A RESOLUTION OF THE CITY OF DANIA BEACH,
FLORIDA, APPROVING THE SITE PLAN REQUEST
SUBMITTED BY FARAH SALEHI, REPRESENTING BELLE
COMMERCE, INC., FOR PROPERTY LOCATED AT THE
SOUTHWEST CORNER OF SW 23RD TERRACE AND STATE
ROAD 84, DANIA BEACH; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the
City of Dania Beach, Florida, states that a site plan is required as a condition to the
issuance of a building permit; and
WHEREAS, Farah Salehi, representing Belle Commerce, Inc., has applied for site
plan approval for the proposed construction of a 15,000 square foot office/distribution
building in an IROM (Industrial Research Office Marine)zoning district, to be located atthe
southwest corner of SW 23Id Terrace and State Road 84, Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 19, 2002, recommended that
the City Commission grant the site plan request (SP-17-02), based upon the criteria set
forth in Section 8.4 of Article 1 of Chapter 8 of the Code of Ordinances of the City of Dania
Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA BEACH, FLORIDA:
Section 1. That that certain application (SP-17-02)for site plan approval, a copy of
which is attached and made a part of this Resolution as Exhibit "A" is approved, with the
following conditions:

a) Applicant to provide additional storm water capacity to compensate for the
5% decrease in pervious area, said improvements to be in the form of a French drain or

other on site storm water measure to be determined by the Public works/Utilities Director.
b) Applicant to comply with all landscape conditions.
c) Applicant to repair and replace Awnings subject to determination by the
Growth Management Director.
It is further noted that the original Site Plan is maintained in the office of the Growth
Management Department of the City of Dania Beach.
Section 2. That based upon the criteria set forth in Section 8-4(p) of Article 1 of
Chapter 8, of the Code of Ordinances of the City of Dania Beach, all site plan approvals
shall automatically expire and become null and void unless building permits are obtained
on or before 18 months from the date of this resolution.
Section 3. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 4. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

Site Plan Fees are calculated as follows:
Residential - $275.00 Base Fee, plus $8.80 per unit for the first 100 units, plus $4.40 for each unit
In excess of 100 units.
Non-Residential I Hotel-Motel -$275.00 Base Fee, plus $1.10 per 100 sq.ft.for the first 10,000 sq.ft.
plus 0.55 per 100 sq.ft.for that portion in excess of 10,000 sq.ft.
Major revision for residential or non-residential and hotel I motel site plan—1/2of site plan fee.

SUBJECT: Variance request to allow:
8 foot rear yard setback (10 feet required)
25% pervious area (30% pervious required)
Site Plan to construct a 15,000 square foot
office/distribution building in an IROM zoning district
APPLICANT: Farah Salehi, representing Belle Commerce, Inc.
DATE: July 9, 2002 City Commission Meeting
The subject property is located at the southwest corner of SW 23`d Terrace and
State Road 84. The property is currently vacant and includes some large black
olive trees.
IROM zoning requires a 30 foot street yard setback (State Road 84 and SW 23rd
Terrace), a 20 foot west side yard setback, and a 20 rear yard setback. IROM
zoning allows the City Commission to reduce these setbacks to 10 feet without a
variance.
The site plan proposes a 10 foot setback along State Road 84, the west lot line
(next to the hotel), and along most of the rear (south) lot line.
A small portion of the building is setback 8 feet from the rear lot line. This
requires a variance. The site plan also shows 25% pervious area. This also
requires a variance (30% required). The site plan complies with all other zoning
code requirements. Landscape review is pending.
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval of the following items, subject to approval of the landscape plan by the
city landscape consultant:
1) Site plan.
2) 10 foot setbacks along the south, west, and north (SR 84) lot lines.
3) Rear yard setback variance (8 feet) and pervious area variance (25%).
