A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING
A SPECIAL EXCEPTION REQUEST SUBMITTED BY ATTORNEY HARRY
HIPLER, REPRESENTING OLD DISTRICT PROMOTIONS, INC. D/B/A END
UP NIGHTCLUB AND BISTRO 19, FOR PROPERTY LOCATED AT 19
NORTH FEDERAL HWY. IN THE DANIA ANTIQUE AND JEWELRY
ARCADE, DANIA BEACH, FOR A SPECIAL EXCEPTION USE TO ALLOW
"ENTERTAINMENT" (DANCE CLUB WITH DISC JOCKEY AND/OR LIVE
BAND), AS PROVIDED FOR IN CHAPTER 28, ZONING, ARTICLE 4.20
SCHEDULE OF USE REGULATIONS; PROVIDING FOR CONFLICTS;
FURTHER, PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Chapter 28, Zoning, Article 4, District Regulations, Section 4.10,
Schedules of Regulations as a Special Exception Use In districts zoned C-2 Commercial;
and
WHEREAS, Attorney Harry Hipler, representing Old District Promotions, Inc. d/b/a
End Up Nightclub and Bistro 19, has applied for a special exception use to allow for
"Entertainment" (Dance Club with Disc Jockey and/or Live Band) at the End Up Night Club
/ Bistro 19 which is located in a C-2 Commercial zoning district, at 19 North Federal Hwy.,
Dania Beach; and
WHEREAS, the Planning & Zoning Board on August 21, 2002, recommended that
the City Commission grant the special exception request, based upon the criteria set forth
in Chapter 28, Zoning, Article 6, Supplementary Use Regulations, Section 6.40, Special
Exception Uses, of the Code of Ordinances of the City of Dania.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF DANIA, FLORIDA:
Section 1. That that certain application SE-34-02, for a Special Exception Use for
property located at 19 North Federal Hwy, a copy of which is attached and made a part of
this Resolution as Exhibit "A", is approved.
Section 2. That all resolutions or parts of resolutions in conflict with this resolution
are repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its
passage and adoption.

SPECIAL EXCEPTION
Answers to questions 1 - 14
The purpose of the Special Exception is to permit entertainment for a dance club and nightclub
with a disc jockey and music at 19 North Federal Highway that will be open beginning at 9:00 pm
and close at 4:00 am. This nightclub will be open when other businesses are closed and it will in
no way interfere with the other existing businesses, which are all located in a business district.
The nightclub will be compatible with existing businesses and area as it is located in a commercial
district. There is ample parking for the nightclub's patrons that will be provided and that exists
adjacent to the proposed nightclub as well as in the adjacent lot, at or near the post office, the city
of Dania Beach, and adjacent streets all during times when other businesses are closed. No part
of this business will interfere with any traffic on abutting streets, and there will be adequate
ingress and egress to the nightclub as well as security in the area. As to any traffic concerns, End
Up will work with the city if there are any traffic concerns, however, there should be no traffic
concerns. The nightclub will attract adult men and women over the age of 21, and there will be
no incompatible noise, lights, vibrations, fumes, odors, dusty or physical activities caused by End
Up. Applicant is unaware of any landscaping or screening that is required, however, Applicant
will comply with all requests of this nature that may be made by the city of Dania Beach. There is
no question that the use made by this proposed nightclub will be consistent with the
Comprehensive Plan. There will be no health, safety, and welfare issues of any concern in as
much as Applicant will have security persons in the parking area as well as in the nightclub. The
use of the property as a nightclub will not overburden the existing public services and facilities.
Entry and exit will be sufficiently accessible to allow entry onto the property by fire, police, rescue
s and other essential public services. The use as a nightclub will be consistent with the property and
zoning classification. The nightclub will be well run, there will be no disturbances, there will be
ample access to public roads and intersections. Adjacent properties will not be hurt, nor will this
nightclub have a detrimental effect on the future development of contiguous properties or the
general area. In fact, there has been a movement in the city of Dania Beach to redevelop
downtown by adding businesses and to provide and attract new enterprises for the benefit of the
city's residents, businesses, and visitors. Allowing a nightclub that will provide a nightlife to the
city's residents and visitors should enhance the area and help to revitalize the city. A nightclub, as
End Up, is an excellent way to help to revitalize and redevelop the city by having entertainment
for patrons to visit the city in the evening time and during the day these same patrons will in all
probability return to visit art galleries and antique shops in the city of Dania Beach. In sum, End
Up could and should become an asset to the city.
Its owners, David Rogers and Toni Barone, have a long term experience and commitment to
providing entertainment as they are the owners of an already existing nightclub called Sea
Monster and have worked in the entertainment industry for many years.

Highway, requesting the following items:
VA-34-02 — Variance to grant a Full Liquor License within
1,000 feet of a Church (1,000 foot setback from Church
required pursuant to Section 4.201 {2} of the Zoning Code).
EA-34-02 - Request to Approve an Extended Hours Liquor
License (4:00 am; 5:00 am on New Years Day).
SE-34-02 — Special Exception Request to Allow
"Entertainment" (Dance Club with Disc Jockey).
DATE: September 10, 2002 City Commission Meeting
Applicant proposes a dance club at 19 North Federal Highway (former Chocolate
Jungle). The floor plan shows approximately 3,000 square feet of customer
service area including a dance floor, video game room, and a lounge. Based on
the size of the establishment, the applicant is permitted six video games.
Rfstaurants and bars in existing buildings within the Downtown Dania
Development District are exempt from parking requirements. Nevertheless,
approximately 40 on-site parking spaces are provided. Public parking is available
on NW 15t Avenue (25 spaces) and at city hall (50 spaces). Club hours are
proposed from 9:00 pm to 4:00 am, periods during which retail businesses are
generally closed.
BSO has conducted a background check (see attached). Neither club operator
has a criminal record, nor does their current business have any record of drug
activity or arrests.
BSO has no objection to approval of the extended hour's license subject to a
reconfiguration of the parking lot such that the U.S. 1 driveway is designated "exit
only/right turn only."
This will require re-striping some parking spaces and repositioning parking stops
next to the club. Signs should also be placed to direct vehicles exiting NW 1st
• Avenue to "turn right only".
PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION
Approval of variance, extended hours, and special exception (dance club with disc
jockey), subject to the following:
1) Applicant to reconfigure parking lot in accordance with BSO report dated
July 23, 2002 prior to commencing operation.
2) Applicant allowed directional wall and/or monument signage on U.S. 1,
as approved by the Growth Management Director and BSO, to direct
incoming traffic to NW 1st Avenue (via Dania Beach Boulevard).
3) Applicant to provide exterior parking lot lighting to the side and rear of
the establishment.
4) Variance, Extended Hours, and Special Exception Approvals shall be
limited to Old District Promotions, Inc., doing business as End-Up Night
Club & Bistro 19 (Toni A. Barone and David D. Rogers).
5) Applicant to clean up and maintain parking lot on daily basis.

CITY OF DANIA BEACH
NOTICE IS HEREBY GIVEN that public hearings will be held before the Dania Beach City Commission on
Septmeber 10, 2002, at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach City Commission
Room, Administrative Center, 100 West Dania Beach Blvd., Dania Beach, Florida 33004, for the purpose of
hearing any comments which might be made to the following requests:
VA-34-02 —Variance Request by Attorney Harry Hipler, PA, representing Old District Promotions, Inc. for
property located at 19 North Federal Hwy., Dania Beach. Attorney Hipler requests approval of the following
variances:
1. Variance to grant a Full Liquor License for Bistro 19 Nightclub within 1,000 feet of a Church (1,000 foot
setback from Church required pursuant to Section 4.201 {21 of the Zoning Code). Property located at
19 North Federal Highway.
2. Request to Approve an Extended Hours Liquor License (4:00 am; 5:00 am on New Years Day) for
Bistro 19 Nightclub. Property located at 19 North Federal Highway.
3. Special Exception Request to Allow "Entertainment" (Dance Club with Disc Jockey and/or live band)
pursuant to Section 4.20 (Schedule of Use Regulations) of the Zoning Code. Property located at 19

The property is legally described as Lots 11 through 16, inclusive less any portions thereof given for street
uurposes, Block 13 of TOWN OF MODELO (now Town of Dania) a subdivision according to the plat thereof
corded in Plat Book B, at Page 49 of the Public Records of Dade County, Florida.
