DISTRICT#2 — DANIA BEACH SUBSTATION, 803 NW 1ST AVENUE; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA, THAT: SECTION 1: That the recommendation from Chief Bryan Cowart, District II Dania Beach, to use $16,825.00 from Law Enforcement Trust Funds, covering costs associated with the installation of telephone systems, computer lines and security cameras for BSO Substation at 803 NW 1st Avenue, in substantial form as Exhibit"A", attached, is approved. District #2- Dania Beach substation proceeds at a rapid pace, it is now time to look at securing the necessary final components to ensure the substation is ready for staffing when complete. I have worked with representatives of the Broward Sheriff's Office Bureau of Information Resource Management (BIRM) to secure quotes for the installation of telephone and computer lines as well as surveillance cameras for the new facility. It is necessary for . this equipment to be installed prior to B.S.O. personnel moving into the building. Attached is a memorandum from Lieutenant Jim Fondo detailing these estimates along with copies of the quotes that have been received from various vendors. I request that the City of Dania Beach authorize the use of Law Enforcement Trust Funds to secure the purchase and installation of these items. On September 10, 2002, 1 spoke with City Attorney Tom Ansbro who suggested that a resolution be prepared for approval by the commission for the expenditure of Law Enforcement Trust Funds. Upon receipt of the approved resolution, I will submit the request to B.S.O. Administration for processing. Scope of work: TELDAR TELECOMUNICATIONS will provide, install and test the following; 1) 22 cable runs 4 pair of cat-5 plenum terminated at both ends. Station ends will be terminated on a cat-5 rj-45 connector installed on a Quad faceplate. Equipment side will be terminated on a 24 port cat-5 patch panel, mount ed on a swing ez rack ( 19"Wx18"Dx357). 2) 22 cable runs 4 pair of cat-3 plenum terminated at both ends. TelDar warrants that for a period of one(1)year from the completion of installation,the Equipment and its installation will be free from defects or malfunction in equipment, material and workmanship.If TelDar is notified of any defects within the above one(1)year period, TelDar will have the option of repairing or replacing the,Equipment;,or its installation at its expense.--This warranty does not extend to any Equipment which has been(a)subject to misuse, neglect,accident,fire,lightning or other casualty,(b)wired, installed, repaired or altered by anyone other than TelDar or its authorized representatives,.or(c)moved from its original location or no longer owned by the Customer named herein. The above warranty is in lieu of and excludes all other expressed and implied warranties,including any warranty of merchantability or fitness for a particular purpose.In no event shall TelDar be liable for loss of profits,benefits,indirect consequential or similar damages,except in the event of negligence by TelDar:.In no event shall TelDar's liability exceed the total purchase price'for the equipment in question regardless of the form in which any legal or equitable action may be brought against TelDar. TelDar is excused from and shall nor be liable for failure to perform or to continue service if it is prevented from doing so by reason of fire, flood,strike,lockout,and inability to obtain material,commotion,war,act of God,or any other cause beyond TelDar's control. When,possible, TelDar agrees to resume performance under the contract as soon as practicable and will honor its original proposal. This contract constitutes the entire agreement between the parties relative to the materials listed in this quote and the installation on it and supersedes all prior negotiations and statements.This agreement may not be amended or supplemented except by an instrument in writing. In . the case of TelDar, such execution must be by a general manager or a corporate officer. If any provision of this Contract shall be held to be invalid,illegal or unenforceable the validity,legality or enforceability of the remaining provisions shall be in no way affected or impaired. If the customer breaches any provision of this Contract,including without limitation,its payment obligations,customer shall be in default and all unpaid amounts become immediately due and payable and TelDar shall have all rights and remedies of a secured party under the Uniform Commercial Code and any other applicable laws.Until any such default is cured,TelDar may cease to perform its obligations under this contract,including but not limited to its obligations to install,service,repair or replace the Equipment.The prevailing party shall be entitled to recover all costs and expenses including reasonable attorney fees and costs of collection,associated with enforcing its rights hereunder. TelDar will remain as the sole owner of all equipment installed by TelDar until it has been paid in full according to the payment terms of this contract.TelDar shall have the rights and remedies to remove the system and all miscellaneous equipment installed by TelDar if necessary. The customer will not be entitled to any refund of the amount paid to TelDar upon execution of this contract. TelDar may charge interest on overdue amounts at the rate of 1.5%per month, but not in excess of the highest interest rate permitted by law. TelDar has the right to charge a$25.00 fee for each returned check.
