A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY FARAH SALEHI, REPRESENTING BELLE
COMMERCE, INC., FROM CHAPTER 28 ZONING,SECTION 27.60(REAR YARD
SETBACK) AND SECTION 29.10 (MINIMUM PERVIOUS AREA); FOR
PROPERTY LOCATED AT THE SOUTHWEST CORNER OF SE 23RD TERRACE
AND STATE ROAD 84, DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, Zoning, Section 27.60, sets
the rear yard setback requirements in the IROM (Industrial Research Office Marine)zoning district
and also that Chapter 29, Zoning, Section 29.10 sets the minimum Pervious area requirements,for
the City of Dania Beach; and
WHEREAS Farah Salehi, representing Belle Commerce, Inc. has applied for a variance
(VA-17-02) to allow:
1) An 8 foot rear yard setback (10 feet required).
2) 25% pervious area (30% pervious area required).
for property located at the southwest corner of SE 23rd Terrace and State Road 84, Dania
Beach, Florida; and
WHEREAS, the Planning & Zoning Board on June 19, 2002, recommended that the City
Commission grant variance request VA-17-02 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-17-02, for a variance as described above (from
requirements in Chapter 28, Zoning, Sections 27.60 and 29.10), a copy of which is attached as
Exhibit "A" is approved, subject to the following conditions:
a) Applicant to provide additional storm water capacity to compensate for the 5%
decrease in pervious area, said improvements to be in the form of a French drain or other on site
storm water measure to be determined by the Public Works/Utilities Director.

b) Applicant to comply with all landscape conditions.
• c) Applicant to repair and replace Awnings subject to determination by the Growth
Management Director.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

office/distribution building in an IROM zoning district
APPLICANT: Farah Salehi, representing Belle Commerce, Inc.

The subject property is located at the southwest corner of SW 23rd Terrace and
State Road 84. The property is currently vacant and includes some large black
olive trees:
IROM zoning requires a 30 foot street yard setback (State Road 84 and SW 23rd
Terrace), a 20 foot west side yard setback, and a 20 rear yard setback. IROM
zoning allows the City Commission to reduce these setbacks to 10 feet without a
variance.
The site plan proposes a 10 foot setback along State Road 84, the west lot line
(next to the hotel), and along most of the rear (south) lot line.
A small portion of the building is setback 8 feet from the rear lot line. This
requires a variance. The site plan also shows 25% pervious area. This also
requires a variance (30% required). The site plan complies with all other zoning
code requirements. Landscape review is pending.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval of the following items, subject to approval of the landscape plan by the
city landscape consultant:
1) Site plan.
2) 10 foot setbacks along the south, west, and north (SR 84) lot lines.
3) Rear yard setback variance (8 feet) and pervious area variance (25%).
