A RESOLUTION OF THE CITY OF DANIA BEACH,APPROVING THE VARIANCE
REQUEST SUBMITTED BY GUNSTER YOAKLEY, ATTORNEYS AT LAW
REPRESETNTING DANIA DISTRIBUTION CENTRE, LTD., FROM CHAPTER 26,
(VEGETATION) AND FROM CHAPTER 28 (ZONING) ARTICLE 29; FOR
PROPERTY LOCATED ON THE SOUTH SIDE OF DANIA BEACH BOULEVARD
BETWEEN SW 12T" AVENUE (EXTENDED) AND THE C-10 CANAL, DANIA
BEACH; PROVIDING FOR CONFLICTS; FURTHER, PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Dania Beach Code of Ordinances, Chapter 28 Zoning, Article 29, sets the
Pervious area requirements for the City of Dania Beach; and
WHEREAS, the Dania Beach Code of Ordinances, Chapter 26 Vegetation, sets the
landscaping requirements for the City of Dania Beach; and
WHEREAS, the law firm of Gunster and Yoakley, representing Dania Distribution Centre,
Ltd., has applied for the following (VA-30-02):
1. Variance to provide 18% pervious area (30% required) (Chapter 28, Zoning,
Article 29);
2. Variance to allow generalized landscape variance from Chapter 26 (Vegetation)
of the City Code.
for property located on the south side of Dania Beach Blvd., between SW 121h Avenue
(extended) and the C-10 Canal, Dania Beach; and
WHEREAS, the Planning &Zoning Board on August 21, 2002, recommended that the City
Commission grant variance request VA-30-02 based upon the criteria set forth in section 10.13 of
Article 10, of Chapter 28, Zoning, of the Code of Ordinances of the City of Dania Beach;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF
DANIA BEACH, FLORIDA:
Section 1. That that certain application VA-30-02, for a variance as described above (from
requirements in Chapters 28, Zoning and 26 Vegetation), a copy of which is attached as Exhibit"A"
is approved, subject to the following conditions:
1) a) Oak trees (inside wall) to be staggered as shown on the original landscape plan.
b) Mahogany trees (outside wall) shall be setback at least 5 — 7 feet from the wall.
c) Coco plum hedge to be installed on the outside of the wall.

d) Retention area to be prohibited in the north lot line buffer.
e) Landscaping and irrigation within Dania Beach Boulevard right-of-way to be provided in
accordance with requirements of the Public Works/Utilities Director.
f) Screen wall may be concrete block, tilt wall, or poured wall construction (horizontal
slat wall prohibited).
g) Applicant to provide a detailed cross-section of east lot line buffer, including
placement of trees along slope of retention area. Retention slope not to exceed 4:1.
h) Additional landscaping (including irrigation)within SW 12th Avenue right-of-way to
be provided in accordance with requirements of the Public Works/Utilities Director.
2) No changes from the approved site plan concerning the location or type of retention
facilities, landscaping, or screen wall without the prior approval of the Growth Management
Director.
Section 2 . That all resolutions or parts of resolutions in conflict with this resolution are
repealed to the extent of such conflict.
Section 3. That this resolution shall be in force and take effect immediately upon its passage
and adoption.

VARIANCE REpUEST - Impervious Land Area Requirement
Dania Distribution Centre,Inc.(the"Applicant"),is requesting a variance from Section 29.10 of the City's Code which regulates the impervious requirements for development approval of
warehouse property. The Applicant is requesting a reduction from the pervious requirement and
provides the following information which satisfies the City's variance criteria:
CRITERIA
1. Special conditions and circumstances The special conditions and circumstances thatrelate
to this property are that: (1) the property contains a portion of the C-10 canal, which makes
up its western boundary; and (2) the proposed stormwater system as designed incorporates
additional technology which satisfies the true intent of the provision of Section 29.10 of the
Code, "to effectively provide for the drainage of stormwater".
The canal allows this property to remove an on-site stormwater retention or detention facility,
providing for the majority of the stormwater storage and pre-treatment technology to be
underground. The site plan incorporates interconnected catch basins with exfiltration
trenches,drainage wells and a control structure to provide pre-treatment prior to discharging
into the canal. The stormwater system is designed with an additional exfiltration trench to
combat the deficient pervious to impervious ratio. The proposed control structure will
regulate the amount of discharge into the canal and drainage wells are utilized to restrict the
amount of off-site discharge into the canal by discharging into the aquifer.
Since the canal is part of the overall development and will naturally absorb and move the
rainfall / stormwater from the property, the canal therefore can reduce and off-set the
pervious area required for the proposed warehouse development. The Applicant is providing
the maximum amount of pervious area as possible on the property, including green and open
space.
2. The conditions and circumstances are not caused by A licant. As stated above the
property's special condition and circumstance, being adjacent to the canal, is not caused by
the Applicant,but is part of the overall development site of which the property is a part. The
hardship is unique, not self-created and is not the result of disregard for or ignorance of the
provisions of the City's Code. The Applicant meets the true intent of the pervious
regulations to effectively provide for the drainage of stormwater by providing additional
stormwater systems to store and pre-treat stormwater prior to discharging into the canal. The
City's Code does not take into consideration properties which border surface waters or
provide greater technological means to satisfy the intent of the Code provision.
3. No special privileges will be conferred to Applicant. Applicant's project is located along
the C-10 canal and makes this property unique for stormwater issues. The Applicant is
designing a stormwater system with additional technologies to meet engineering standards
• and State requirements, and will expend a great deal of money to install and operate this
system. By granting the variance, the City will not confer special privileges upon the
Applicant. Given the development patterns in the IG and the zoning regulations on other
properties in this zoning district, it is unlikely that another applicant would be impacted by
the approval for a variance from the pervious land requirement. As stated above, this
property is very unique due to its location immediately adjacent to the C-10 canal and no
benefit is being bestowed upon the Applicant, as it is substantially mitigating its pervious
area deficit by upgrading the drainage technology for the stormwater system at the
Applicant's own cost.
4. Literal interpretation would deprive Applicant of rights. Literal application of the City's
Code regulating impervious land area required for development would deprive Applicant of
a substantial property right. Applicant has a substantial property right to construct a facility
within the bounds of the City's Code which will provide adequate pervious area. Applicant
has designed a stormwater system which effectively drains stormwater and has mitigated the
pervious requirement by incorporating additional technology meeting the requirements for
stormwater systems. Requiring the Applicant to provide additional pervious area would
reduce the development space needed for the warehouse project,creating an undue hardship
upon the Applicant.
5. Variance requested is minimum variance needed.The requested variance is the minimum
variance necessary to accomplish the Applicant's development, due to the conditions and
circumstances affecting the property. Allowing a reduced pervious requirement will make
possible the reasonable use of the property, without losing valuable property rights. As
stated above, the adjacent canal and the upgraded stormwater system will provide the
necessary instruments to effectively provide for the drainage of stormwater for pervious land
area to satisfy the intent of the Code requirement to naturally absorb and hold rainfall.
6. Variance in harmony with zoning code. The variance is in harmony with the general
purposes of the City's Code and will not be injurious to the surrounding area or public
welfare. The intent of the pervious Code requirement is to provide ample pervious area to
"effectively provide for the drainage of stormwater". The Applicant will effectively provide
for the drainage of stormwater using additional technology and engineering standards to
direct the stormwater to the necessary pre-treatment controls prior to discharging into the
adjacent C-10 canal.This system is'entirely contained on-site and granting this variance will
not be injurious to the surrounding areas. This variance will not only be in harmony with,
but will also advance the general purposes and intent of the City's Code.

VARIANCE REQUEST - Interior Landscaping Requirement
Dania Distribution Centre Inc. the"Applicant-),
( Applicant ),is requesting a variance from Section 26-48
of the City's Code which regulates the interior landscape requirements for vehicular use areas .
("VUAs"). The Applicant is requesting a reduction from the interior landscaping requirements for
VUAs and provides the following information which satisfies the City's variance criteria:
CRITERIA
1. Special conditions and circumstances The special conditions and circumstances that
relate to this property are that: (1) the proposed development will be an office/research park
use of warehouses designed to facilitate deliveries by service vehicles; and(2) the property
contains a portion of the C-10 canal, which makes up its western boundary.
The proposed development provides the required landscaping and trees around the entire
perimeter of the property to effectively shield and buffer the development from the adjacent
streets and developments. The Applicant is requesting a variance from the interior VUAs
landscaping requirements because the Code's interior landscaping VUAs requirements do
not take into account a warehouse use. The warehouse facility will be serviced by large
vehicles making deliveries. Trucks and other vehicles delivering or picking up goods to the
individual tenants in the warehouse bays will be hindered by landscaped islands and trees
within the interior driveways ofthe warehouse development. The Applicant has incorporated
as many required trees as possible within the VUAs and along the warehouse bays' facades.
In addition, due to the canal along the western edge of the development, the Applicant has
to meet increased setbacks,which decrease the area for interior VUAs. However,the canal's
western bank contains a natural vegetation buffer preserving the appearance, character and
value of the surrounding properties.
2. The conditions and circumstances are not caused hv A iicant. As stated above the
property's special condition and circumstance, being adjacent to the canal, is not caused by
the Applicant, but is part of the overall development site of which the property is a part. In
addition, the Code regulating the landscaping for interior VUAs does not take into account
warehouse designed facilities where large trucks and vehicles will need to service the
individual warehouse bays through paved driveways. The hardship is unique, not self-
created and is not the result of disregard for or ignorance of the provisions of the City's
Code. The Applicant has met all of the perimeter and other landscaping requirements and
meets the true intent ofthe interior VUAs provision by effectively buffering the development
from adjoining properties.
3. No special privileges will be conferred to Applicant. Applicant's proposed development
is a warehouse project located along the C-10 canal. The Applicant will enhance the
property by planting approximately 273 trees for the development. In addition,the Applicant
• will preserve several of the native species of trees along the canal. By granting the variance,
the City will not confer special privileges upon the Applicant. Given the development
patterns in the IG and the zoning regulations on other properties in this zoning district, it is
41 unlikely that another applicant would be impacted by the approval for a variance from the
interior VUAs landscaping requirements. As stated above, this property is very unique due
to its location immediately adjacent to the C-10 canal and no benefit is being bestowed upon
the Applicant, as it is providing for all of the required perimeter landscaping which will
effectively screen the development from adjacent properties.
4. Literal interpretation would deprive AQplicant of rights. Literal application of the City's
Code regulating interior landscaping for VUAs would deprive Applicant of a substantial
property right. Applicant has a substantial property right to construct a facility within the
bounds of the City's Code which will provide adequate landscaping for the development.
As stated above,the City's Code regulating landscaping for interior VUAs does not take into
account warehouse facilities which require trucks and service vehicles to access the
individual tenants through the development. Providing landscaped islands along driveways
between the warehouse bays would be illogical for a warehouse development,limiting access
for delivery trucks and service vehicles. In addition, requiring the Applicant to provide
additional interior landscaped VUAs, would reduce the development space needed for the
warehouse project, creating an undue hardship upon the Applicant.
5. Variance requested is minimum variance needed.The requested variance is the minimum
variance necessary to accomplish the Applicant's development, due to the conditions and
circumstances affecting the property. Allowing a reduced number of trees for the interior
VUAs will make possible the reasonable use of the property, without losing valuable
property rights. As stated above, the adjacent canal and the remaining 273 trees and
vegetation around the perimeter and throughout the development site will provide the
necessary buffer and character to satisfy the intent of the Code requirement.
6. Variance in harmony with zoning code. The variance is in harmony with the general
purposes of the City's Code and will not be injurious to the surrounding area or public
welfare. The intent of the interior landscaping VUAs Code requirement is to provide green
space throughout a development. The Applicant will effectively provide for ample green
space and vegetation throughout the warehouse development and around the perimeter to
buffer the development from adjacent properties and the street. The variance requested is
to permit the Applicant to reduce the number of required trees within the interior landscaped
VUAs. As stated above, the use of the property as permitted in the IG zoning district is for
warehouse space,where large trucks and service vehicles will access the property to deliver
and pick up goods to and from the tenants of the development. These trucks cannot
maneuver around trees and landscaped islands. This variance will not only be in harmony
with, but will also advance the general purposes and intent of the City's Code.

on the north, SW 1P Avenue (extended) on the east, the C-10 Canal on
the west, and the Stirling-Levy Commerce Park on the south.
VA-30-02 — Variance Request:

square foot Industrial/Office/Distribution Complex
DATE: November 26, 2002
The applicant proposes a new 220,000 square foot Industrial/Office/Distribution
Complex directly behind the Stirling Commerce Park. The property is zoned I-G
Industrial General. Access will be via a 25 foot easement that runs along the south lot
line and SW 12th Avenue.
No access to Dania Beach Boulevard is proposed and there are no plans to extend SW
12 Avenue to Dania Beach Boulevard. Both the Fire Marshall and Public Works/Utilities
Director have determined that adequate access has been provided (see attached letters
dated August 26, 2002 and September 17, 2002).
The site plan meets or exceeds parking, setback, loading, building height, and lot
coverage requirements. Variances have been requested for landscaping and pervious
area.
NORTH LOT LINE ADJACENT TO DANIA BEACH BOULEVARD
The applicant has provided a 17 foot wide buffer along the north lot line. The metal
picket fence has been replaced with an 8 foot wall.
The plan indicates a double row of live oak trees inside the wall and a single row of
mahogany trees located outside the wall. Staff recommends following:
a) Oak trees (inside wall) to be staggered as shown on the original landscape plan.
b) Mahogany trees (outside wall) shall be setback at least 5 — 7 feet from the wall.
c) Coco plum hedge to be installed on the outside of the wall.
d) Retention area to be prohibited in the north lot line buffer.
e) Additional landscaping (including irrigation) within Dania Beach Boulevard right-
of-way to be provided in accordance with requirements of the Public
Works/Utilities Director.

ARCHITECTURE
The applicant has revised the architecture along the north lot line to add more detail,
color, and design to the building. The combination of landscaping (both abutting the
building and adjacent to Dania Beach Boulevard), screen wall, and revised architecture
and color are consistent with what is provided in the rear yard of the Dania Boulevard
Publix.
RECOMMENDATION
VARIANCES AND SITE PLAN:

November 12, 2002, at 7:00 p.m., or as soon thereafter as possible, in the Dania Beach City Commission
