT:
Section 1. That the City Commission of the City of Dania Beach accepts that certain
settlement amount of $23,000.00 and the proper City officials are authorized to execute
settlement documents between the City of Dania Beach and George Cornish relating to
certain Code Enforcement liens filed against real property at 15 NW 14 Avenue, subject
that the property must be used as a single family residence and not a duplex.
Section 2. That the City Manager and City Attorney are authorized to make minor
revisions to such Settlement Documents as are deemed necessary and proper for the
best interests of the City.
Section 3. That this Resolution shall be in force and take effect immediately upon its
passage and adoption.

Dear Ms . Johnson:
The City Commission approved George Cornish' s settlement on
the above referenced code enforcement liens for the sum of $23 , 000 .
The settlement includes a provision that the subject property
located at 15 N.W. 14th Avenue, Dania Beach, will only be used as
a single family residence.
In connection with the lien settlement, I enclose the
following items :
1 . Declaration of Restrictive Covenant signed by George
Cornish as President of GEC Enterprises, Inc . , the
property owner, which restricts the use of the subject
property to single family residence;
2 . Proposed Release and Satisfaction of Code Enforcement
Liens; and
3 . Our trust account check payable to City of Dania Beach in
the sum of $23 , 000 , together with a copy of the Gold Seal
Title Company check payable to Ryan & Ryan Trust Account
in the sum of $23 , 000 .

which is hereby acknowledged, the City of Dania Beach, Florida, a
municipal corporation existing under the laws of the State of
Florida, does hereby release the property hereinafter described
from that certain lien recorded by the Code Enforcement Board of
the City of Dania Beach, Florida, on the 7th day of December, 1999,
at Official Records Book 30073, Pages 1388 through 1391, of the
Public Records of Broward County, Florida, and that certain lien
recorded by the Code Enforcement Board of the City of Dania Beach,
Florida, on the 15" day of June, 2000, at Official Records Book
30591, Pages 997 through 1000, of the Public Records of Broward
County, Florida, and does hereby declare said liens fully
satisfied. Said property and owner are described as follows :

Dear Mr. Pato :
This letter will outline a proposal for settlement of two
foreclosure suits arising out of two code enforcement liens against
the above referenced property.
The Code Enforcement Board entered a final order on October 4 ,
1995 , citing the subject property for an abandoned vehicle and
storage of junk and trash. A fine was assessed of $75 per day.
The code board entered a second final order on January 27, 2000,
for peeling and discolored paint on the building exterior and
assessed a fine of $50 per day. The property is still in violation
and the fines total approximately $220 , 000 .
The city filed a complaint to foreclose the two liens in
August , 2001, and this case is pending in Broward County Circuit
Court, Case Number 01-14744 (05) , under the heading City of Dania
Beach vs . Shawn Schroeder, et al . There is a first mortgage
against the property which predates the city' s liens and the
defendant bank, Financial Security Savings and Loan Association, is
joined as a party in the city' s foreclosure action.

Financial Security Savings and Loan assigned its mortgage to
Residential Funding Corporation and a second foreclosure suit was
filed by Residential Funding Corporation against Shaun Schroeder,
the City of Dania Beach, and others seeking to foreclose the first
mortgage. The balance due on the first mortgage when the complaint
was filed in February, 2002 , totaled $26, 554 . It is expected that
the amount due at foreclosure sale, including accrued interest,
costs and attorneys' fees will be approximately $30, 000 on the
first mortgage .
The subject property is a duplex with both units being two
bedroom one bath apartments . The property appraiser has assessed
the duplex at $48 , 420 . The fair market value of this property, if
listed with a registered real estate broker, is approximately
$65, 000 . In accordance with our discussions, I have ordered an
appraisal of this property.
My office has been contacted by George Cornish with an offer
® to purchase the city liens for a total cash amount of $23 , 000 . Mr.
Cornish is attempting to purchase the duplex from Shaun Schroeder
and must pay off the first mortgage and municipal liens to close
the transaction.
The city can continue with the foreclosure action or accept
the settlement proposal of George Cornish and satisfy both liens .
If the city continues with the foreclosure action, then the
property will go to a foreclose sale and the city will be required
to pay the first mortgage of approximately $30, 000 in order to
protect the city' s interest in its two Code Enforcement Board
'Liens . The city would then begin the process to declare this
duplex as surplus property and offer the property for sale . In the
alternative, the city can accept the proposal of George Cornish and
settle its liens without incurring additional expenses in the
foreclosure action.
Mr. Cornish has been advised that he will be required to
correct the code violations that are the subject of the code board
liens within twenty days after he purchases the property.
Otherwise, he would be cited for code enforcement violations . Mr.
Cornish' s written settlement offer is attached is this letter.

It is recommended the city accept the $23 , 000 offer at this
time. Please place this matter on the City Commission' s agenda for
the commission meeting on Tuesday, May 28`h for review and
consideration. Please contact my office if you need any
documentation or additional information on this matter.

DECLARATION OF RESTRICTIVE COVENANT
This Declaration of Restrictive Covenant is enterou into this
/C day of June, 2002 by GEC ENTERPRISES, INC . , a Florida
Corporation.
WHEREAS, GEC ENTERPRISES, INC. is the owner of real property
located at 15 Northwest 14" Avenue, Dania Beach, Florida and
legally described as follows :
All of that part of the SE 1/4 of the NE 1/4
of the SE 1/4 of Section 33, Township 50
South, Range 42 East, described as follows :
® Beginning at a point 25 feet North of the
Southwest corner of said SE 1/4 of the NE 1/4
of the SE 1/4 of Section 33, Township 50
South, Range 42 East, thence East 95 feet,
thence North 60 feet; thence West 95 feet;
thence South 60 feet to the point and place of
beginning. Also described as Lot 1 of Mizell' s
Unrecorded Subdivision.
Tax Folio Number: 0233-01-0120 -and-
WHEREAS, the above-referenced property is encumbered by two
Code Enforcement Liens from the Code Enforcement Board of the City
of Dania Beach, Florida recorded in Official Records book 30073
Page 1388 and recorded in Official Records Book 30591 Page 997,
and;
WHEREAS, the total fines accrued on the two Code Enforcement
Violations exceed $220, 000 and GEC ENTERPRISES, INC. offers to
satisfy the outstanding liens for the sum of $23, 000; and
WHEREAS, the City of Dania Beach requires a change in

permitted use of the subject property from duplex zoning to single
family residential zoning as a condition to reducing the accrued
fines .
NOW THEREFORE, GEC ENTERPRISES, INC. a Florida corporation, in
consideration of the City' s offer to reduce its fine and execute a
Satisfaction and Release of Code Enforcement Liens, does covenant
and agree as to itself, its officers, directors, administrators,
successors and assigns, that the legal permitted use of the above-
referenced property shall be limited to a single family residence.
Any deed, lease,. conveyance, or contract made in violation of
this agreement shall be void and may be set aside on petition of
the City of Dania Beach, and all its successcrs in interest or
assigns; and when any such conveyance or other instrument is set
aside by decree of a court of competent jurisdiction, all costs,
attorney fees, and expenses of such proceedings shall be taxed
against the offending party or parties, and shall be declared by
the court to constitute a lien against the real estate so
wrongfully deeded, sold, leased, or conveyed, until paid, and such
lien may be enforced in such manner as the court may order.
Any use conducted in violation of this agreement may be
prosecuted by the City of Dania Beach, its successors in interest
or assigns, in Circuit Court or before the Code Enforcement Board,
and all costs, attorney fees and expenses shall be taxed against
the offending party or parties, and shall be declared by the Court
or Board to constitute a lien against the real estate, and such
lien may be enforced in such manner as the Court or Board may
order.
This Declaration of Restrictive Covenant is a covenant running
with the land, and all successive future owners shall have the same
responsibility to comply with its provisions as the present owner
of this property.
This Declaration of Restrictive Covenant shall take effect and
be in full force when executed by the undersigned party and
recorded in the Public Records of Broward County, Florida .
IN WITNESS WHEREOF, GEC ENTERPRISES, INC. has caused this
agreement to be executed at Dania Beach, Broward County, Florida,
this day of June, 2002 .
