RESOLUTION NO. 2002 - 125 i A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE ZONING APPEAL REQUEST SUBMITTED BY RICHARD BLACK, REPRESENTATIVE FOR THE INTERNATIONAL GAMING FISH MUSEUM (IGFA), FOR PROPERTY LOCATED AT 300 GULFSTREAM WAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Article 10.30 of Chapter 28 Zoning of the Code of Ordinances of the City of Dania Beach, Florida, states that the City Commission shall hear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by an administrative official in the enforcement of this chapter; and WHEREAS, Richard Black, representative for the International Gaming Fish Museum (IGFA), for property located at 300 Gulfstream Way, Dania Beach, has requested a zoning appeal from the following decisions of the Growth Management Director: • 1. Appealing the determination of the Growth Management Department that the outdoor display of alligators for public exhibition is not a permitted use in an IROC (Industrial Research Office Commercial) Zoning District. 2. Appealing the determination of the Growth Management Department that a 12 foot high metal chain link fence is not permitted in an IROC zoning district. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain request dated August 13, 2002(ZA-44-02)for a zoning appeal, a copy of which is attached and made a part of this Resolution as Exhibit "A", is approved: Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. DATE: August 13, 2002 City Commission Meeting APPLICANT: Richard Black, IGFA • The applicant wishes to display four live alligators in the wetland preserve area north of the Fishing Hall of Fame. Applicant wishes to enclose the alligators within a 12 foot high chain link fence installed in the wetland. It is unclear if the chain link fence will be topped with barb wire. IROC zoning does not list the "display of wild animals" as a permitted use. IROC zoning does allow freestanding museums, including "uses normally incidental and accessory to a museum." If the City Commission is favorably disposed to alligator display, the activity may be considered accessory to the IGFA Museum. Otherwise, the use would be prohibited. Staff recommends any approval place a restriction on the "number" and "species" of wild animals allowed on the site. This is because the State of Florida has granted a license (attached) that places almost no limit on the number of animals or the type of animal that may be displayed on the premises. There is no reference to fence height in IROC zoning district. The landscape code allows fences up to eight feet in height with City Commission approval. • RECOMMENDATION To be presented at the City Commission public hearing.
