HomeMy WebLinkAboutR-2002-079 RESOLUTION NO. 2002-079 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE SIGN ADJUSTMENT REQUEST SUBMITTED BY VICTORIA L'ORIGINALE,FROM CHAPTER 28, ZONING, ARTICLE 28, SIGNS, SECTION 28.160 DOWNTOWN DANIA BEACH REDEVELOPMENT DISTRICT REGULATIONS, FOR PROPERTY LOCATED AT 212 NORTH FEDERAL HWY., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances Chapter 28 Zoning, Article 28, Signs, Article 28, Signs, Section 28.160 Downtown Dania Beach Redevelopment District Regulations sets the signage criteria for zoning districts within the Downtown Redevelopment District in the City Of Dania Beach; and WHEREAS, Domenico Apa owner of Victoria L'Originale, has applied for a sign adjustment (SA-18-02 ) to allow for a signage in excess of the allowed regulations in the Downtown Dania Beach Redevelopment District for property located at 212 North Federal Hwy., Dania Beach; and WHEREAS, the Planning & Zoning Board on May 17, 2002 , recommended that the City Commission grant the sign adjustment request SA-18-02 based upon the criteria set forth in Article 28, Section 28.200. "Relief from requirements; Sign Adjustment;Variances", of Chapter 28,Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application SA-18-02, for a sign adjustment from Chapter 28 Zoning, Article 28, Signage, Section Sign Regulations, a copy of which is attached as Exhibit"A" is approved, to allow a monument sign 55 square feet in area with a five foot sign setback from the road and seven feet in height. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Leeds, AICP, Director Date May 20, 2002 Growth Management Department City Manager Date CITY OF DANIA BEACH ® GROWTH MANAGEMENT DEPARTMENT STAFF REPORT TO: Ivan Pato, City Manager C G FROM: Laurence Leeds, AICP, Director Growth Management Department DATE: May 28, 2002 City Commission Meeting SUBJECT: SIGN ADJUSTMENT SA-18-02: Request by Domenico Apa of Victoria L'Originale (Property located at 212 North Federal Highway) Requested Sign Adjustment: The existing pole sign (see attached photocopy) contains approximately 50 square feet in area, is approximately 20 feet high, and is located right next to the road. Applicant wishes to replace the pole sign with a 45 square foot monument directory sign measuring 6 Y2 feet in height and setback three feet from the road. Permitted by Sign Code: The sign code allows a seven feet high monument sign containing 42 square feet of area that is setback at least five feet from the ® road. The applicant has painted wall signs on U.S. 1 and the south face of the building. An adjustment cannot be granted to allow these signs to remain. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION Approval of the monument sign as submitted. Locating a monument sign only three feet from the road may create a vision obstruction for vehicles leaving the site. Staff recommends a five foot sign setback in conjunction with a larger directory sign (approximately 55 feet square feet).
