HomeMy WebLinkAboutR-2002-139 RESOLUTION NO. 2002- 139 A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE REQUEST SUBMITTED BY PHIL GLASSMAN, JAXSON'S DANIA SHOPPING CENTER, FROM CHAPTER 28 ZONING, ARTICLE 6.21. OFF-STREET PARKING, FOR PROPERTY LOCATED AT 112-126 SOUTH FEDERAL HIGHWAY, DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning,Article 6.21 sets the parking requirements in the City of Dania Beach; and WHEREAS, Phil Glassman, Jaxson's Dania Shopping Center, has applied for a variance to provide approximately 100 shopping center parking spaces (137 spaces required) in order to allow a Goodwill Thrift Shop in an existing shopping center. Property located at 112-126 South Federal Highway, Dania Beach; and WHEREAS, the Planning &Zoning Board on August 21, 2002, recommended that the City Commission grant variance request VA-33-02 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-33-02, for a variance as described above (from requirements in Chapter 28 Zoning, Article 6.21 Off Street Parking) a copy of which is attached as Exhibit"A" is approved, subject to the following conditions: (1)Wall mounted rear yard exterior lighting; (2) Clean up rear yard (removal of trash and deteriorated dumpster closure); (3) Replace or repair sidewalks on the east side of NW 1st Avenue. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. DATE: August 27, 2002 APPLICANT: Phil Glassman representing Jaxson's Dania Shopping Center • Applicant is requesting a parking variance to allow a Goodwill Thrift Store in an existing shopping center. The parking variance is required because: 1) The thrift shop requires more parking than the previous retail use. 2) The "change in use" triggers application of the parking codls to the entire shopping center. Based on the existing shopping center uses and the proposed thrift shop, 137 parking spaces are required. Approximately 100 spaces are provided, including 89 spaces in front of the shopping center, and space for approximately 11 parking spaces in the rear yard. Applicant represents he has access to the parking lot in the adjacent office parking lot to the south. Staff has requested documentation of this arrangement. Staff also recommends that applicant improve the appearance of the rear yard, install additional wall-mounted lighting on the rear of the building, and take additional measures to assure the rear yard will not be used as a thrift shop drop-off area. Federal Highway Dania Beach, Florida Dear Sir/Madam: It is my understanding that during the Planning and Zoning Advisory Board meeting that took place last night, August 21', 2002, at the Dania Beach City Commission Room, to which Ms. Sandra Pollero of Modulaire Realty& Management, Inc., attended on my behalf, Mr. Paul Morzio (representing Mr. Glassman) stated that Mr. Glassman and I had had a conversation during which I agreed to let the prospective Tenant use our property's parking facilities as additional parking as required. This statement is incorrect. I did not have any such conversation with Mr. Glassman, on the other hand, we oppose to the variance for three reasons: 1) Our parking lot is private property. 2) The parking space we have is just enough for our two tenants, Vacances Air Transat Holiday and Memorial Hospital District Clinic. 3) In general, between Mr. Glassman's center, Grampa's Restaurant, and the other various commercial enterprises in the immediate area, I feel that further impact on parking would be unwise.
