HomeMy WebLinkAboutR-2002-175 RESOLUTION NO. 2002- 175 A RESOLUTION OF THE CITY OF DANIA BEACH, APPROVING THE VARIANCE REQUEST SUBMITTED BY CHRISTOPHER CUTRO REPRESENTING ALEKSANDER ZWOLINSKI, OWNER OF UMT MARINE SERVICES, INC., FROM CHAPTER 28 ZONING, ARTICLE 27 (IROM) DISTRICT AND CHAPTER 26 VEGETATION, FOR VACANT PROPERTY LOCATED ON THE WEST SIDE OF RAVENSWOOD ROAD, NORTH OF SW 42 STREET AND SOUTH OF SW 39T" STREET., DANIA BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 27 sets the zoning requirements in the Industrial Research Office Marine (IROM) district, and Chapter 26 Vegetation sets the Landscaping requirements in the City of Dania Beach; and WHEREAS, Christopher Cutro, representing Aleksander Zwokinski, owner of UMT Marine, has applied for a variance (VA-14-02) to allow the following: • 1. Variance to allow generalized landscape variance from Chapter 26 (Vegetation) of the City Code. 2. Variance to construct an industrial/warehouse/showroom building a five foot rear yard setback (Minimum 10 feet required). for property located on the west side of Ravenswood Road, North of SW 42 Street and South of SW 39th Street in the City of Dania Beach; and WHEREAS, the Planning &Zoning Board on August 21, 2002, recommended that the City Commission grant variance request VA-14-02 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-14-02, for a variance as described above 1 RESOLUTION NO. 2002- 175 (from requirements in Chapter 28, Zoning, and Chapter 26 Vegetation) is approved, subject to an extra set of canopyawnings being added to match the other two awnings on the 9 9 9 windows and a contribution to the City's tree fund as determined by Bill Tesauro, City's Landscape Consultant. Section 2. That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. Variance to construct an industrial/warehouse/showroom building with a five foot rear yard setback (Minimum 10 feet required). SP-14-02 - Site Plan Approval for the proposed construction of a 7,000 sq. ft. industrial /warehouse / showroom building. DATE: September 24, 2002 The applicant proposes a new 7,000 square foot industrial/warehouse/showroom building on the west side of Ravenswood Road, immediately south of Flossie's Bar. The property is zoned IROM. The building will be occupied by UMT Industries, currently located on NE 1st Street just east of U.S. 1. The site plan complies with parking (13 spaces provided) and pervious area (35% provided) requirements. Side Yard Setbacks: The required interior side yard shall be a minimum of twenty (20) feet. The City Commission may reduce the twenty (20) foot setback requirement to 10 feet if the size, width, depth, configuration, or location of a parcel makes it impractical to provide the required setback. The small size (less than Y acre) and narrow width (82 feet) of this parcel support 10 foot side yard setbacks along the north and south lot lines. The applicant has provided additional landscaping along the north lot line next to Flossie's. Rear Yard Setback: The required interior rear yard shall be a minimum of twenty (20) feet. The City Commission may reduce the twenty (20) foot setback requirement to 10 feet if the size, width, depth, configuration, or location of a parcel makes it impractical to provide the required setback. The applicant proposes a five feet rear yard (west) setback. This requires a variance. Applicant proposes two loading doors to the rear of the building in the rear yard. Loading/Unloading Areas: Access to the loading/unloading areas shall be designed to allow trucks to enter and leave the site without having to back from Ravenswood Road. If the size or configuration of a parcel makes it impractical to enter or leave the site, the City Commission may approve trucks backing from or onto a public street. Based on the small size and narrow width of the lot, there is insufficient room for an on-site truck maneuvering area. Architecture: The architectural treatment of the building(s) should, to the greatest extent possible, based on the size, configuration, and location of the development parcel, include pedestrian scale architectural treatment, use of window and door glass, and landscaping directly adjacent to a building. While the applicant has provided additional architectural detail along the east building elevation, some of the foxtail palms are located within a proposed septic drain field. • Fire Rescue: Fire-Rescue indicates the building setback shall be less than 150 feet from a public road and the building height shall be less than 30 feet. The Fire Marshall has not indicated if the site plan included in your backup meets these specifications. PLANNING AND ZONING ADVISORY RECOMMENDATION 1. Variance to allow generalized landscape variance from Chapter 26 (Vegetation) of the City Code. Approval, subject to relocation of foxtail palm clusters and identification of sod areas. 2. Variance to construct an industrial/warehouse/showroom building with a five foot rear yard setback (Minimum 10 feet required). Approval, subject to approval of building plan by City Fire Marshall. 3.
