A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY GARY POSNER, OWNER, TREASURE
COVE ASSOCIATES, LTD, FOR PROPERTY LOCATED AT
SW 45T" STREET AND SW 27T"AVENUE; PROVIDING FOR
CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Gary Posner, Owner, Treasure Cove Associates, LTD., has applied for
site plan approval for the proposed construction of a boat slip to be located at SW 45th
Street and SW 27th Avenue, Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 19, 2002, recommended that
the City Commission grant the site plan request (SP-13-02) based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-13-02)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved, with the
stipulation that the boat dock construction be limited to the area east of Ms. Gottlieb's unit
and that building permits are not to be issued for docks west of Ms. Gottlieb's unit, until the

litigation between Mr. Posner and Ms. Gottlieb is resolved and with the Planning and
Zoning Board conditions as follows:
a) Owner occupants cannot rent out docks.
b) Renter occupants cannot rent out (sub lease) docks.
It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 84(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
• are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

1. 12-foot rear yard setback(15 feet required) along SW 27" Avenue
and SW 45`h Street. For proposed deck/screen enclosure
2. 7-foot rear yard setback (15 feet required) along west property line
units 27- 34.
We are requesting a.variance for the rear yard setback for a
deck/screen enclosure for all the units within development. The
revised landscape plans attached provide for proper screening. The
over-all size of the development is 7.18 acres. Out of the 7.18 acres,
1.97 acres is existing water/proposed dock area. The proposed
deck/screen enclosures will be built on columns above the existing
grade and will not add any additional impervious area to the project.
We believe that since almost 2 acres of the over-all project is water
area that a variance should be granted for deck/screen enclosure for the
rear setbacks.

29.10. Impervious land area requirements:
® To effectively provide for the drainage of stormwater, the area of land covered by buildings, structures and
impervious surfaces shall not exceed seventy (70) percent for industrial uses, seventy (70) percent for
commercial uses and sixty (60) percent for residential uses. For the purpose of this requirement, all other uses
such as, but not limited to, utilities, transportation and office parks, shall be included in the commercial use
category. In mixed use developments, the most restrictive of the applicable impervious area limitations shall be
utilized. For purposes of this ordinance, "impervious" shall mean and refer to any area or part of any parcel of
land that has been modified to reduce the natural ability of land to absorb and hold rainfall. Any placement of
any nonorganic material which prohibits penetration by liquids or other soluble materials results in the creation
of an impervious area. For purposes of this ordinance, "pervious" shall mean the opposite of "impervious" as
defined and described above in this ordinance.
(1) Subject to compliance with all other city ordinances, pervious areas may be used to satisfy
requirements for landscaping and setbacks, buffer strips, drain fields, passive recreation areas and any
other purpose that does not require covering with a material that prevents infiltration of water into the
ground.
(2) In those cases in which city ordinances may allow some required parking stalls to be grassed, no
credit towards the computation of pervious area shall be granted for such areas.
(3) Upon demonstration by an applicant that special conditions peculiar to the location or physical
characteristics of a particular site are present, or special conditions resulting from the design of existing
facilities or surrounding land uses are present, the city commission may permit variation from the
impervious area standards, subject to the following limitations:
a. Variation from the impervious requirements shall be proportional to mitigating design
improvements provided in excess of the minimum required engineering and landscaping
standards. If a variation is granted, the impervious area shall not exceed eighty-five (85) percent
for industrial uses, eighty(80) percent for commercial uses and seventy(70) percent for residential
• uses.
b. Mitigating design improvements may include the use of grassed retention basins and swales
to aid in the filtration of storm water runoff or any combination of the foregoing.
c. Pervious paving blocks may be used in overflow parking areas, park and recreation parking
facilities and residential areas. In all cases in which pervious paving blocks are used at locations
where pedestrian traffic is prevalent, the block voids shall be planted with a nonrunner specie of
grass such as, but not limited to, zoysia or bermuda grass. Pervious paving blocks may not be
used within principal or major driveways, loading zones, or actively used parking stalls in
commercial or industrial developments.

Boat Slip Site Plan
DATE: June 25, 2002 City Commission Meeting
The subject parcel is located at the northwest corner of SW 45th Street and SW 27th
Avenue. The City Commission approved a site plan for 51 townhouse units on this
parcel on January 9, 2001. At the time of site plan approval, the developer represented
that individual boat slips were to be installed in the existing boat basin as an accessory
use to each townhouse.
The applicant subsequently revised his site plan to show 10' x 16' screened-in wood
• decks behind each townhouse. Construction of the screened-in wood decks along the
west lot line required setback and pervious area variances. The City Commission
approved the variances subject to conditions, including the installation of masonry wall
along SW 45th Street and SW 27th Avenue and provisions for additional drainage.
Construction of new boat slips (and reconfiguration of existing boat slips) is shown on
the new site plan. The Zoning Code regulates boat docks to the extent that said dock or
slip extends into a public waterway or canal. Staff has requested a legal opinion from
the City Attorney confirming application of zoning code requirements to the Dania Cut-
Off Canal.

RE: Treasure Cove / Marina Permit
Pursuant to the City's request, our office has reviewed information submitted on behalf
of Treasure Cove Associates, Ltd., including a title report prepared by Commonwealth Land
Title Insurance Company dated June 6, 2002 under Search No. 50119580, as well as an
Opinion of Title prepared by Roth, Ruosso & Darrach, P.A. dated June 12, 2002, copies of
which are attached hereto (collectively the "Title Reports") concerning the Treasure Cove
Property (the "Property") described in the Title Reports.
A review of the Title Reports was performed to determine whether there are any title
instruments which vest the encroaching neighbor, Karen Gottlieb, with title rights to the
Property. Based solely upon our review of the 'Title Reports, there do not appear to be any
instruments which vest any property, ownership or occupancy rights to Karen Gottlieb which
affect the Property.
This issue, however, is currently being litigated in Broward County under Case No. 02-
9715-CACL-03. Even though the instruments we have reviewed do not appear to affirmatively
grant any title rights to Ms. Gottlieb, a court of competent jurisdiction may find otherwise
based on further information. Additionally, a review of the legal descriptions in the Title
Reports should be performed by a surveyor in order to determine that they accurately describe
the real property at issue.

1. I own the property having a civil street address of 4473 Treasure Cove Drive,
which is immediately adjacent to the property which is the subject of the variance.
2. I am in the notice requirements under the City of Dania Beach's regulations.
3. I will suffer an immediate harm by virtue of allowing construction into the
required set-back areas adjacent to my home.
4. I have standing because I am within the zone of interest and effect relative to the
regulations from which a variance is sought in this cause.
