A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY STEVEN AND MELANIE REDLER, FROM
CHAPTER 28 ZONING, ARTICLE 4 DISTRICT REGULATIONS, SCHEDULE OF
LOT, YARD AND BULK REGULATIONS, FOR PROPERTY LOCATED AT 450
SE 71h Street#206, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER,
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 4 District
Regulations, Schedule of Lot, Yard and'Bulk Regulations, sets the set back requirements for the
City of Dania Beach; and
WHEREAS Steven and Melanie Redler have applied for a variance (VA-24-02)to allow an
accessory shed within one foot of a street lot (25 feet required). The shed is located to the rear of
Unit 206 and adjacent to SE 71h Street, for property located at 450 SE 71h Street, Dania Beach; and
WHEREAS, the Planning & Zoning Board on June 19, 2002, recommended that the City
Commission grant variance request VA-24-02 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-24-02, for a variance as described above (from
requirements in Chapter 28, Zoning, Article 4 District Regulations), a copy of which is attached as
Exhibit "A" is approved, subject to the applicant properly maintaining the fence for the townhome
unit.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

SUBJECT: VA-24-02 -Variance to allow an accessory shed within
one foot of a street lot (25 feet required). The shed is
located to the rear of Unit 206 and adjacent to SE 7th
Street
APPLICANT: Steven and Melanie Redler, 450 SE 7th Street, Unit 206
DATE: July 9, 2002 City Commission Meeting
The subject property is located in Townhouse East adjacent to SE 7th Street.
Code Enforcement, responding to a complaint, observed the applicant erecting
an accessory use shed without a building permit. The shed is located to the rear
of the townhouse adjacent to SE 7th Street.
The property is zoned RM-2 (Townhouse East was erected in 1974, prior to the
adoption of the current RM-2 zoning). RM-2 zoning requires a 25 foot setback
adjacent to a public street.
The shed is located within one foot of the street lot line. Other sheds, mostly
along SE 5th Avenue and SE 10th Street, are also located within one foot of the
street lot line. Some of these sheds appear to be several years old. The sheds
were not visible from the street until Townhouse East replaced several hat
racked trees with new trees last year.
The applicant's shed has the approval of the Townhouse East Condominium
president.
