Home My WebLink AboutR-2002-180 RESOLUTION NO. 2002-180 A RESOLUTION OF THE CITY OF DANIA BEACH, FLORIDA, APPROVING THE FIRST AMENDMENT BETWEEN BROWARD COUNTY AND THE CITY OF DANIA BEACH FOR THE NORTHWEST BEAUTIFICATION PHASE IV PROJECT, UNDER THE 27T" YEAR COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM; PROVIDING FOR AN EXTENSION OF THE GRANT PROGRAM TO FEBRUARY 28, 2003; PROVIDING FOR CONFLICT; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain First Amendment between Broward County and the City of Dania Beach for the Northwest Beautification Phase IV Project, under the 27th Year Community Development Block Grant (CDBG) Program, in substantial form as Exhibit "A", attached, is approved and the appropriate city officials are authorized to execute it. Section 2. That_the City Manager and City Attorney are authorized to make minor revisions to said First Amendment that are deemed necessary and in the best interest of the City of Dania Beach. Section 3 That all resolutions in conflict herewith be repealed to the extent of such conflict. Section 4. ANSBRO CITY ATTORNEY • FIRST AMENDMENT to AGREEMENT Between BROWARD COUNTY and THE CITY OF DANIA BEACH for NW Neighborhood Beautification Phase IV Project IN THE AMOUNT OF $225,884 PROVIDING FOR FUNDING AND ADMINISTRATION OF COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS • FIRST AMENDMENT . to AGREEMENT Between BROWARD COUNTY and THE CITY OF DANIA BEACH for NW Neighborhood Beautification Phase IV Project IN THE AMOUNT OF $225,884 PROVIDING FOR FUNDING AND ADMINISTRATION OF COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAMS This is a First Amendment to the December 10,2001,Agreement("Agreement")made and entered into by and between BROWARD COUNTY, a political subdivision of the State of Florida, its successors and assigns, ("COUNTY"), and CITY OF DANIA BEACH, a corporate body politic of the State of Florida, its successor and assigns, ("SUBGRANTEE"), collectively referred to as "the Parties." WHEREAS, the Parties entered into the Agreement providing for funding and administration of community development block grant programs; and WHEREAS, SUBGRANTEE is seeking to amend the Agreement by requesting time extension to commence and complete Project construction; and WHEREAS, the requested amendment is necessary and reasonable under the circumstances set forth above; NOW, THEREFORE, IN CONSIDERATION of the mutual terms, conditions, promises and covenants set forth, the Parties agree as follows: 1. Article 4, Funding and Method of Payment and Provisions Relating to the use of the Funds", Section 4.11, should be amended as follows: 4.11 SUBGRANTEE agrees to expend the funds allocated to the Project by Getebe 31, 2002 February 28, 2003. All funds not expended within the term of this Agreement shall remain in the custody and control of COUNTY. 2. Article 8, Term of Agreement, should be amended as follows: This Agreement shall commence on November 1, 2001, and shall terminate on @etober 31, 2002 February 28, 2003. 3. Exhibit C, Timetable/Schedule for Project, is deleted and replaced with Exhibit C-1. 4. All other terms and conditions of the Agreement not inconsistent herewith shall remain in full force and effect and are to be performed at the level specified in the Agreement.
