RESOLUTION NO. 2002-185 A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE REQUEST SUBMITTED BY DAVID ZELCH, ARCHITECT, REPRESENTING AMERICAN MARITIME OFFICERS (AMO) FOR PROPERTY LOCATED AT 601 SOUTH FEDERAL HIGHWAY, DANIA BEACH; FROM CHAPTER 26 VEGETATION AND FROM CHAPTER 28, ZONING; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Dania Beach Code of Ordinances, Chapter 26, sets the landscaping requirements for the City of Dania Beach; and WHEREAS, the Dania Beach Code of Ordinances, Chapter 28, sets the schedule of Lot Yard and Bulk regulations; the schedule of Off-Street Parking requirements; and the pervious area requirements for the City of Dania Beach; and WHEREAS, David Zelch, Architect representing American Maritime Officers (AMO) has applied for a variance (VA-40-02) to allow the following: 1. Variance to provide 18 % pervious area (30% required). Chapter 28, Zoning, Article 29; 2. Variance to allow generalized landscape variance from Chapter 26 Vegetation; 3. Variance to construct a portion of the office building with a six foot front yard (10 feet required). Chapter 28, Zoning, Schedule of Lot Yard and Bulk regulations; 4. Variance to build an administrative office building with 48 parking spaces (54 spaces required). Chapter 28, Zoning, Article 6.21 Off-street Parking. 5. Variance to Permit a "V" Shaped Monument Sign containing 94 square feet in area, 7 Y2 feet in height (42 square foot / 7 foot height monument sign permitted.) for property located at 601 South Federal Highway, Dania Beach; and WHEREAS, the Planning &Zoning Board on August 21, 2002, recommended that the City Commission grant variance request VA-40-02 based upon the criteria set forth in section 10.13 of Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF DANIA BEACH, FLORIDA: Section 1. That that certain application VA-40-02, for variances as described above (from requirements in Chapter's 26 Vegetation and 28 Zoning), a copies of which are attached as Exhibit "A" is approved, subject to the following conditions: (1) Office building may be used only by AMO and its affiliate organizations will not be open to the public and will not be rented out to organizations not affiliated with AMO. VA-40-02 1 RESOLUTION NO. 2002-185 Meeting room attendees must park across the street at the school. (2) Contribution of$5,900.00 to city landscape fund for the removal of six (6) existing Black Olive Trees. (3) Provide the required hedge along the north perimeter next to the landscape spaces. (4) Provide the following tree and hedge specification requirements: 1) Eleven 14 foot tall trees with a 7' spread and 2" DBH 2) Six 12 foot tall trees with a 5'-6' spread and 2" DBH 3) All hedges require 2' height x 2' spread x 2' on center spacing. (5) Enter into a Payment In Lieu of Taxes Agreement prior to issuance of a building permit. (6) AMO shall resubmit a color rendering to the City Commission for approval of the colors only. (7) AMO shall provide up to 30% of runoff through the exfiltration trench. Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are repealed to the extent of such conflict. Section 3. As you may know, we participate in the operation of a world-class maritime training facility that serves both our members and commercial customers and benefit plans administration offices for our members at our present location at Federal and Dixie Highways. We will continue to provide those services at that location and we hope to do so in a way that allows us to continue to be responsible citizens and neighbors in Dania Beach. The continued operation at our existing facility will not be changed as a result of the new building. The proposed new building for which we seek a parking variance is only for the administrative offices of the Union, not for the school or the benefit plans administration offices. • Only 10-12 employees of the Union will occupy this building on a regular, daily basis. • Because our membership is widely dispersed throughout the world, our three full time service representatives who may have offices and work out of this building are on the road as much as they are in the office. • The building is not and will not be open to the public or consumers. • The only visitors on a day-to-day basis will be the occasional member or applicant who may come in for information or may walk over to the building while attending the school across the street. • Officials of the union who may attend the monthly membership meetings will occupy many of the executive offices only once a month. They will generally arrive from the Fort Lauderdale airport by cab and be housed across the street at union owned housing. There is a membership meeting once a month. On average, about 50 members attend the monthly meeting. There are approximately 20 people associated with these meetings. Those that do rent cars will park at their assigned housing and simply walk across the street to the new building. SP-40-02 - Site Plan Approval request for a proposed 15,000 sq. ft. Administrative Office Building at the southeast corner of SE 6t" Street and U.S. 1. DATE: August 21, 2002 The subject property was previously used as a bank. Applicant proposes to demolish the bank and construct a new 15,000 sq. ft. administrative office building and meeting hall. The first floor contains covered parking. The second and third floors contain offices and a large meeting hall. The building is located to the front of the lot. Parking is located under the building and to the rear of the building. • At the direction of the city landscape inspector, the applicant has preserved and/or relocated several queen palms on-site. Additional sabal palms were added along the rear, side, and front lot lines to soften the height of the building. Other existing healthy trees were preserved where possible. Six mature black olives were removed (five black olives are located in the building footprint; the sixth black olive located near the dumpster was determined to be unhealthy by the city landscape inspector). These trees must be mitigated by a contribution to the city landscape trust fund. A new screen wall is proposed along the east and south lot lines. A metal picket fence is provided along the west (US 1) and north (SE 6th Street) lot lines. The building elevation appears to provide between 25% - 30% window and door glass along US 1 (35% is required by code; however, the City Commission may approve a lower figure). The applicant has also requested a 6% pervious area variance (See attached memo from Public Works/Utilities Director dated September 27, 2002). Staff has requested the applicant indicate if this building is to stay on the tax rolls. PLANNING AND ZONING ADVISORY BOARD RECOMMENDATION • 1.
